GAMMON Approved and signed by me �9 ORDINANCE NO. 6663 -79 AN ORDINANCE AMENDING CHAPTER 20 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, BY ADDING A NEW ARTICLE 10 AUTHORIZING THE BOARD OF PUBLIC WORKS TO ESTABLISH RESIDENTIAL PARKING ZONES STATE OF PURPOSE AND INTENT The Common Council recognizes that in certain residential areas which are located near industrial, commercial, educational or public service facilities there may be a traffic congestion problem caused by the parking of vehicles on certain public streets in those resi- dential areas by non - resident persons whose destination is one of the facilities described above. The Common Council further recognizes that this problem causes hazardous traffic conditions to exist in those residential areas; results in polluted air, excessive noise, and trash and refuse caused by the entry of commuter vehicles; places an unreasonable burden upon residents of those areas in gaining access to their residences; and decreases the value of the property in those areas. The Common Council, therefore, authorizes the Board of Public Works to designate certain residential areas as Residential Parking Zones in an effort to (1) reduce hazardous traffic conditions in those residential areas, (2) protect those areas from polluted air, exces- sive noise, and trash and refuse caused by the entry of commuter vehicles, (3) protect the residents of those areas from unreasonable burdens in gaining access to their residences, and (4) preserve the character of those areas as residential areas and preserve the value of the property in those areas. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. Chapter 20 of the Municipal Code of the City of South Bend, Indiana, is amended by adding a new Article 10, Section 20 -114, as follows: Sec. 20 -114 Application Process; Parking Study Authorized (a) The lawful residents of a residential area within the City may request the Board of Public Works to re- strict parking on the public streets within the resi- dential area to residents only by the establishment of a Residential Parking Zone The request shall be in the form of a petition signed by two - thirds (2/3) of the lawful residents of the residential area settin forth the boundaries of the residential area to be in- cluded in the Residential Parking Zone and an ex lanati of the need for the parking restriction. (b) Upon receipt of the petition, the Board of Public Works shall authorize a parking study of the residential area to be conducted by the Bureau of Traffic and Lighting. In conducting the study, the Bureau of Traffic and Lighting shall consider the following factors in determining whether a parking restriction for the residential area is warranted: (1) The proximity of the residential area to Industrial, commercial, educational or public _ service facilities and the off - street parking spaces available for persons uti izin�z such acilits (2) The number of vehicles operated by persons whose destination is a facility described in subsection 1 above which are parked on the public streets within the residential area under consideration—, (3) The total number of parking spaces available on the public streets within the residential area under consideration. (4) Any days of the week or times of day in which parking on the public streets within the residential area under consideration particularly may be congested. (c) The Bureau of Traffic and Lighting shall not recommend that a parking restriction is warranted unless the average number of vehicles operated by persons whose destination is a facility described in subsection (b), (1) above is in ex- cess of twenty -five percent (25 %) of the total number of parking spaces available on-the public streets within the residential area, and the total number of parking spaces on the public streets occupied by motor vehicles exceeds seventy -five percent (75 %) of the total number of parking spaces on the public streets in the residential area under consideration. The recommendation may be limited to a restriction on parking only for specific days of the week or specific times of day, and may recommend that the park- ing restriction be designated only for certain public streets within the residential area under consideration. SECTION II. Chapter 20 of the Municipal Code of the City of South Bend, Indiana, is amended by adding a new Article 10, Section 20 -115, as follows: See. 20 -115. Designation of Residential Parking Zones a) Upon Recommendation of the Bureau of Traffic and Lighting, the Board of Public Works may designate the residential area under consideration as a Residential Parking Zone. The designation shall set forth the boundaries of the residential area and the parking res- trictions shall be applicable only to the public streets of the residential area so designated. The designation shall set forth any limitations as to the days of the week or times of the day in which such restriction shall be in force. A copy of the designation shall be kept on file with the Clerk of the Board of Public Works. fib) Parking on the public streets within the residential area designated as a Residential Parking Zone shall be restricted to vehicles displaying a Residential Parking Decal issued by the Board of Public Works. Any lawful residents of the residential area so designated shall be SECTION III. Chapter 20 of the Municipal Code of the City of South Bend, Indiana, is amended by adding a new Article 10, Section 2 -116, as follows: Sec. 20 -116. Penalty When signs are erected giving notice, any motor vehicle parked in a Residential Parking Zone in violation of the restrictions for parking in the Zone and which does not display a Residential Parking Decal may be ticketed and/ or towed at the owner's expense in accordance with this Code. -2- SECTION IV. This will unable residents in neighborhoods where there is a concentration of institutional parking to limit parking in front of their homes. We have a particular problem in the Third District with parking at I.U.S.B. Even though the University has ample parking for students, they often park on residential streets.
