Pm and I would like to call to order the personal and Finance Committee meeting. Bill 2533 is appointing an agent, negotiating an advisory Common Council negotiating team, represent the Common Council, and I mean South Bend Fraternal Order of Police Lodge, #36 negotiations attorney Bob Palmer. Will be our attorney representing us and. On the committee, the negotiating committee will be Sheila Niskowski, Vice President Rachel. Thomas Morgan and also myself Kenneth Lee. It is now 540 and I'd like to call to order the public works and Property Vacation Committee. Clerk Tirado, would you mind calling the roll for the committee, please? Committee Member Warner. Committee member Doctor Davis. Dr. Oliver Davis 10:19 Present. Council Chambers 10:21 Committee member Karl Littrell. Citizen Member Jason Pontch. Committee by Sher Gooden Rodgers. Committee chair nasoski present. Four members present. Thank you. We do have a quorum for the meeting and today's meeting we have before us is Bill 6424. This is a bill that I believed was tabled last December. Clerk Tirado was the person requesting Mr. Rodriguez, I believe. Was he? Did he say it was going to be? The committee meeting to speak on this or. The person who filed for the alley vacation. They were contacted, but I I don't see them present. Yeah, I I do not see him present here. Just for a little context, this bill we heard last. It was filed in October. I think we finally ended up tabling it in December. And it had to do with some issues with the vacation itself and access to his own property. Which basically would cut off access to his property. Be. And so he was going to give some time to go back over this to see in review. I see Gemma Stanton is here. Do you have any background for us, Gemma, or clarification on anything? Would you? Would you mind coming to the mic for me? Just for clarification, 'cause, this has been like going on a year. I even think further. Dr. Oliver Davis 12:20 I can't hear. So the issues that we discovered in December haven't really changed, but we did. Chris Dressel from planning and then another engineer from Public Works both met. Mr. Rodriguez, out on his property to explain why we're not sure that the vacation would actually alleviate the problem that he's experiencing. But we're we would still be able to walk him through if if he's interested. Pursuing the petition, but I thought that he might be here tonight, but if he's not here, then we don't have further. Action or updates on it. But if he reaches back out, we'll be happy to bring that back to the committee. Dr. Oliver Davis 13:59 Question. Can you hear me? Is there a timeline that we are working with that? Any deadlines coming up that? Council Chambers 14:12 Today, today, I believe was the deadline. Dr. Oliver Davis 14:15 Will. So if no if no action is taken today, what what then happens? Council Chambers 14:16 So. And and if I may, I believe that the committee would have a couple options. One is we could table it. We could send it forward with a favorable or unfavorable or no recommendation. The problem with the property is the way that the line that the next property to his if he vacates the alley, he basically cuts off access to his property. He will not be able to. Dr. Oliver Davis 14:45 Yeah. OK. Council Chambers 14:47 If you know where this is at Doctor Davis, it's right there as you're going over the track. That's his properties right there off of Walnut and the topography there is such that it would even be difficult if he were try to get a different curb cut. And there's really not enough room because that other little section of property is owned by someone else. Dr. Oliver Davis 15:07 OK. Council Chambers 15:08 So we brought all of those things to his attention back in December and I said if you do this, you cut off all the access to your property. And so this was then given him time to think about it. It is now been since filed in October. This is now June 9th of 2025. He does have some other things that he could look 'cause there's also the railroad is right there. So as you're aware, there's easements with the railroad. Dr. Oliver Davis 15:34 OK. Council Chambers 15:36 So the fact that he just isn't here after this amount of time, I would leave it up to the committee for discussion on what they feel is best moving forward. If you're OK, clerk Tirado or your staff, I think it's true that they maybe. Submitted envelopes prior to this meeting, which makes me think that they are not done with the process, so I think perhaps tabling for a few more months or giving them an ability to come back if there was a miscommunication or something like that, might be appropriate if you. Think so? Yeah. Well, they did resubmit. The envelope and we got both sent out, so it was just follow up with them at this point. Yeah, that sounds good. I just want to make sure that we're not. Slicing off the process if he wants to keep going and and he could show up at the 7:00 too. Dr. Oliver Davis 16:30 But the. Council Chambers 16:32 That could be, yeah. Dr. Oliver Davis 16:34 But questions if this does this resubmission extend his time since today's the deadline? There's a resubmission. Add a new clock? Or are we still working by the clock from December? Council Chambers 16:46 I believe that if it's up to the committee, we can either table it, give it a recommendation to move it to the Committee of the whole. He could just be. Some people don't know that it's really necessary to show up at the committee meeting and they show up at the 7:00, and if he doesn't show up at the 7:00, then if we move it out of committee, we could always table it while it's under the. Committee of the whole to give him a further opportunity, as Gemma stated. Dr. Oliver Davis 17:11 OK. Council Chambers 17:12 So if it's OK with the committee, I'm gonna go ahead. And oh, go ahead, I would point out that I've been to the site, I've been to the site and noticed that they have done some work in the alley and on the property adjacent and joining the north-south Alley to the to the east. So they're in there doing something. It appears to be to make the access from the east viable. But whether the intervening property owner is aware. Given his permission. Or. What is is unknown at this point. I have a question. So I wanna. I wanna get it clarified 'cause I've been there too. So the house is on walnut. It's right at the railroad tracks. Yep. So you can go in and you go down that little slope and then you can go all the way around the back. Yep. And come out. OK. I'm making OK now. I've been there too. And I've talked to to Mr. Rodriguez. Dr. Oliver Davis 18:04 Mm hmm. Council Chambers 18:12 I guess it was the the son. I believe it was. One was a younger man on crutches or something at the time that I went. OK, that should. I think that's Mr. Rodriguez. OK and. I think we better. I'd like to see this table and let them really 'cause. I don't think they even understood what really was going on. OK. Well, we we were pretty thorough at the December meeting. But I mean it's it is up to the committee on if they want to keep it in committee or if you want to move this forward. Dr. Oliver Davis 18:41 Thank you. Council Chambers 18:43 But regardless, you know, I believe some type of action and perhaps give him the opportunity to to so he and I'll give Gemma your team. To a little further time with him. I don't know if it's super important, but a small clarification. The alley. The right alley right of way does not go all the way through to that north-south segment. So he has access to a dead end alley, and that's his only access to his property.
