A part of the east half of the northwest quarter of section 10,
township 37 north, range 2 east, Portage Township, St. Joseph
county, being more particularly described as:
Beginning at the intersection of the west right of way line of Meade Street and
the southwesterly right of way line of Washington Street, said beginning point
being South 00 degrees 34 minutes 52 seconds east (assumed bearing), a
distance of 69.16 feet from the southeast corner of lot number 82 as the said lot
is known and designated on the plat of the West End Subdivision. Said plat
being recorded in plat book 8, page 46 in the office of the reorder of St. Joseph
County, Indiana; thence south 0-0 degrees 34 minutes 52 seconds east along
the west right of way line of said Meade Street, a distance of 72.96 feet to the
intersection of the west right of way line of Meade Street with the northeasterly
right of way line of the Penn Central Railroad; thence north 65 degrees 21
minutes 00 seconds west along the northeasterly right of way line of said Perin
Central Railroad, a distance of42.08 feet; thence north 10 degrees 57 minutes
20 seconds west, a distance of 87.57 feet to the southwesterly right of way line
of aforesaid Washington Street; thence south 46 degrees 31 minutes 51 seconds
east along the southwesterly right of way line of said Washington Street, a
distance of 143.05 feet; thence south 65 degrees 21 minutes 00 seconds east
along the southwesterly right of way line of said Washington Street, a dista3rse _
of 93.92 feet to the point of beginning of this description containing 15,315
square feet or 0.352 of an acre, more or less, being subject to all easements, s
restrictions and public rights of way of record.

THIS INDENTURE WITNESSETH, for and in consideration of Ten Dollars ($10.00), and other valuable
consideration, the receipt whereof is hereby acknowledged, that the Northern Indiana Commuter Transportation District,
an Indiana Municipal Corporation, Releases and Quit Claims to the City of South Bend, of St Joseph County, in the
State of Indiana, whose mailing address for tax purposes is: 1316 County -City Building, South Bend, Indiana 46601,
all of its interest in the Real Estate described in Exhibit "A" and depicted upon the Right -of -Way Parcel Plat attached
hereto in Exhibit "B", both of which exhibits are incorporated herein by reference.
This conveyance is subject to any and all easements, conditions and restrictions of record.
The Grantor hereby specifically acknowledges and agrees that it is conveying its entire interest in the Real Estate
herein which is intended, but not warranted, to be in fee simple and that no reversionary rights whatsoever shall remain
with the Grantor, or any successors in title to the abutting lands of the Grantor, notwithstanding any subsequent
abandonment, vacation, disuse, non-use, change of use, conveyance, lease and/or transfer by the Grantee or its
successors in title, of a portion or all of the said Real Estate or any right-of-way, roadway or roadway appurtenances
established thereupon. This acknowledgment and agreement is a covenant running with the land and shall be binding
upon the Grantor and all successor and assigns. m
