BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: Section 1. Ordinance No. 4990 -68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Lots 54 and 55, Hartman and Millers Addition to the City of South Bend. be and the same is hereby established as "C" Commercial, E Height and area. Sharpe to zone from "B" Residential, "A" Height and Area to "C" Commercial, "E" Height and Area, property located at 1022 - Georgiana Street, City of South Bend Gentlemen: The attached rezoning petition of James W. Sharpe was legally advertised on November 8, 1980. The Area Plan Commission gave it a public hearing on November 18, .1980, at which time the following action was taken: Upon a motion by Joseph Serge, being seconded by Dean Speicher, and carried, the proposed ordinance and site development plan of James W. Sharpe to zone from "B" Residential, "A" Height and Area to "C" Commercial, "E" Height and Area, property located at 1022 Georgiana Street is sent to the Common Council with a favorable recommendation subject to a final site plan. PLEASE NOTE that the attached ordinance contains a change in the proposed height and area classification from "A" Height and Area to "E" Height and Area by request of the petitioner. This amended ordinance was the ordinance legally advertised and heard by the Area Plan Commission. The above recommendation is made subject to a final site plan and the pre- liminary site plan is attached hereto, The deliberations of the Area Plan Commi.ssi.on and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. Georgiana, South Bend REQUESTED ACTION: The petitioner is requesting a zone change from "B" Residen- tial, "A" Height and Area to "C" Commercial, "E" Height and Area for the "expansion of retail rental store and industrial uses that are clearly incidental to the retail business of rental equipment to include outside storage of rental property. EXISTING LAND USE: The land is vacant. SURROUNDING LAND USE: Located to the north, east and west are single family homes to the south zoned "A" Residential, "A" Height and Area; and are two single family homes and the existing Aay's Rental Co., zoned "C" Commercial, "D" Height and Area. APPLICABLE REGULATIONS: All parking within 50 feet of a residential district must be properly screened. Storage facilities require 1 space per 2 employees, and retail uses require 1 space per 2 em- ployees and 1 space per 200 square feet of floor area. ACCESS: Two points of access are shown from Georgiana for the proposed use. DRAINAGE: Two 1,800 gallon drywells are proposed. DATA: The total site including the existing business is 17,168 square feet. Of that, the existing building and proposed addition take up 5,180 square feet or 30.20 of the site; the existing and proposed parking, drives, and open storage area take up 11,438 square feet or 66.6% of the site; and 550 square feet, or 3.2% of the site will be open space. SITE PLAN: The site plan is preliminary. AGENCY COMMENTS: The City Engineer has the following comments: 1. The drywells shown on the site plan are sufficient. 2. The existing 18' Drive on Georgiana be widened to 24'. 3. We are requesting that the existing drive on St. Rd. 23 be closed. 4. All radii at the drives have a minimum 10' radius. 5. The gate to be constructed at the northern most drive is to be located a minimum_of 20 ft. from curbline so as to allow a vehicle awaiting entry, space off of the narrow street. JAMES W.
