(,07,1g_® AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 1., SECTION 2 -11 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, COMMONLY REFERRED TO AS COMMITTEE OF THE WHOLE COUNCIL: COMPOSITION, PROCEDURE, POWERS AND DUTIES The Common Council recognizes that public hearings on all proposed ordinances and resolutions play a vital and important role. The Council further recognizes that procedures governing such public hearings should ensure fairness to all parties while maintaining order. Therefore, in the interest of clarifying the procedure used during a public hearing, the following bill is introduced. NOW, THEREFORE, BE IT ORDAINED by the Common Council for the City of South Bend, Indiana, as follows: SECTION I. Chapter 2, Article 1, Section 2 -11 of the Municipal Code of the City of South Bend, Indiana, is amended by the addition of a new sub - section (d) which shall read as follows: (d) Public hearings on all bills, proposed resolutions, and petitions shall be conducted as follows: (1) Reading of the title by the City Clerk. (2) Reports from any City Departments, Common Council Committees, or the Area Plan Commission if such item was referred for review and recommendation. (3) Formal presentation in favor, followed by members of the public supporting the item. (4) Formal presentation against the item, followed by members of the public opposing the measure. This portion shall be equal in time to the presentation in favor, or a minimum of fifteen (15) minutes if needed. (5) Five minute rebuttal for the person or persons who gave the formal presentation in favor of the item, after which the public portion of the hearing is closed. (6) Council portion. SECTION II.
