ORDINANCE NO. 6836 -80
AN ORDINANCE AMENDING CHAPTER 2 OF THE MUNICIPAL
CODE OF THE CITY OF SOUTH BEND, INDIANA, BY THE
INCLUSION OF NEW ARTICLE 17 ENTITLED FEES CHARGED
FOR LEGAL ADVERTISEMENT.
STATEMENT OF PURPOSE AND INTENT:
The Common Council of the City of South Bend realizes the
increasing demands for quality city services. The Council further
recognizes that the demands on the City budget are becoming more
and more difficult.
In the interest of passing on direct out -of- pocket expenses
such as legal advertisement fees, the following rates and charges
are established.
NOW, THEREFORE, BE IT ORDAINED.by the Common C
City of South Bend, Indiana, as follows; ouncil of the
SECTIOV I. Chapter 2 of the Municipal Code of the City of
South Bend, Indiana, is hereby amended by the addition of new
Article 17 entitled Fees Charged for Legal Advertisement, which
shall read in its entirety as follows:
Sec. 2 -205 Fees Charged for Legal Advertisement.
All petitioners seeking tax abatements, voluntary annexa-
tion or rezoning; except those rezonin s
Area Plan Commission or member of the Common�Counciilfshalll bee
charged the exact fee necessarily incurred by the City to fulfill
all legal advertisement requirements of such proceedings.
SECTION II. This ordinance shall be in full ,force and effect
from and after its passage by the Common Council of the City of
South Bend, Indiana, approval, by the Mayor, and legal publication.

I am introducing the attached Bill in the interest of
establishing fair and equitable rates for the duplication
Of public records, as well as establishing a procedure
that would charge the petitioners for legal advertise-
ment costs in tax abatement proceedings, voluntary
annexations, and rezonings,
With the increasing demands on the civil city budget,
I believe these costs should be borne by the parties
most affected by the individual proceedings, rather
than all taxpayers.
Money collected pursuant to this Bill would be received
as miscellaneous revenue, and placed in the general
fund of the City.
I believe such a Bill is long overdue and would be a
small step to keep the city fiscally sound in these areas.
I seek your support and approval.
