AN ORDINANCE AMENDING SOUTH BEND MUNICIPAL CODE
SECTION 17 -46, COLLECTION OR DEFERRED PAYMENT CHARGE
STATEMENT OF PURPOSE AND INTENT.
In order to facilitate the collection of bills from
customers for water services, it is necessary to decrease the number
of days from the due date for the imposition of a collection or
deferred payment charge for failure to pay for such services.
NOW THEREFORE, BE IT ORDAINED by the Common Council of the
City of South Bend that:
SECTION I. That Section 17 -46 of the South Bend
Municipal Code be amended to read as follows:
Section 17 -46. Collection or deferred payment charge.
All bills for water services, not paid within fifteen - {15)
five (5) days from the due date thereof, as stated in such bills,
shall be subject to a collection or deferred payment charge of ten

SECTION II. This ordinance shall be in full force and
effect from and after its passage by the Common Council, approval by
the Mayor, and publication according to statute.

I've submitted for your review and action under first readings
of the October 12, 1981 Council Meeting two ordinances which will make
language changes in the collection policy of the Utilities through the
amendment of certain sections of the Municipal Code.
As the Utilities are currently being billed on a bi- monthly basis,
the current collection policy and payment periods will not fit into
the one month billing system. Additionally, an attempt is being made
to increase our ability to deal with cronic late payers or non - payment
customers.
Currently, Municipal Code allows a grace period of 15 days after
the due date prior to an assessment of penalty. If this were continued,
penalties would not be assessed until 10 days into the next months
billing period. While this is not only bad for our attempts of better
cash management, it also would create problems in the mechanics of the
billing system itself.
While this amendment to the Code will affect when penalties are
assessed, it does not shorten the length of time customers have to pay
on their accounts. If you have questions, please feel free to contact
