D. Legislative Actions: If after the Effective Date any governmental entity takes a legislative action that imposes taxes, fees, or charges on Engineer's services or compensation under this Agreement, then the Engineer may invoice such new taxes, fees, or charges as a Reimbursable Expense to which a factor of 1.0 shall be applied. Engineer shall meet any Contractor's submittal schedule that Engineer has accepted. 12. Substitutes and "or -equal ": Evaluate and determine the acceptability of substitute or "or - equal" materials and equipment proposed by Contractor, but subject to the provisions of Paragraph A2.02.A.2 of this Exhibit A. 13. Inspections and Tests: Require such special inspections or tests of Contractor's work as deemed reasonably necessary, and receive and review all certificates of inspections, tests, and approvals required by Laws and Regulations or the Contract Documents. Engineer's review of such certificates will be for the purpose of determining that the results certified indicate compliance with the Contract Documents and will not constitute an independent evaluation that the content or procedures of such inspections, tests, or approvals comply with the requirements of the Contract Documents. Engineer shall be entitled to rely on the results of such tests. 14. Disagreements between Owner and Contractor: Render formal written decisions on all duly submitted issues relating to the acceptability of Contractor's work or the interpretation of the requirements of the Contract Documents pertaining to the execution, performance, or progress of Contractor's Work; review each duly submitted Claim by Page 6 (Exhibit A — Engineer's Services) EJCDC E-500 Agreement Between Owner and Engineer for Professional Services Copyright © 2008 National Society of Professional Engineers for EJCDC. All rights reserved. Docusign Envelope ID: D6C53305-7513-4331-95AB-7279605F17A9 PART 1 Project Description, Scope of Services, and Schedule Water Wall Replacement Project City of South Bend, Indiana GENERAL: Commonwealth Engineers, Inc. (ENGINEER) shall provide the City of South Bend, Indiana (CITY) with professional engineering services to which this scope of services applies. These services include serving as the CITY's professional representative for the Project, providing professional engineering consultation and advice, furnishing civil engineering services, and other customary services incidental thereto. PROJECT DESCRIPTION: The CITY has two wells that are aging and in need of replacement. The two well replacements are at two sites further described below. The CITY plans to fund this project with local funds. Cleveland South At the Cleveland South well site, the existing well needing replacement, Well #1, is located inside the existing chemical building. This well was constructed in 1984, with the well cleaned and pump and motor last overhauled in 2018. After cleaning/overhauling, the well's lower screen was still 50% plugged and the pump was only expected to operate for another 5 years. A new well onsite is desired to replace Well #1 with the new raw water line routed to the existing chemical building for chemical dosing. The new well will be housed in a new well building, which will be expandable to house future relocated chemical equipment. Backup power already exists at the site, but the CITY would like to evaluate moving the switchgear inside. Remote level monitoring and air line for manual level measurement will be added to the new well. Due to limited available budget, the CITY desires the option to eliminate the well building from the scope. Pinhook The Pinhook well site has five existing wells, with Wells 1-4 located along Pinhook Lake constructed in 1961, and Well 5 located inland constructed in 2004. The 12-inch raw water lines from each well converge into a 24-inch raw water line which is routed to the existing Pinhook Water Treatment Plant. The four wells located along the lake contain elevated PFAS levels, are located outdoors (prone to freezing), and are aging, while the inland well has lower PFAS levels and is housed in a well house. The second well from west, Well 3, is the targeted well to decommission and relocate, while the CITY desires a plan for relocation of the other three wells (1, 2, and 4). The new well will be housed in a new well building and will have provisions for remote level monitoring, air line for manual level measurement, and receptacle for connection to a portable backup generator. Due to limited available budget, the CITY desires the option to eliminate the well building from the scope. 6/30/2025 Commonwealth Engineers Inc. Docusign Envelope ID: D6C53305-7513-4331-95AB-7279605F17A9 The project consists of the following: • Cleveland South: The new well location will be identified and reviewed with the CITY prior to completing the new well site survey permitting process. Test drilling, test well development, and well sampling for IDEM water quality parameters will be conducted near the proposed new well location. Concurrently with well site survey and testing, design will be conducted for a new well, well house (masonry with brick veneers), raw water site piping, and decommissioning of the old well. A mandatory deductive alternate will be included in the bid for eliminating the new well building. • Pinhook: The scope for this site is the same as Cleveland South, but at this location, a study will also be conducted to suggest locations for Wells 1, 2, and 4.
