ROLL CALL Present: Council Members Luecke, Niezgodski, Soderberg, Puzzello, Slavinskas, Zakrzewski, Coleman, Duda and Voorde Absent: None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: The sub - committee has inspected the minutes of the November 13, 1989 meeting of the Council and found them correct. Therefore, we recommend the same be approved. /s/ John Voorde /s/ Ann Puzzello Council Member Zakrzewski made a motion that the minutes of the November 13, 1989, meeting of the Council be accepted and placed on file, seconded by Council Member Voorde. The motion carried. SPECIAL BUSINESS Council Member Puzzello stated that there are two appointments to the Redevelopment Commission that the terms expire at the end of this year. RESOLUTION NO. 1759 -89 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, GIVING SPECIAL RECOGNITION TO THE D.A.R.E. PROGRAM AS PART OF THE "CITIES FIGHT BACK AGAINST DRUGS WEEK." WHEAREAS, the presence of illegal drugs and narcotics in our society has resulted in devastating problems which have severe social economic, and sociological implications; and WHEREAS, the week of December 3rd through December 9th is being declared. "Cities Fight Back Against Drugs Week" throughout America by the National League of Cities; and WHEREAS, in our local fight against drugs, the South Bend Common Council would like to highlight and provide particular public attention to the "Drug Abuse Resistance Education" (D.A.R.E.) Program sponsored by our South Bend Police Department in conjuntion with the South Bend Community School Corporation; and WHEREAS, the local D.A.R.E. program began in March of 1989 and by September it had been implemented into nineteen (19) elementary schools from kinergarten through the sixth grade; and WHEREAS, the D.A.R.E. program also has a special program aimed at the fifth graders where seventeen (17) consecutive weeks have three South Bend Police Officers teaching at that grade level. WHEREAS, we have asked Lt. William Humphries to provide us with a Special Report on the D.A.R.E. program, which will be heard under special business this evening. NOW, THEREFORE, BE IT ORDAINED BY THE SOUTH BEND COMMON COUNCIL as follows: SECTION I. The Common Council of the City of South Bend hereby declares the week of December 3rd through December 9th as "Cities Fight Back Against Drugs Week" in South Bend, Indiana. SECTION II. On behalf of all of the citizens of the City of South Bend, the Common Council hereby publicly commends the D.A.R.E. under the leadership of Lt. William Humphries of the South Bend Police Department and all officers and concerned persons involved in this innovative and very successful educational program. SECTION III. The South Bend Common Counci lurges all citizens to take an active stand against drugs in our community, and urges them to support our local D.A.R.E. program. SECTION IV. This Resolution shall be in full force and effect upon its adoption by the Common Council and approval by the Mayor. Council Member Puzzello made the presentation on the resolution. She indicated that the Common Council commends the D.A.R.E. program under the leadership under Lt. William Humphries, of the South Bend Police Department and all the officers and concerned persons involved in this innovative and very successful educational program. Lt. William Humphries, 55620 Laurie Ln., spoke in favor of the resolution. He indicated that 8% of students in school today have never used alcohol. He commented on that by age nine (9) marijuana is easiely accessible. He stated that the drug trade continues to flourish in this country. He stated that the D.A.R.E. program was established in 1989 to teach formal curriculum in the class room. He stated that the purpose of D.A.R.E. is to educate the children before they go into jr. high and high school. Officer Sherri Taylor spoke in favor of the resolution. She read a letter from a parent of a fifth grader at Jefferson Elementary School. She indicated that the letter commended the D.A.R.E. program. Officer Kevin Andert, South Bend Police Department spoke in favor of the bill. He read a letter from a 5th grade boy who lives in the Twyckenham Hills area. He indicated that the letter stated that the boys mother had to leave him with his father because she was on drugs and could cope with taking care of him. Council Member Puzzello presented Lt. Humphries with a $500.00 check to be used by the D.A.R.E. program. Council Member Voorde made a motion to adopt this resolution, seconded by Council Member Coleman. The resolution was adopted by a roll call vote of nine ayes. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on November 27, 1989, at 7:20 p.m., with nine members present. Chairman Zakrzewski presiding. BILL NO. 47 -89 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT THE NORTHWEST CORNER OF BENDIX DR. & ELWOOD AV. IN THE CITY OF SOUTH BEND, INDIANA. Council Member Slavinskas stated that this bill is being tabled indefinately at the request of the petitioner. BILL NO. 98 -89 A BILL APPROPRIATING MONIES FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF THE DESIGNATED ENTERPRISE FUNDS OF THE CITY OF SOUTH BEND, INDIANA, FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1990 AND ENDING DECEMBER 31, 1990 INCLUDING ALL OUTSTANDING CLAIMS AND OBLIGATIONS, AND FIXING A TIME WHEN THE SAME SHALL TAKE EFFECT. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Katherine Humphreys, City Controller made the presentation on the bill. She indicated that the 1990 Enterprise Budget was reviewed in Council Committee Meetings. She indicated that the appropriations are made within the following funds of the City: Solid Waste Fund, Solid Waste Depreciation Fund, Water Works General Fund, Water Works Depreciation Funds, Water Works Sinking Fund, Sewage Works General Fund, Sewage Works Depreciation Fund, Sewage Works Sinking Fund, Sewer Repair Fund, South Bend /Clay Water Works General Fund, South Bend /Clay Water Works Sinking Fund, South Bend /Clay Sewage General Fund, South Bend /Clay Sewage Sinking Fund. Joseph Guentert, 3510 Corby Blvd., spoke opposed to the bill. He questioned the percentages of the increases in various departments. Jack Dillion, Chief Chemist Waste Water Department, spoke in regard to the increases. He stated that the increase in the solid waste fund was 20 1/2 % due to increased landfill costs. He stated that the sewage works fund was 12% and the Sewer Depreciation Fund was a 105% increase as a plan for the furture a new way to look at the deteriorating sewer system. Council Member Voorde made a motion to recommend this bill to the Council favorable, seconded by Council Member Niezgodski. The motion carried. BILL NO. 100 -89 A BILL MAKING TECHNICAL CORRECTIONS TO ORDINANCE NO. 7998 -89 FIXING MAXIMUM SALARIES AND WAGES OF APPOINTED OFFICERS AND NON- BARGAINING EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, FOR THE CALENDAR YEARS OF 1990, 1991, AND 1992. iR.Pr. LAR_ MR ,T-IN G This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Voorde stated that the Personnel & Finance Committee . met on this bill and recommends this bill to council favorable as amended. Katherine Humphreys, City Controller made the presentation on the bill. She indicated that this bill amends Ordinance No. 7998 -89 which fixes maximum salaries and wages of non - bargaining employees. She stated that the changes as proposed are either technical corrections or the addition of positions which were inadvertently omitted from the original ordinance. She indicated that in addition to the technical corrections there are amendments in sick -leave language and making it consistent with changes made by the Council late last year. She indicated that this language serves to clarify the accumulation of sick time for non- barganing employees. The amendments are as follows: In the Department of Code Enforcement, Dept. 97, Inspector III the pay should be changed to $19,500 in 1990; $20,300 in 1991; $21,000 in 1992. In the Equipment Service Dept. 92, Superintentend IV should be omitted. Superintendent of Operations should be added. Parts Foreman should be changed to Parts Manager. Fiscal Aide should be added with a salary of $17,778 in 1990; $18,414 in 1991; and $18,966 in 1992. Secretary II should be changed to Secretary III with a salary of $14,606, in 1989; $15,312 in 1990; $15,898 in 1991 and $16,375 in 1992. In the Legal Dept. 05, Deputy City Attorney I the salary should be $13,717 in 1989; $13,994 in 1990; $14,344 in 1991; $14,714 in 1992. In the Park Dept. 24 the position of Coordinator of Program Development should be added, with a annual salary of $20,635 in 1990; and $21,328 in 1991 and $21,968 in 1992. The position of Park Police should be added with a salary of $7.53/hr in 1989 $7.78/hr in 1990; $8.03 /hr in 1991; $8.33/hr in 1992. In the Parking Garage Dept. 35 the position of General Foreman the pay should read as follows $6.71 in 1989; $6.96 in 1990; $7.21 in 1991 and $7.46 in 1992. In the Department of Sanitation Dept. 33 the position of Superintendent II should be changed to Superintendent III. In the Department of Sold Waste Dept. 22 the position of Superintendent I should be added with an annual salary of $24,445 in 1989; $25,249 in 1990; $26,034 in 1991; and $27,769 in 1992. The position of Superintendent III should'be''added with an annual salary of $25,575 in 1989;$26,500 in 1990; $27,400 in 1991 and $28,250 in 1992. In the Wastewater Dept. 30 the position of Director Division of Wastewater should be changed to Director of Environmental Services. The position of Superintendent of Maintenance should be added with the salary of $28,050 in 1990; $28,900 in 1991; and $29,700 in 1992. The position of Superintendent III should be added with the salary of $26,157 in 1990; $26,961 in 1991; $27,769 in 1992. The position of Superintendent II should be added with the salary of $25,765 in 1990; $26,560 in 1991; $27,357 in 1992. The position of Superintendent I should be added with the salary of $25,249 in 1990; $26,034 in 1991; and $28,815 in 1992. The position of Project Engineer the salary should be adjusted to $26,712 in 1990; $27,526 in 1991 and $28,352 in 1992. In the Department of Water Works Dept. 29, the position of Chemist IV should be added with the salary to be $24,901 in 1990; $25,679 in 1991; $26,449 in 1992. The position of Chemist III should be added with the salary to be $22,881 in 1990; $23,619 in 1991 and $24,327 in 1992;. The position of Chemist II should be added with the salary to be $21,366 in 1990; $22,073 in 1991 and $22,736 in 1992. The position of Chemist I should be added with the salary of $19,851 in 1990; $20,528 in 1991 and $21,1.44 in 1992. The position of Supervisor I the pay should be changed to $21,578 in 1990; $22, 290 in 1991; and $22,958 in 1991. The language in Section II. Sick Leave. Sick leave will be accrued at the rate of eight (8) days per year, to be calculated at 2/3 days for each month of completed employment. Employees hired prior to January 1, 1987 who''have not elected long term disability benefits may maintain up to ninety (90) days'of accumulated sick leave. Employees hired prior to January 1, 1987 who have elected long term disability benefits may maintain up to sixty five (65) days sick leave. Such employees who currently have in excess of sixty five (65) days accumulated leave may maintain the sick leave accumulated, however, no additional sick leave may be accrued until such time as the balance of sick leave falls below sixty five (65) days. Employees hired after January 1, 1987 may accumulate up to forty five (45) days sick leave. Council Member Voorde made a motion to accept the amendments, seconded by Council Member Puzzello. BILL NO. 101 -89 A BILL MAKING TECHNICAL CORRECTIONS TO ORDINANCE NO. 7997 -89 FIXING MAXIMUM SALARIES AND WAGES OF TEAMSTERS EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, FOR THE CALENDAR YEARS OF 1990, 1991 AND 1992. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Voorde stated that the Personnel & Finance Committee met on this bill and recommends this bill to council favorable as amended. Katherine Humphreys, City Controller made the presentation on the bill. She indicated that this ordinance amend the ordinance passed earlier this summer which fixes maximum salaries for Teamster employees. - -- — - --. -- --- - - - - -- -_---- - =---_- 1gR9 _ - I - She indicated that these changes are technical corrections or omissions. She stated them as follows: Building Maintenance Dept. 93 the position of Janitor should be added. Parks & Recreation Pay Group IX should be omitted an Pay Group X should be added. Pay Group X, Mechanic IV should be omitted. Pay Group VII, Mechanic III should be changed to Mechanic II. Pay Group VI pay in 1990 should be $9.07, in 1991 it should be $9.32 and in 1992 it should be $9.62. Pay Group IV Mechanic II should be change to Mechanic I. In pay Group II the position of Dietician should be added. In pay group I the positionof Park Police should be added. In the Bureau of Solid Waste the pay for operator I should be $8.08 in 1989. In 1990 it should be $8.33. In 1991 it should be $8.58 and in 1991 it should be $8.88. In the Bureau of Wastewater the Utility & Relief Operator should be renamed to Utility Operator. Council Member Voorde made a motion to accept the amendments, seconded by Council Member Zakrzewski. The motion carried. BILL NO. 105 -89 A BILL AMENDING CHAPTER 20, ARTICLE 9 OF THE SOUTH BEND MUNICIPAL CODE, ENTITLED "MOBILITY HANDICAPPED PARKING" This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Soderberg stated that the Public Safety Committee met on this bill and recommends it to the Council favorable. John Leszczynski, City Engineer made the presentation on the bill. He indicated that this bill amends Chapter 20 Article 9 of the South Bend Municipal Code. He stated that this bill will amend the Mobility Handicapped Parking Ordinance to delete the requirement that the curbs adjacent to handicapped parking spaces be painted blue. Council Member Zakrzewski made a motion to recommend this bill to the Council favorable, seconded by Council Member Niezgodski. The motion carried. BILL NO. 106 -89 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA ESTABLISHING A NON - REVERTING "CENTURY CENTER PREVENTIVE MAINTENANCE AND IMPROVEMENT FUND" This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Voorde stated that the Personnel & Finance met on this bill and recommends this bill to the Council favorable. Katherine Humphreys, City Controller made the presentation on the bill. She indicated that this bill would create a non - reverting "Century Center Preventive Maintenance and Improvement Fund." She stated that the principal, initial amount of this fund is $300,000.00; this amount is the license fee paid the Century Center Boad of Managers by the Service America Corporation with whom the Century Center Board has renewed the contract for food and beverage services at Century Center. She stated that these funds are currently invested in a local financial instutuion. She stated that the board determines the need to use these funds earmarked for maintenance and improvemtns at Century Center. Council Member Niezgodski made a motion to recommend this bill to the Council favorable, seconded by Council Member Soderberg. The motion carried. BILL NO. 111 -89 A BILL APPROPRIATING $2,000 AMONG VARIOUS ACCOUNTS WITHIN THE DEPARTMENT OF ECONOMIC DEVELOPMENT. Elizabeth Leonard, Director Financial and Program Management Economic Development Department, made the presentationon Bill No. 109 -89. She indicated that this bill would allow for the appropriation of $2,000.00 of Urban Development Action Grant Reimbursement Funds to the Industrial Infrastructure Projects account for use as the local match for State Grant Funds to be used for infrastructure improvements. Council Member Zakrzewski made a motion to recommend this bill to the Council favorable, seconded by Council Member Voorde. The motion carried.
