Be it remembered that the Common Council of the City of South Bend met in the
Council Chambers of the County -City Building on Monday, June 26, 1989 meeting of
the Council and found them correct.
Therefore, we recommend the same be approved.

SPECIAL BUSINESS
RESOLUTION NO. 1732 -89 A RESOLUTION OF THE SOUTH BEND COMMON COUNCIL ADOPTING
A WRITTEN FISCAL PLAN ESTABLISHING A POLICY FOR THE
PROVISION OF SERVICES TO AN ANNEXED AREA.
WHEREAS, Relative Real Estate Management Inc. has petitioned the Common Council to
annex an area specifically described in Attachment "A ", incorporated herein; and
WHEREAS, responsible planning and State law require adoption by the City of a
fiscal plan and a definite policy for the provisions of services to annexed areas;
and
WHEREAS, such a plan has been developed and presented to the Common Council.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend,
Indiana, that:
SECTION I. The Common Council of the City of South Bend, Indiana, hereby approves
and adopts the fiscal plan for the annexation of the area located in Penn Township
near the intersection of Jackson and Gras Roads, more specifically described in
Attachement "A ", which plan is attached hereto as Attachment "B" and made a part
hereof, and hereby approves and adopts specific policies for implementation of the
plan as set out therein.
SECTION II. It is estimated that the implementation of the plan may require
budgeting and appropriation of additional funds in the approximate amount of
$50,000 per year to provide police protection to the annexation area.
SECTION III. All services of a noncapital nature will be provided to the annexed
area within one (1) year after the effective date of annexation in a manner
equivalent in standard and scope to those services provided to areas within the
corporate boundaries that have similar topography, patterns of land use, and
population density.
SECTION IV. Capital improvements will be provided by the developer within three
(3) years of the effective date of annexation. Implementation of the plan will not
require the appropriation of funds for capital improvements to the annexed area by
the City of South Bend, Indiana.
SECTION V. This annexation will not result in the elimination of jobs of employees
of another governmental entity.
SECTION IV. This resolution shall be in full force and effect after its adoption
by the Common Council and approval by the Mayor.

A public hearing was held on the resolution at this time. Dave Norris, Project
Manager Economic Development Department made the presentation on the bill. He
indicated that the resolution establishes a policy and plan outlining the City to
provide services to 107.82 acres of land located in Penn Township near the
intersection of Ireland and Ironwood Roads. Council Member Soderberg questioned
whether or not the City has adequate Police and Fire Protection to handle this
area. Council Member Voorde made a motion to adopt this resolution, seconded by
Council Member Coleman. The resolution was adopted by a roll call vote of nine
ayes.

indicated that the Personnel & Finance Committee met on this bill and recommends
that the substitute version of Bill 12 89 be sent to the Council favorable.
Council Member Coleman made a motion ti accept the substitute bill, seconded by
Council Member Slavinskas. The motion carried. Member Niezgodski made the
presentation on the bill. He indicated that the bill will allow for the increase
of the penalty for some offenses and d signates the City Clerk as the collection
agent. He pointed out that the fine f r parking in a handicapped zone will
increase from $20 to $50. Also, fines for false fire alarm or being disorderly in
a city park will increase from $25 to 50. Council Member Voorde made a motion
to recommend the substitute bill to th Council favorable, seconded by Council
Member Coleman. The motion carried.

WHEREAS, the Common Council of the City of South Bend, Indiana has adopted a
Declaratory Resolution designating certain areas within the City as Economic
Revitalization Areas for the purpose of tax abatement consideration; and
WHEREAS, a Declaratory Resolution designated the area in the City of South Bend,
St. Joseph County, Indiana, which is described as follows:
Parcel 1: All that portion of the South half of Lot Thirty -eight (38) of Denniston
and Fellow's addition to the Town, now City of South Bend, and Lots numbered 1
through 10 as shown on the recorded Plat of J.C. Knoblock's subdivision of Lot
Thirty -nine (39) of Denniston and Fellow's addition to the Town, now City of South
Bend.
Parcel 2: The north half of Lots Thirty -seven (37) and Thirty -eight (38) of
Denniston and Fellow's addition to the Town, now City of South Bend,
WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing
before the Council has been published pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and
WHEREAS, the Council held a public hearing for the purposes of hearing all
remonstrances and objections from interested persons; and
WHEREAS, the Council has determined that the qualifications for an economic
revitalization area have been met.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend,
Indiana, as follows:
SECTION I. The Common Council hereby confirms its Declaratory Resolution
designating the area described herein as an Economic Revitalization Area for the
purposes of tax abatement. Such designation is for personal property tax abatement
only and is limited to two (2) calendar years from the date of adoption of the
Declaratory Resolution by the Common Council.
SECTION II. The Common Council hereby determines that the property owner is
qualified for and is granted personal property tax deduction for a period of five
(5) years.
SECTION III. This Resolution shall be in full force and effect from and after its
adoption by the Common Council and approval by the Mayor.

A public hearing was held on the resolution at this time. Kevin Butler, Attorney,
100 E. Wayne St. made the presentation on the resolution. He indicated that the
petitioner Ziker Cleaners is located at 247 E. Sample St., South Bend, and they
plan to increase their production facilities to accommodate the industrial and
commercial business growth. He stated that in order to expand business and job
security, they need additional production space, new equipment and additional
employee parking and off street parking. Council Member Coleman made a motion to
adopt this resolution, seconded by Council Member Duda. The resolution was adopted
by a roll call vote of nine ayes.

SOUTH BEND, INDIANA, DESIGNATING CERTAIN AREAS WITHIN
THE CITY OF SOUTH BEND COMMONLY KNOWN AS 247 TO 251

REVITALIZATION AREA FOR PURPOSES OF A SIX (6) YEAR
REAL PROPERTY TAX ABATEMENT FOR 1ST SOURCE BANK,
TRUSTEE OF THE JOSEPH ZIKER TRUST AND FOR ITS TENANT,
ZIKER CLEANERS, INC.
WHEREAS, a petition for real property tax abatement has been filed with the City
Clerk for consideration by the Common Council of the City of South Bend, requesting
that the area in South Bend, Indiana, which is described as follows:
Parcel 1: All that portion of the South half of Lot Thirty -eight (38) of Denniston
and Fellow's addition to the Town, now City of South Bend, and Lots numbered l
through 10 as shown on the recorded Plat of J.C. Knoblock's subdivision of Lot
Thirty -nine (39) of Denniston and Fellow's addition to the Town, now City of South
Bend.

WHEREAS, the Departments of Economic Development has concluded an investigation and
prepared a report with information sufficient for the Common Council to determine
that the area qualifies as an Economic Revitalization Area under Indiana Code
6 -1.1- 12.1 -1 et seq., and South Bend Municipal Code 2 -76, et seq., and has further
prepared maps and plats showing the boundaries and such other information regarding
the area in question as required by law; and,
WHEREAS, the Human Resources and Economic Development Committee of the Common
Council has reviewed said report and recommended to the Common Council that the
area qualifies as an Economic Revitalization Area.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend,
Indiana, as follows:
SECTION I. The Common Council hereby determines and finds that the Petition for
Real Property Tax Abatement and Statement of Benefits form completed by the
Petitioner meets the requirements of Indiana Code 6 -1.1- 12.1 -1 et seq., and
qualifies under the provisions of South'Bend Municipal Code Section 2 -76, et seq.,
for tax abatement.
SECTION II. The Common Council hereby determines and finds the following:
A. That the estimate of the value of the redevelopment or rehabilitation is
reasonable for projects of this nature;!
B. That the estimate of the number of individuals who will be employed or whose
employment will be retained can reasonably be expected to result from the proposed
described redevelopment or rehabilitation;
C. That the estimate of the annual salaries of those individuals who will be
employed or whose employment will be retained can be reasonably expected to result
from the proposed redevelopment or rehabilitation;
D. That the other benefits about which'iinformation was requested are benefits that
can be reasonably expected to result from the proposed described redevelopment or
rehabilitation; and
E. That the totality of benefits is sufficient to justify the deduction, all of
which satisfy the requirements of Indiana Code 6 -1.1- 12.1 -3.
SECTION III. The Common Council hereby determines and finds that the proposed
