RESOLUTION
WHEREAS, the City of South Bend, Department of
Redevelopment, has submitted and recorded its
Dedication of streets and Utility and Construction
Easements as to Lands located in Urban Renewal
Project Ind. R-29, commonly known as the Chapin
Street Project, in the Office of the Recorder of
St. Joseph County, Indiana, on the "— day of

WHEREAS, the Board of Public Works and Safety of
the City of South Bend approved said Dedication
of Streets and Utility and Construction Easements,
NOW THEREFORE, BE IT RESOLVED, that the Board of
Public Works and Safety of the City of South Bend,
Indiana, having approved said Dedication of Streets
and Utility and Construction Easements located in
Urban Renewal Project Ind. R-29, commonly known
as the Chapin Street Project, does hereby accept
the responsibility for the repair and maintenance
of said streets dedicated in said Dedication.
The above Resolution was adopted at a regularly held
meeting of the Board of Public Works and Safety of the City
of South Bend, Indiana, on the day of 4 ,

AND CONSTRUCTION EASEMENTS

The City of South Bend, Department of Redevelopment,
hereby grants and dedicates streets upon real estate located
in the City of South Bend, St. Joseph County, Indiana, herein-
after described, for the use of the public and for street
purposes, which streets are more particularly described in
Exhibits A, B and C attached hereto and made a part hereof.
The City of South Bend, Department of Redevelopment,
hereby further grants and dedicates easements upon real estate
located in the City of South Bend, St. Joseph County, Indiana,
hereinafter described, for the use of public utilities for the
installation and maintenance of water and sewer mains and
underground electric ducts, cables and lines, which specific
easements are more particularly described in Exhibits D and E
attached hereto and made a part hereof.
The City of South Bend, Department of Redevelopment,
hereby further grants and dedicates easements upon real estate
located in the City of South Bend, St. Joseph County, Indiana,
hereinafter described, for the use of the public for the
installation and maintenance of a pedestrian overpass and

pier, including temporary construction easement therefor and
permanent easement for said pedestrian overpass and pier, which
specific easements are more particularly described in Exhibit E
attached hereto and made a part hereof.
The foregoing Dedication of Streets and Utility and
Construction Easements are to run with the land and shall be
binding on all parties and all persons claiming under them.
This Dedication of Streets and Utility and Construction
Easements is given subject to Redevelopment Plan for the Chapin
Street Project Area, Indiana R-29, which is incorporated herein
by reference, and which is recorded in the Office of the Recorder
of St. Joseph County, Indiana, in Book 220, pages 169 thru 177
inclusive.
IN WITNESS WHEREOF, the said City of South Bend, Department
of Redevelopment, has caused this Dedication of Streets and Utility
and Construction Easements to be executed in its name by Donald A.
Wiggins, its President, and its official seal to be hereunto affixed,
and attested by John E. Chenney, its Secretary, this 12th day of
May, 1967.

a line parallel to and 20.00 feet due East of the centerline of Laurel
Street, a distance of 131.36 feet; thence Southeasterly along a 20 foot

Western Avenue and the South Project Limits. Easement to contain
a 12-inch sewer and a 6" water main and Indiana and Michigan
Electric Company's Oliver duct line. Said Easement is described
as follows:
Beginning at a point on the South line of Western Avenue
317' West of the centerline of Laurel Street, thence South 0002'

An easement in the Southeast One Quarter (SE 1/4),
Section 11, Township 37 North ( T 37 N ), Range 2 East, ( R. 2 ma),
City of South Bend, Portage Township, Saint Joseph County, Indiana.
Said tract is located on West side of Chapin Street for the construction
and maintenance of a pedestrian overpass, more particularly bounded
and described as follows:
Beginning at a point on the west line of Chapin Street Three
Hundred Sixty-four and Five Tenths (364. 5) feet South of the center-
line of Western Avenue; thence South Four Degrees, Forty-one Minutes,
Forty-five Seconds East (S O4041145" E) on and along said west line
of Chapin Street a distance of Sixty-eight and Twenty-two Hundredths
(68.22) feet; thence South Eighty-nine Degrees, Fifty-two Minutes,
Forty-five Seconds West (S 89052145" W) a distance of Fifty-eight

The City of South Bend, Department of Redevelopment,

construction easement therefor and permanent sewer main easement,

Exhibit "C" attached hereto and made a part hereof.
The City of South Bend, Department of Redevelopment,
hereby further grants and dedicates easements upon real estate
located in the City of South Bend, St. Joseph County, Indiana,
hereinafter described, for the use of the public for the
installation and maintenance of a pedestrian overpass and

pier and traffic signal controller, including temporary
construction easement therefor and permanent easement for
said pedestrian overpass and pier and traffic signal
controller, which specific easements are more particularly
described in Exhibits "D" and "E" attached hereto and made
a part hereof.
The foregoing easements are to run with the land
and shall be binding on all parties and all persons claiming
under them.
This Dedication of Easements is given subject to
Redevelopment Plan for the Chapin Street Project Area,
Indiana R-29, which is incorporated herein by reference,

10" sewer located in vacated Monroe Street between Chapin and
Scott Streets.
Beginning at a point on the West line of Scott Street
388 feet South of the centerline of Western Avenue, thence South
89055'00" West parallel with and 388 feet South of the centerline
of Western Avenue a distance of 571 feet more or less to the East
line of Chapin Street; thence South 04028107" West on and along
the East line of Chapin Street a distance of 26.04 feet thence
North 89055'00" East along a line which is 26 feet South and

Beginning at a point on the West line of Scott Street
939.68 feet South of the centerline of Western Avenue; thence

East line of Chapin Street a distance of 20.39 feet thence South

Beginning at a point on the East line of Chapin Street
500 feet South of the centerline of Western Avenue, thence North

of 36.94 feet to the East line of Chapin Street thence South
04028'07" West on and along said East line of Chapin Street
a distance of 38.42 feet, thence South 00007'15" East on and
along said East line of Chapin Street a distance of 71.70
feet to the place of beginning. The permanent easement for
the pier shall be the West 20 feet thereof, and the construction
easement shall be the East 20 feet thereof.
A 15' x 15' easement for the construction and maintenance
of traffic signal controllers, more particularly described as
follows r
7-1/2 feet either side of a line described as follows:
Beginning at a point on the bisector of the center curve at the
Northwest corner of the Housing Disposition Site (which is also
the Southeast corner of the intersection of Chapin Street and
Western Avenue), 42 feet Northwesterly from the radius point
of said curve thence Northwesterly on and along said bisector
a distance of 15.0 feet to the property line.
