AN ORDINANCE APPROVING A CONTRACT BETWEEN
THE CITY OF SOUTH BEND, INDIANA AND THOMAS
J. BRUNNER, JR., SOUTH BEND, INDIANA, FOR
PROVIDING LEGAL SERVICES WITH RESPECT TO
THE FIRST BANK CENTER PROJECT AND CENTURY
MALL.
STATEMENT OF PURPOSE AND INTENT
To approve a Contract for Legal Services related to the First
Bank Center Project and Century Mall Project.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
Citv of South Bend. Indiana, as follows:
SECTION I. That the Contract entered into between the City of
South Bend, Indiana, and Thomas J. Brunner, Jr., South Bend, Indiana,
on the 28th day of April, 1980, for professional services concerning
the First Bank Center Project and the Century Mall project in a total
cost which will exceed $7,500.00 is hereby approved.
SECTION II. This Ordinance shall be in full force and effect
from and after its adoption by the Common Council and approval by
the Mayor.

Dear Members of the Council:

Ordinance No. 6629 -79 passed on August 27, 1979 provides that contracts
for any services where the amount to be expended shall exceed the sum
of $7,500.00 must be approved by ordinance of the Common Council. On
April 28, 1980 the Board of Public Works approved the renewal of a
contract with Mr. Thomas J. Brunner, Jr., for professional services
concerning the First Bank Center Project and the Century Mall Project
subject to the approval of the Council. Since the renewal of the
contract will result in a total cost exceeding $7,500.00, Council
approval is needed.
As you know, the First Bank Project involves FBT Corporation, Rahn
Properties, HUD and the City in a series of complex and essential
agreements among the parties which were negotiated and agreed to orally
over the past two years. Mr. Brunner has assisted the City in docu-
menting these agreements and assuring that the terms, conditions and
representations made by the parties are followed. Additionally, Mr.
Brunner is continuing work initiated in 1979 on the Tax Incremental
Bond Financing necessary for the construction of the Century Mall
Project.
No allocation of funds by the Council will be necessary as a result
of this contract. Mr. Brunner's services related to the First Bank
Project are funded by the UDAG Grant while services related to Century
Mall are funded with Community Development funds.
Your favorable consideration of this ordinance is requested.
