The Agenda Review Session of the Board of Public Works was convened at 10:30 a.m. on April
3, 2025, by Board President Elizabeth A. Maradik, Vice President Joseph Molnar, and Board
Members Gary Gilot, Murray Miller, Breana Micou, and Board Attorney Michael Schmidt present.
The Board of Public Works Clerk, Theresa Heffner, presented the Board with a proposed agenda
of items presented by the public and by City Staff.
Board members discussed the following item(s) from the agenda.
OPENING OF BIDS
Director of Diversity, Equity and Inclusion Cynthia Simmons asked if there would be MWBE
goals associated for item 3.A: 2025 Street and Sewer Material Bid and 3.B.: 2025 Asphalt Material
Bid.
President Maradik stated that these two (2) items are not projects, they are for materials. Attorney
Schmidt stated that it would probably be deemed to not be commercially reasonable to subdivide
like the hot mix. Mr. Miller noted that at one time, they added trucking into it the material bids.
AWARD BIDS AND APPROVE CONTRACTS
Mr. Gilot was present to ask about item 4.B.: 2025 or Newer All Wheel Drive Police Pursuit Utility
Vehicles. He raised concerns about the impact of newly announced tariffs on the cost of Chrysler
Dodge vehicles for the Police Department. He suggested delaying the award to assess the potential
increase in costs and consider adding a clause to disclose tariff impacts before awarding contracts.
He proposed that legal should think about the implications of the tariffs and whether a clause
should be added to the contract requiring vendors to disclose the impact of tariffs on their bids
before awarding the contract.
VP Molnar noted that there isn’t a car company in the world that won’t be impacted.
Attorney Schmidt discussed the possibility of suppliers increasing costs beyond their bids due to
tariffs and whether tariffs could be grounds for declaring a force majeure event. They concluded
that tariffs should not be considered a force majeure event. He added that the City experienced this
during COVID with chemical supplies. What we found was that these suppliers were able to
increase cost well beyond what they put on their bid. The City takes some risk and the supplier
takes some risk, when you award a contract, we are supposed to be locking in a price.
Mr. Gilot reiterated that since the announcement about tariffs was made yesterday, he wouldn’t
mind delaying the award to give them time to answer on how the tariffs may affect the pricing.
Director of Public Works Eric Horvath stated that it may be worse if they wait to award the
contract. They should be subject to the price, but he thinks potentially they will see future bids
being elevated. In the instance of the chemical supplies, they didn’t want to keep them to that price,
but they said they would back out and then we wouldn’t have chemicals. They couldn’t get any
other chemical suppliers, and they checked with everyone in the area. He concluded that he doesn’t
think that in a week or a month they are going to have any certainty. At some point we will just
have to move forward.
Mr. Gilot asked if the Board would like to see a standard clause added to the awards while we are
in this period of uncertainty.
Attorney Schmidt advised that it is up to the Board on how they would like this to be handled. It
is rare to have a vehicle purchase come through because they use quantity purchase agreements
(QPAs) to make acquisitions. He advised the Board to think about a recommendation that can be
voted on before Tuesday, then if the Board wants to pursue anything, they could prepare a
resolution to formalize a response to uncertainties of the tariffs and what impacts might be on the
public bids.
CHANGE ORDERS
Mr. Miller was present to ask for additional information regarding item 6.A.: Leeper Ave. Bridge
Repairs Deck Replacement. He noted that there was not a lot of information in the file.
Director Horvath advised that the work is complete, but there was money left in the contract and
the path up to the bridge structure was in bad repair, so they are just repaving that and they had to
do it in the spring.

REQUEST TO ADVERTISE FOR THE RECEIPT OF BIDS
Mr. Gilot noticed that they would be using post tension concrete for item 8.A.: VPA Leeper Courts
Reconstruction and asked if that was correct. Director Horvath noted that they could go with
asphalt and they may need to depending on prices, but they will get a much longer life out of post
tension concrete.
INDUSTRIAL WASTEWATER DISCHARGE PERMIT MODIFICATIONS
Mr. Gilot asked if the permit was just a change in ownership for item 11.A.: Toefco Engineering
LLC DBA Imagineering Enterprises LLC.
Director of Environmental Compliance Andrea Alexander stated that it is just an ownership
change, not a change in process at the facilities.
Mr. Gilot added that he thought her memo covered it well and that they assumed responsibility as
the discharge. Sometimes there's an asset purchase and they don't want to assume full
responsibility, but that was a good point to note in your cover memo.
PRIVILEGE OF THE FLOOR
Board Member Gary Gilot acknowledged the efforts of crews restoring power after the severe
storm. He highlighted the Herculean effort of 2,700 crews working around the clock to restore
power and deal with the storm's impact on the community. He also expressed gratitude for the
city staff involved in storm cleanup and dealing with calls for service. He emphasized the
importance of acknowledging their hard work and dedication during the storm.
Director Horvath stated that it was one of the worst he has seen since he has been with the City in
terms of the amount of damage across the city. He added that they literally ran out of stop signs
due to so many signals down. They were getting generators from everywhere and it was a lot of
work, but AEP did a nice job getting them back up.
Board Attorney Michael Schmidt announced the retirement of Cynthia Simmons from the Office
of Diversity and Inclusion after twenty-eight (28) years of service. He praised Cynthia's
contributions and success in the department and emphasized the positive impact of her work.
Mr. Gilot highlighted that she went from managing Water Works Customer Billing, to managing
311, to Directing the office of Diversity Equity and Inclusion.
Director Horvath mentioned a reception to celebrate Cynthia's retirement, inviting board members
to attend and acknowledge her contributions from 2p.m. to 4 p.m. that day at Howard Park.
Director Cynthia Simmons stated that she came in through the Human Rights Commission and it
came full circle. She noted all of her roles have been challenging, but she tries to do the best that
she can and be successful. She added that they have moved the needle in the department and that
seeds have been planted, so let it grow.
ADJOURNMENT
There being no further business to come before the Board, President Maradik adjourned the
meeting at 10:47 a.m.

REGULAR MEETING APRIL 8, 2025
The Regular Meeting of the Board of Public Works was convened at 9:32 a.m. on Tuesday, April
8, 2025, by Board President Elizabeth A. Maradik in the 13th Floor Conference Room of the
County-City Building, 227 W. Jefferson Blvd., South Bend, Indiana. The meeting was also
streamed live to the public via Microsoft Teams. Board Clerk Theresa Heffner confirmed the
presence of Board President Elizabeth A. Maradik, Vice President Joseph Molnar (absent), and
Board Members Gary Gilot, Murray Miller (virtual), Breana Micou, and City Attorney Jenna
Throw, with a roll call. President Maradik reminded virtual attendees to mute their microphones
and turn off their cameras when not speaking, and to save their questions and comments for the
Privilege of the Floor.
APPROVE MINUTES OF PREVIOUS MEETING
Upon a motion made by Mr. Miller, seconded by Ms. Micou and carried by roll call, the minutes
for the Agenda Review Session and Regular Meetings of the Board held on March 20, and March
25, 2025, were approved.
PUBLIC HEARING - NEW MASSAGE ESTABLISHMENT LICENSE
President Maradik advised that this was the date set for the Board’s Public Hearing concerning
and license application for Dig Deep Massage Co. It was noted favorable recommendations were
received from City staff. There being no one else present wishing to address the Board concerning
this matter, the Public Hearing was closed. Therefore, upon a motion made by Mr. Miller,
seconded by Ms. Micou and carried by roll call, the license was approved.
OPENING OF BIDS – 2025 STREET AND SEWER MATERIAL BID – PROJECT NO. 125-
005 (PR-00039711)
This was the date set for receiving and opening sealed bids for the above referenced project. The
Clerk tendered proof of publication of the Notice in the South Bend Tribune, which was found to

opened for the above referenced project. After reviewing those bids, Ms. Plantz recommended that
the Board award the contract to the lowest responsive and responsible bidder, Milestone
Contractors, L.P., in the amount of $197,800. Therefore, Mr. Miller made a motion that the
recommendation be accepted, and the bid be awarded, and the contract approved as outlined above.

AWARD BID AND APPROVE CONTRACT – 2025 OR NEWER ALL WHEEL DRIVE
POLICE PURSUIT UTILITY VEHICLES – SPEC B – (PR-00039002)
Jeff Hudak, Central Services, advised the Board that on March 25, 2025, bids were received and
opened for the above referenced project. After reviewing those bids, Mr. Hudak recommended that
the Board award the contract to the lowest responsive and responsible bidder, Fletcher Chrysler
Products, Inc., in the amount of $38,911 each, twenty-nine (29) units with a total of $1,128,419.
Therefore, Mr. Miller made a motion that the recommendation be accepted, and the bid be
awarded, and the contract approved as outlined above. Ms. Micou seconded the motion, which
carried by roll call.
AWARD BID AND APPROVE CONTRACT – ONE (1) OR MORE 2024 SELF-PROPELLED

Mr. Jeff Hudak, Central Services, advised the Board that on April 8, 2025, bids were received and
opened for the above referenced contract. After reviewing those bids, Mr. Hudak recommended
that the Board award the contract to the lowest responsive and responsible bidder Oxbo
International Corporation, in the amount of $676,500 (unit price of $709,381 minus the trade in of
$56,265 plus $23,384 a 5-year- 10,000 hrs. extended warranty). Therefore, Mr. Miller made a
motion that the recommendation be accepted, and the bid be awarded as outlined above. Ms. Micou
seconded the motion, which carried by roll call.
AWARD QUOTATION AND APPROVE CONTRACT – DEMOLITION OF 215 JOHNSON
ST – PROJECT NO. 124-064 (PR-00039898)
Zach Hurst, Engineering, advised the Board that on March 25, 2025, quotations were received and
opened for the above referenced project. After reviewing those quotations, Mr. Hurst
recommended that the Board award the contract to the lowest responsive and responsible quoter,
Green Demolition Contractors, in the amount of $79,800 Base quote plus water works allowance.
Therefore, Mr. Miller made a motion that the recommendation be accepted, and the quotation be
awarded, and the contract approved as outlined above. Ms. Micou seconded the motion, which
carried by roll call.
APPROVE CHANGE ORDER NO. 2 – LEEPER AVE. BRIDGE DECK REPLACEMENT –
PROJECT NO. 124-008 (PO-0033849)
President Maradik advised that Patrick Sherman, Engineering, has submitted change order number
2 on behalf of Milestone Contractors, L.P., indicating the contract amount be increased by $28,648

additional one hundred and eleven (111) days and a new completion date of May 15, 2025. Upon

APPROVE CHANGE ORDER NO. 3 (FINAL) AND PROJECT COMPLETION AFFIDAVIT –
2023 GUARDRAIL & HANDRAIL IMPROVEMENTS – PROJECT NO. 122-043R (PO-

President Maradik advised that Kyle Ludlow, Engineering, has submitted change order number 3
(final) on behalf of LaPorte Construction Co., Inc., indicating the contract amount be decreased by
$4762.93 for a new contract sum, including this change order, of $335,164.93. Also submitted was
the project completion affidavit indicating this new final cost of $335,164.93. Upon a motion made
by Mr. Miller, seconded by Ms. Micou and carried by roll call, change order number 3 (final) and
the project completion affidavit were approved.
