THIS GREEMENT, ntered into day of

James, Lisa Sconl rs, an Gregory Mitchem, hereinafter referred to
as the "Buyers," and the Civil City of South Bend, a municipal
corporation of the State of Indiana, hereinafter referred to as the
,City."
WITNESSETH:
WHEREAS, I.C. 36-1-11 establishes the procedures for the sale
and rental of real property owned by the City of South Bend; and
WHEREAS, the Board of Public Works (hereinaf er referred to as
the "Board") is empowered to carry out the provisions of said
statute; and
WHEREAS, the Board has determined that:
1. The highest and best use of certain real property owned
by the City is by sale to an abutting landowner;
2. The cost to the public of maintaining said real property
owned by the City equals or exceeds the established fair market
value of said real property;
3. It is economically unjustifiable to sell real property
owned by the City in accordance with the procedures set forth in
T.C. 36-1--11-4.
WHEREAS, the Board has determined that the assessed value of
said real property is less than TWO THOUSAND DOLLARS ($2,000); and
WHEREAS, pursuant to I.C. 36-1-11-5, the Board is empowered to
negotiate and sell said real property to the abutting landowner who
submits the highest offer for said real property; and
WHEREAS, the offer of the Buyers in the amount of One Hundred
Dollars ($150.00) was offered and accepted as the best offer for
said property.
NOW, THEREFORE, it is agreed by and between the parties
hereto, and for and in consideration of the promises and the mutual
covenants herein contained, as follows:
1. The City agrees to sell and Buyers agree to buy the
following property located in St. Joseph County, Indiana:

E. 33' W. 41' Lot 14 Dubails 1st Addition.
More commonly known as 215 East Dayton Street,
South Bend.
for the sum of $15o.00.
2. Buyers agree to pay the purchase price and recording fee
in full at the time of closing.
3. Buyers agree to pay all title and abstract costs involved
in said transaction which it shall desire or request.
4. At the time to closing and after a submission of a
receipt for the total purchase price has been submitted by the
Controller to the Board of Public Works, the Board shall cause a
Quit -Claim deed to be prepared, which deed shall be signed by the
Mayor and attested to by the City Clerk with the Seal of the City
affixed, which shall then be recorded with the St. Joseph County
Recorder's Office.
4. This conveyance is made so long as the property is not
used for the purpose of constructing a new, single family dwelling.

The Board of Public Works, at its meeting held August 6, 1996, accepted your bid of
$150,00 for the purchase of the City -owned property at 215 Dayton.
Enclosed is the Purchase Agreement for this property. Please sign and return to my
attention.
Please submit a check to the Board, made payable to the City of South Bend, in the amount
of $16.00 which is for filing fees required of the Auditor's Office and the Recorder's Office for the
recording of the Quit Claim Deed for this property.

On Monday, July 15, 1996, the Board had scheduled the opening of sealed bids for the sale
of 215 East Dayton. No bids were received.
The Board is now obligated by statute to contact all landowners that abut the lot to see if any
are interested in negotiating for the purchase of this property. Our records show that you own
property that abuts the lot in question. If you have any interest in purchasing the lot described

WHEREAS, the Board of Public Works of the City of South Bend, Indiana, has compiled
a current detailed inventory of all real property owned by the City of South Bend; and
WHEREAS, the Board of Public Works has reviewed said inventory of real property and it
finds that a certain parcel of real estate now owned by the City of South Bend is not necessary to the
public use and is not set aside by State and City laws for public purposes; and
WHEREAS, the Board of Public Works finds that the property described below has an
assessed valuation of less than $2,000.00, that the cost of maintaining said parcel equals or exceeds
the estimated fair market value of the parcel, and that the highest and best use of the parcel is sale
to an abutting landowner.
WHEREAS, the Board of Public Works now wishes to take the necessary action to make it
possible for the Board, in the future, to sell said parcel of real estate pursuant to State statutes.
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South
Bend, Indiana:
1. That the parcel of real estate owned by the City contained in the following list is
not necessary to the public use, is not set aside by State or City laws for public
purposes, that the cost of maintaining said parcel equals or exceeds the estimated fair

The Board of Public Works, at its meeting of July 29, 1996, opened two (2) bids for the sale
of City -owned property at 215 East Dayton.
I am in receipt of a check for $150.00 from Lisa Sconiers, 3527 Addison, South Bend,
Indiana. I tried to contact Ms. Sconiers on July 29, but to no avail. I was given a phone number of
her employer to call, but it was not a business, and tried leaving a message at the number on her
check, but no one seemed willing to do that. I am trying to figure out the connection between the
person making a bid for this property, and your request to purchase this property. I have not been
able to contact you personally, as there is not a listing for you.

equals or exceeds the estimated fair market value of the property. The Board has also determined
that the highest and best use of the lot is to sell to an abutting landowner.
On Monday, July 15, 1996, the Board had scheduled the opening of sealed bids for the sale
of 215 East Dayton. No bids were received.
The Board is now obligated by statute to contact all landowners that abut the lot to see if any
are interested in negotiating for the purchase of this property. Our records show that you own
property that abuts the lot in question. If you have any interest in purchasing the lot described

The Division of Planning and Neighborhood Development has reviewed the aforementioned request
and offers the following comments. The petitioner has stated that he currently maintains the lot and
would like to acquire it for use as a side yard. He has also stated that the lot is used illegally as a
throughway by residents. Upon inspection, the lot does appear to occasionally be used as an
alleyway. There is not a curb cut allowing vehicular access to the lot, however, a Y x 5' service walk
remains. The lot is vacant, however, it may contain a house foundation underground. The 1994
Southeast Neighborhood Strategic Action Plan encourages the development of vacant property
within the neighborhood to uses that are consistent with responsible home ownership.
Therefore, the Division of Planning and Neighborhood Development recommends the approval
of sale of said property to the petitioner.
The approval of sale should be conditional, and the following conditions should be reflected in the
deed:
1. The lot, individually, cannot be used as a building site for purposes of a new, single-
family construction site.
2. Petitioner should combine the two tax key numbers (18-7042-1662 and 18-7042-1661)
through the procedures of the Township Assessor's office.
However, the lot can be used for structural expansion of the residence at 215 Dayton or new garage
construction, following current zoning requirements.
