Clerk ORDINANCE NO. 6815 -80 AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 5 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, BY THE ADDITION OF SECTION 2 -61 ENTITLED OLDER ADULTS COUNCIL. STATEMENT OF PURPOSE AND INTENT The City of South Bend, Indiana, recognizes the need to increase its awareness of the special problems and needs of the urban older adults and to give proper consideration to those needs and problems while carrying on the affairs of city government. The City of South Bend, Indiana, also recognizes the need to devise and implement a means to utilize the knowledge and experience of South Bend's older adults on behalf of city government in a planned, coordinated, and meaningful manner through an ongoing and effective organization. The City of South Bend, Indiana, believes that the formation of an Older Adults Council would enable the Office of the Mayor, the Common Council and other city officials to more fully utilize the talents, skills, and knowledge of our community's older adult citizens in addressing both the special needs and problems of our older adults, and the needs and problems of all citizens of South Bend. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. Chapter 2, Article 5, of the Municipal Code of the City of South Bend, Indiana, is hereby amended by the addition of new Section 2 -61, which shall read in its entirety as follows: SECTION 2 -61 OLDER ADULTS COUNCIL (a) Legislative Findings. The South Bend Common.Council hereby finds that there is a need to more effectively and efficiently utilize the talents, skills, and knowledge of our community's older adult citizens in addressing the problems and challenges which face our City, not only those which are peculiar to older adults but those which effect all the citizens of South Bend. (b) Establishment. It is hereby declared that the establishment of an Older Adults Council, referred to herein as the "Council ", is in the public interest of the City of South Bend, Indiana. (c) Composition. The Council shall be composed of twenty -one (21) members who are residents of the City of South Bend. Seven ( 7) of whom shall be appointed by the Mayor, and fourteen (14) of whom shall be appointed by the Common Council. The Council shall be broadly representative of the community and non - partisan in nature. Membership on the Council shall be limited to older adults, herein defined as persons 55 years old and older. (d) Terms of Members. The members of the Council shall serve three year terms as members, however, the first Council shall have one -third of its membership appointed for a one (1) year term, one - third for a two (2) year term and one -third for a three (3) year term. The first Council shall have five (5) members selected by the Common Council for one year terms, five (5) members selected by the Common Council for two year terms and four (4) members slected by the Common Council for three year terms. The first Council shall have two (2) members selected by the Mayor for one year terms, two (2) members selected by the Mayor for two year terms and three (3) members selected by the Mayor for three year terms. All members shall serve at the pleasure of the appointing party. (e) Filling Vacancies. Successors to all members of the Council shall be appointed for temrs of three (3) years except when appointed to fill a vacancy, in which case such appointment shall be for the unexpired portion of the term. (f) Compensation. All members,of the Council shall serve without compensation. (g) Quorum. A majority of the membership of the Council shall constitute a quorum. (h) Official Action. It shall take the concurrence of a majority of the Council to take official action. (i) Election of Officers. Within four (4) weeks after the effective date of this ordinance, all members shall be appointed.. Within forty -five (45) days after all of the members have been ap- pointed, as herein provided, they shall hold a meeting to select a President, Vice President, second Vice President and Secretary. At the first meeting of every calendar year thereafter, such officers shall be selected in the same manner. (j) Meetings. The Council shall meet not less than nine (9) times per year at the call of the Chairman. (k) Purpose and Specific Objectives. The purpose of the Council shall be to work with the Office of the Mayor, the Common Council, and other city officials in addressing both the needs and problems of South Bend's older adults as well as the problems and challenges facing all citizens of the community. In carrying out this general purpose, the Council shall: (1) Review and evaluate, on a continuing basis, city policies, programs, and activities regarding older adults for the purpose of appraising their value and their impact on the lives of South Bend's older adults. (2) Serve as spokesmen and advocates on behalf of South Bend's older adults by conducting studies on matters of concern to older adults, developing recommendations for action if appropriate and advocating such action. (3) Advise the Mayor and Common Council concerning the special needs of older adults. (4) Serve as a liaison with city government departments, agencies, and other municipal agencies in providing services to older adults when problems arise; and to serve as a liaison between the individual citizen and the proper agency including State and National Commissions. (5) Develop as a of accumulating information and problems, and then transmitting of the City. Severability. If any provision of this ordinance is held invalid, such invalidity shall not affect other provisions or applications which can be given effect without the invalid pro- vision or application, and to that end, the provisions of this ordinance are declared to be severable. SECTION III. This ordinance shall be in full force and effect from and after its adoption by the Common Council, its approval by the Mayor, and the fulfillment of all statutory requirements. As you will recall, the month of May was Sixth District BEVERLY D. CRONE designated "Older Adults Month". In May, Mayor Parent At Large held a reception to discuss the formation of the Older RICHARD C. DOMBROWSKI At Large Adults Council— - The response at that time was over - JOHN VOORDE whelming. At Large Since then, I have aided the Mayor in chairing a meeting held on June 26th to discuss this bill further with interested Older Adults. This bill therefore, reflects many of the suggestions and recommendations received to date. I. believe the establishment of an Older Adults Council would enable the City to more fully utilize the talents, skills, and knowledge of our Older adults in trying to address their special needs and problems. Respectfully report that they have examined the matter and that in their opinion THIS BILL SHOULD BE RECOMMENDED TO THE COUNCIL FAVORABLE, AS AMENDED: Change composition of Council to 14 appointed by the Common Council and 7 appointed by the Major. Change Terms of Members to reflect the 14 appointed by the Common Council and seven by the Mayor. In (k) (2) change the paragraph to read: "Serve as spokesmen and advocates on behalf of South Bend's older adults by conducting studites on matters of concern to older adults, developing recommendations for action if appropriate and advocating such action."
