HomeMy WebLinkAbout07-11-88 Council Meeting Minutes315 REGULAR MEETING JULY 11, 1988 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Monday, July 11, 1988, at 7:00 p.m. The meeting was called to order and the Pledge to the Flag was given. ROLL CALL Present: Council Members Luecke, Soderberg, Puzzello, Slavinskas, Zakrzewski, Coleman, Duda and Voorde Absent: Council Member Niezgodski REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: The sub- committee has inspected the minutes of the June 27 meeting of the Council and found them correct. Therefore, we recommend the same be approved. /s/ John Voorde /s/ Loretta Duda Council Member Coleman made a motion that the minutes of the June 27, meeting of the Council be accepted and placed on file, seconded by Council Member Puzzello. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on July 11, at 7:06 p.m., with nine members present. Chairman Zakrzewski presiding. BILL NO. 15 -88 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 641 SANCOME AVENUE IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Puzzello made a motion to accept the substitute bill on file with the City Clerk, seconded by Council Member Voorde. The motion carried Council Member Slavinskas indicated the Zoning and Vacation Committee had met on this bill and recommended it to the Council favorably. Kevin Joyce, Area Plan, gave the staff report, which was favorable to the rezoning. Richard Ludwick, Ludwick Printing, made the presentation for the bill. He indicated they were requesting this rezoning in order to build on to their present building. Council Member Voorde made a motion to recommend this bill to the Council favorably, as amended, seconded by Council Member Coleman. The motion carried. BILL NO. 31 -88 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 434 NORTH MICHIGAN IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Slavinskas indicated the Zoning and Vacation Committee had met on this bill and recommended it to the Council favorably. Kevin Joyce, Area Plan, gave the staff report which was favorable to the rezoning. Thomas Roemer, attorney, made the presentation for the bill. He indicated this area has changed over the years and is basically commercial. He indicated they were requesting the rezoning in order to establish this property was a boarding and lodging house. He indicated there was a need for this type of housing in the City. T. Brooks Brademas, 425 N. Michigan, indicated this was a classic example of spot zoning. He indicated this area has been changing into a commercial area and this type of establishment should not be in the area. Joseph Amaral, attorney, representing the owners of 436 N. Michigan, indicated this particular property has been as commercial for 18 years. He indicated this was definitely spot zoning. He indicated this is not the type of establishment City needs. He presented the Council with reports from Code Enforcement, as well as letters from surrounding commercial establishments against the zoning. He also presented pictures of the property. Council Member Puzzello made a motion to recommend this bill to the Council favorably, seconded by Council Member Voorde. The motion failed on a roll call vote of four ayes and four nays (Council Members Luecke, Soderberg, Slavinskas and Duda.) Council Member Slavinskas made a motion to recommend this bill to the Council unfavorably, seconded by Council Member Luecke. The roll call vote was five ayes and three nays, however, Council Member Voorde asked this his vote be changed to nay, making the motion fail on a vote of four ayes and four nays (Council Members Puzzello, Zakrzewski, Coleman and Voorde) Council Member Coleman indicated this bill should be continued and the Council should visit the property. Council Member Soderberg made a motion to continue this bill until the next meeting, seconded by Council Member Coleman. The motion passed on a roll call vote of seven ayes and one nay (Council Member Soderberg.) BILL NO. 38 -88 A BILL EXTENDING THE BOUNDARY OF THE TAX ABATEMENT IMPACT AREA WITHIN THE CITY OF SOUTH BEND. 1 Council Member Luecke made a motion to continue public hearing on this bill until July 25, seconded by Council Member John Voorde. The motion carried. BILL NO. 46 -88 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING SECTION 2 -5 OF THE MUNICIPAL CODE COMMONLY REFERRED TO AS "SPECIAL MEETINGS OF THE COMMON COUNCIL." This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Voorde indicated the Rules Committee had met on this bill and recommended it to the Council favorably. Council Member Slavinskas made the presentation for the bill. He indicted the bill should be amended in Section I, (c) and (g) by adding "or designee ". Council Member Voorde made a motion to accept this amendment, seconded by Council Member Luecke. The motion carried. Council Member Slavinskas indicated this bill would set forth specific procedures to be followed when a special meeting of the Council is called and then cancelled. He indicated this would assure proper notice to all of the members of the Council, as well as the public and the news media. Council Member Luecke made a motion to recommend this bill to the Council favorably, as amended, seconded by Council Member Coleman. The motion carried. BILL NO. 48 -88 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, ESTABLISHING A NONREVERTING "EAST RACE WATERWAY PROMOTIONAL AND DEVELOPMENT FUND." This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Voorde made a motion to accept the substitute bill on file with the City Clerk, seconded by Council Member Coleman. The motion carried. Richard Nussbaum, City Attorney, made the presentation for the bill. he indicated that due to insurance liability concerns the private not - for - profit corporation which had been promoting the East Race Waterway has been dormant for some time, and in order to ease the concern the corporation was being brought into the framework of City government as a subcommittee to the Park Board. He indicated that to assure the money raised for the development is used for that specific purpose, it is necessary to establish such a fund. He indicated the East Race Waterway is a vital asset to this community. T. Brooks Brademas, 425 N. Michigan, spoke in favor of this bill. Joseph Guentert, 3510 Corby, spoke against this bill. Council Member Puzzello made a motion to recommend this bill to the Council favorably, seconded by Council Member Voorde. The motion carried. BILL NO. 49 -88 A BILL TRANSFERRING $55,223 AMONG VARIOUS ACCOUNTS WITHIN THE DEPARTMENT OF ECONOMIC DEVELOPMENT. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Beth Leonard, Economic Development, made the presentation for the bill. She indicated this transfer would be used Historic Preservation's survey records, the summer cleanup crew, Monroe Park activities and the Studebaker Corridor study. Council Member Luecke made a motion to recommend this bill to the Council favorably, seconded by Council Member Coleman. The motion carried. BILL NO. 50 -88 A BILL APPROPRIATING $175,716.00 FROM THE LOCAL ROAD AND STREET FUND TO PROJECT R &S 8802, PAVING MATERIALS, WITHIN THE LOCAL ROAD AND STREET FUND. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Zakrzewski indicated the Public Works Committee had met on this bill and recommended it to the Council favorably. John Leszczynski, Director of Public Works, made the presentation for the bill. He indicated this money would be used for street paving and the slurry program. Council Member Slavinskas made a motion to recommend this bill to the Council favorably, seconded by Council Member Puzzello. The motion carried. BILL NO. 51 -88 A BILL APPROPRIATING $350,000.00 FROM THE LOCAL ROAD AND STREET FUND TO PROJECT R &S 8803, VARIOUS ROAD IMPROVEMENTS, WITHIN THE LOCAL ROAD AND STREET FUND. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Zakrzewski indicated the Public Works Committee had met on this bill and recommended it to the Council favorably. John Leszczynski, Director of Public Works, made the presentation for the bill. He indicated this money would be used for construction and design of several projects. Council Member Coleman made a motion to recommend this bill to the Council favorably, seconded by Council Member Puzzello. The motion carried. BILL NO. 52 -88 A BILL APPROPRIATING $86,200.00 FROM THE CUMULATIVE SEWER BUILDING AND SINKING FUND TO PROJECT CS831, TWYCKENHAM STORM SEWER, WITHIN THE CUMULATIVE SEWER BUILDING AND SINKING FUND. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Zakrzewski indicated the Utilities Committee had met on this bill and recommended it to the Council favorably. John Leszczynski, Director of Public Works, made the REGULAR MEETING TTIT.V 11 . 1988 presentation for the bill. He indicated this money would be used for improvements to the storm sewer. Council Member Coleman made a motion to recommend this bill to the Council favorably, seconded by Council Member Puzzello. The motion carried. BILL NO. 53 -88 A BILL APPROPRIATING $91,054.00 FROM THE MOTOR VEHICLE HIGHWAY FUND TO STREET DEPARTMENT ACCOUNT 4255.0 OTHER MATERIALS WITHIN THE MOTOR VEHICLE HIGHWAY FUND. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Zakrzewski indicated the Public Works Committee had met on this bill and recommended it to the Council favorably. John Leszczynski, Director of Public Works, made the presentation for the bill. He indicated this money would be used for the paving and slurry program. Corey Stein, 1233 S. 29th, spoke against the Street Department Program. Council Member Coleman made a motion to recommend this bill to the Council favorably, seconded by Council Member Voorde. The motion carried. BILL NO. 54 -88 A BILL TRANSFERRING MONIES FROM VARIOUS ACCOUNTS TO VARIOUS ACCOUNTS WITHIN THE STREET DEPARTMENT BUDGET WITHIN THE MOTOR VEHICLE HIGHWAY FUND. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Zakrzewski indicated the Public Works Committee had met on this bill and recommended it to the Council favorably. John Leszczynski, Director of Public Works, made the presentation for the bill. He indicated this money would be used for the paving program. Council Member Duda made a motion to recommend this bill to the Council favorably, seconded by Council Member Coleman. The motion carried. There being no further business to come before the Committee of the Whole, Council Member Coleman made a motion to rise and report to the Council, seconded by Council Member Voorde. The motion carried. RESOLUTION NO. 1624 -88 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND COMMONLY KNOWN AS 1020 HIGH STREET AN ECONOMIC REVITALIZATION AREA FOR PURPOSE OF A THREE (3) YEAR REAL PROPERTY TAX ABATEMENT FOR ART IRON, INC. WHEREAS, a petition for real property tax abatement consideration has been filed with the Common Council of the City of South Bend, requesting that the area commonly know as 1020 High Street, South Bend, Indiana, and which is more particularly described as follows: Parcel 1 (a) A part of the Northeast Quarter of Section 13, Township 37 North, Range 2 East in the City of South Bend, St. Joseph County, Indiana, described as follows, viz: Beginning at a point, in the center line of High Street, 159 feet South of the point of intersection of the said center line of High Street in Martin L. RESOLUTION NO. 1627 -88 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE MAYOR AND THE SOUTH BEND PUBLIC HOUSING AUTHORITY TO SUBMIT AN APPLICATION FOR THE MAJOR RECONSTRUCTION OF OBSOLETE PUBLIC HOUSING PROJECTS PROGRAM (MROP) TO THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT. 326 WHEREAS, the Mayor of the City of South Bend, Indiana, is the Chief Executive Officer of the City; and WHEREAS, Section 8 of the United States Housing Act of 1937, as amended, authorizes the Housing Authority to develop, own, or assist in housing of low- income persons; and WHEREAS, there currently exists in South Bend, Indiana, a need for the rehabilitation of twenty -eight (28) vacant units owned by the Housing authority; and NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of South Bend, Indiana, as follows: SECTION I.
