GAMMON 0/9 —19 f/ Ile Clerk ORDINANCE N0. t� C( -13 - Z 1 AN ORDINANCE ESTABLISHING A SERVICE FEE OF THREE DOLLARS ($3.00) FOR POLICE DEPARTMENT ACCIDENT REPORTS STATEMENT OF PURPOSE AND INTENT: The 1981 General Assembly of the State of Indiana amended I.C. 9 -3 -1 -3 to enable a police department to charge a fee for each copy of an accident report, provided that the fiscal body pass an ordinance setting that amount. NOW, THEREFORE, be it ordained by the Common Council of the City of South Bend, Indiana: SECTION I. That the South Bend Police Department charge a fee of Three Dollars ($3.00) for each copy of traffic accident reports. SECTION II. Such reports shall be supplied only to persons qualified to receive such reports under I.C. 9- 3 -1 -3. SECTION III. Fees obtained for accident reports shall be deposited in Fund #15: South Bend Police Accident Reports, and may be expended at the discretion of the Police Chief for any department purpose reasonably related to the keeping of accident reports and records or prevention of street and highway accidents. THOMPSON Chief of Police Common Council of the City of South Bend 4th Floor County -City Building South Bend, Indiana Dear Members of the Common Council: Attached for your consideration is a proposed Ordinance establish- ing a service fee of $3.00 for Police Department accident reports. Before September 1, 1981, a fee of $2.00 was established by State statute. Effective September 1, 1981, I.C. 9 -3 -1 -3 requires that the Common Council pass an Ordinance setting a service fee of at least $3.00 per report. This proposed Ordinance would bring the City of South Bend into compliance with that statute. If you have any questions, I would be happy to discuss them with you at your convenience.
