GAMMON ORDINANCE NO. 6812 -80 AN ORDINANCE FIXING THE ANNUAL PAY OF POLICE OFFICERS FOR THE CALENDAR YEAR 1981 STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend, Indiana, recognizes that Indiana Code Section 18- 1 -11 -2 specifically authorizes the Common Council to set salaries for the Police Department. The Council further recognizes that its Wage Committee and the Police Officers' Wage Committee are continuing to negotiate the final provisions of this Bill which will amount to a total expenditure of approximately $383,000.00 for the 1981 calendar year. The Council will continue to carefully weigh the needs and benefits of our entire community when setting the final dollar amounts to be distributed. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I.: (a) The Common Council of the City of South Bend, Indiana, recognizes the Wage Committee of the Fraternal Order of Police, Lodge No. 36, as the sole bargaining unit for the annual salaries and fringe benefits for members of the South Bend Police Department. (b) The Council further recognizes and designates the Police Chief, Division Chiefs and Captains as the management members of the department. (c) The annual pay for the officers and sworn members of the Police Department of the City of South Bend for the 1981 calendar year, by rank, classification, and service years, shall be as follows: Police Chief . . . . . . . . . . The first service year for a police officer commences upon his being sworn in as a police officer. The police officer shall obtain his second service year on the next succeeding first day of January until he attains the maximum salary for the particular rank he may hold. SECTION II: In addition to the foregoing annual pay, the officers and members of the Police Department shall receive compensation for extra duty and specific performance and the following benefits: (a) Effective January 1, 1981, if an officer is subpoenaed to court or has to go to court or is required to appear at any given location to validate a complaint, warrant or recall, the officer shall be paid (if off duty) at the rate of time and one -half the officer's hourly rate of pay with minimum of two hours on the officer's regularly scheduled work day and four hours on the officer's regularly scheduled day off. In addition, any officers required to work overtime shall be paid at the rate of one and a half times the officer's normal rate of pay with a minimum of one hour for any overtime beyond said officer's normal work day schedule. (b) Any officers shall be entitled to receive $31.00 for each of the holidays listed below, whether such holiday is worked or not. Payment shall be made for each holiday during the pay period to which the holiday falls; however, no holiday shall be paid in advance of its occurrence. The holiday pay shall apply only to the following: New Year's Day Fourth of July Lincoln's Birthday Labor Day Washington's Birthday Columbus Day Good Friday Veteran's Day Easter Sunday Thanksgiving Day Memorial Day Christmas Day (c) For night incentive and hazard pay, $300.00 per year. SECTION III: The Common Council recommends as follows: (a) The sworn members of the Police Department shall receive an annual clothing allowance of $500.00. Such clothing allowance shall be distributed one -half by June 15, 1981, and the remaining one -half by December 15, 1981. (b) That the annual clothing allowance for those individuals holding the rank of Chief, Division Chief or Captain be in the amount of $375.00; and be distributed one -half by June 15, 1981, and the remaining one -half by December 15, 1981. (c) That the advancement of rank from Patrolman First Class to Corporal be after three complete years upon satisfactory performance of duty and promotion by the Board of Safety. (d) That a maximum of $302.00 be paid for each officer requesting Dependent Health Insurance coverage over and above what the City is presently paying, excluding Chief, Division Chief and Captains. (e) That officers working under the Overtime Foot Patrol Program be paid at the rate of $7.50 per hour. A minimum of $120,000.00 shall be appropriated for the 1981 Overtime Foot Patrol Program. (f) That no other special pay programs or salary bonuses such as S.O.S. be established, and that if such special programs are needed, that participating officers be paid ou of the Overtime monies. JOHN VOORDE At Large This Bill represents a total money expenditure of approximately $383,000.00 for the salary package for 1981, excepting the positions of Chief, Division Chiefs, and Captains. The Council`s Wage Committee desires to continue good faith negotiations with the F.O.P. Wage Committee between the filing of this Bill and its eventual passage on July 14th. Such meetings however,.will only be for the purpose of determining the final distribution of the money. There will be no new money added to this package. As you are all well aware, we have reached the absolute top dollar amount which can be offered to the Police Officers. In order to continue to operate in a fiscally responsible manner, there is no way any new money can be added.. Over the next few weeks the Council Wage Committee will attempt to meet with the Police Wage Committee and the City Administration to hammer out any further considerations which this ordinance should address. The Common Council will be updated on a continuing basis throughout these negotiations.. You can be assured that the Council Wage Committee will carefully weigh the benefits and the needs of the citizens of South Bend and of the Police Officers when determining the final figures of the Bill.
