(j-761-'� AN ORDINANCE AMENDING VARIOUS SECTIONS WITHIN CHAPTER 20 ARTICLE 9 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, COMMONLY KNOWN AS MOBILITY HANDICAPPED PARKING. STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend first passed a mobility handicapped parking law in 1978. Since the passage of this law, several concerned citizens have made recommendations to improve it. The Council therefore introduces the following bill to further strengthen this law by including a fine of $20.00 for persons illegally parking in handicapped parking spaces; marking such spaces more clearly and marked as tow away zones; and requiring that all angle parking spaces be a minimum of thirteen feet wide. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. Chapter 20, Article 9, Section 20- 112(d) of the Municipal Code of the City of South Bend, Indiana, is amended to read as follows: (d) Upon the Board's designation of a space for handicapped parking; its respective curb shall be painted blue and a sign shall be installed bearing the words: "HANDICAPPED PARKING ONLY DISABLED LICENSE OR PERMIT REQUIRED ALL OTHERS WILL BE TOWED AWAY AT OWNERS EXPENSE; and the official international wheel chair symbol or a reasonable facsimile thereof. All angle parking spaces so designated shall be at least thirteen (13) feet wide. SECTION II. Chapter 20, Article 9, Section 20- 113(b) of the Municipal Code of the City of South Bend, Indiana, is amended to read as follows: (b) Any motor vehicle found parking in areas designated for the exclusive use of mobility handicapped persons which does not bear a disabled veteran registration plate, a special registration plate, or display a South Bend Handicapped Parking Permit shall be t4:eketed fined Twenty dollars ($20.00) and towed at the owner's expense. - if found to be in violation longer than one (1) hour. Continuing violations under this Section shall constitute a separate offense and be punishable by a separate penalty for each infraction. SECTION III. This Ordinance shall be in full force and effect from and after its passage by the Common Council of the City of South Bend, Indiana, approval by the MAyor, a legal // publication. After meeting with a local organization concerned about handicapped persons, and after reviewing our law, I concluded that several amendments are in order. Overall the amendments would: (1) Require all angle parking spaces to be 13 feet wide to enable the chair lifts to properly operate. (2) Require handicapped parking spaces to have "Tow Away Zone" signs posted. (3) Include a $50.00 fine plus tow away charges for motor vehicles found illegally parking in such spaces. I believe these amendments would better serve the interests of our handicapped population. Hopefully, with the passage of this bill, and stepped up enforcement, the present parking problems will be substantially reduced. I seek your support, LAM /vld Si cerely, Lewis A. Respectfully report that they have examined the matter and that in their opinion THIS BILL SHOULD BE RECOMMENDED TO THE COUNCIL FAVORABLE., as amended: Section I (d) the sign will bear the words "Handicapped parking only disabled license or permit required all others will be towed away at owners expense. (b) The fine will be Twenty dollars and towed at owners expense if found to be in violation longer than one(1) hour.
