Klosinski, P.E., Assistant City Engineer SUBJECT: Agenda Request: Amendment No. 2 to Professional Services Agreement Wastewater Treatment Plant WAS Thickening Improvements Project No. 123-031 / DFO PROJ00000435 DATE: May 6, 2025 The Division of Engineering recommends the Board of Public Works approve Amendment No. 2 to a Professional Services Agreement with Black & Veatch for Project No. 123-031 WWTP WAS Thickening Improvements for additional scope of work items including structural design and mechanical design elements that were required to complete the design for the subject project. In addition, this extends contract services for Construction Administration Services and the development of the HVAC air handling improvements required due to the classification of the space. Summary of Contract Costs: DFO PROJ00000435 Black & Veatch Corporation (V-00000222) PO-0025188 Original Design Fee: $528,642.00 Amendment No. 1: $ 69,585.00 Amendment No. 2 (current request): $ 99,315.00 Total (not to exceed): $697,542.00 The Department of Public Works has sufficient funds from the Fund 642 Sewage Works, Account 642-06-605-514-431002 to fund the subject project DFO PROJ00000435. AMENDMENT TO OWNER-ENGINEER AGREEMENT Amendment No. __2___ 1.Background Data: a.Effective Date of Owner-Engineer Agreement:July 25, 2023 b.Owner:City of South Bend, Indiana c.Engineer: Black & Veatch Corporation d.Project:123-031 WWTP DAF Building Improvements 2.Description of Modifications: a. Engineer shall perform or furnish the following Additional Services: Task 101 – Project Management and Administration Engineer will continue to support the project for an additional 20 months including additional project coordination, invoicing, and management. Task 104 – Design and Contract Document Development For Bid Package No. 1 (123-031A): Engineer produced three structural drawings and related specifications related to removal and replacement of the south exterior stair, foundation, and railings at the Degrit Building. For Bid Package No. 2 (123-031B): Engineer produced an additional 32 drawings, resulting in a total of 62 drawings, as well as additional technical specifications. The work included additional scope for mechanical process, structural, electrical, instrumentation and control, and plumbing disciplines. For Bid Package No. 2 (123-031B): Engineer shall design HVAC system upgrades to be included as an Addendum to the Bidding Documents. These upgrades will enable the existing DAF Building (new GBT Building) to achieve continuous ventilation at the required six Air Changes per Hour (ACH), ensuring the NEC Hazardous Location Classification of the building remains unclassified, as specified in NFPA 820 (2024), Table 6.2.2(a), Solids Treatment Processes, row 8, line c. GBT Building HVAC system upgrades involve evaluation of the existing building to establish the continuous ventilation design, and incorporation of the design into two drawings and additional specification sections. Engineer will provide a draft and final version of the HVAC system upgrade Addendum to the Owner for review and transmittal to the bidders. Task 204 – Shop Drawing and Submittal Review Engineer will review up to an additional 20 submittals and re-submittals for a total of 62 submittals and resubmittals for both project bid packages. Task 205 – Site Visits Engineer participated in five site visits for Bid Package No. 1 out of a total of four included in the project scope for both bid packages. An additional two site visits will be performed for Bid Package No. 2 for a total of seven site visits for the project. b. The Scope of Services currently authorized to be performed by Engineer in accordance with the Agreement and previous amendments, if any, is modified as follows: c.
