AN ORDINANCE AMENDING VARIOUS SECTIONS WITHIN CHAPTER 2, ARTICLE 1, OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, COMMONLY REFERRED TO AS THE COMMON COUNCIL STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend recognizes that it has the authority to "adopt local laws deemed necessary for the effective operation and conduct of government with respect to municipal and internal affairs." The Council further recognizes that the rules and regulations of the Council were enacted prior to the passage of the 1977 Indiana Open Door Law found at Indiana Code Section 5- 14 -1.5 -1 through 5- 14- 1.5 -7. In the interest of clarifying the regulations regarding the reporting of minutes of committee meetings of the Council, and in the interest of being consistent with the state law, the following bill is introduced. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City Of South Bend, Indiana, as follows: SECTION I. Chapter 2, Article 1, Section 2 -7 of the Municipal Code of the City of South Bend, Indiana, commonly known as Duties of City Clerk as Clerk of Council, is hereby amended by the addition of new sub - section (j) which shall read in its entirety as follows: (j) The Cit Clerk's Office shall maintain all minutes 7: 11 of the standing and special committees of the Common Council Which are dul 'filed with said office by the Chairman of the Committee. The minutes shall be maintained with the notices of such meetings in a separate and commi tee, pll folders shall be openrforepublicdinspectionh and available for copying at a reasonable cost to members of h e p ublic. t SECTION II, Chapter 2, Article 1, Section 2 -10 of the Municipal Code of the City of South Bend, Indiana, commonly known as Standing Committees of the Common Council; titles and responsibilities, is her amended by amending sub - section (f) as follows: eby (f) Responsibilities and scope of Council Committees: The general responsibilities of each Council committee shall include the right to review all legislative proposals, reports and other pertinent information under its jurisdiction; and to monitor on a continuing basis the department, bureau and public officials under its jurisdiction. South Bend, Indiana 46601 Dear Councilmen: At the June 30th meeting of the Council Rules Committee, the topic of reporting the minutes of the Council committees was discussed. Presently the Code only requires an annual written report of each committee whereas state law requires a written report of each committee within a "reasonable period of time ". In light of the apparent discrepancy between the Indiana Open Door Law and our own municipal code, the Committee is recommending that the Code be amended. Therefore, the attached bill is introduced in the hope of making our own regulations more efficient, and also consistent with state laws. This bill would basically do the following: (1) Require a written report of each committee to be filed with the City Clerk's Office within two (2) weeks after a committee meeting; and (2) Require the City Clerk's Office to maintain all reports in a permanent file so that they may be used in the future as informational and reference material. We believe these changes would help make our own rules more efficient, and would further professionalize our procedures. I seek your suppPrt of these amendments.
