LABELED AS EASEMENT 41" WITHIN THE SUMMER HILL, PHASE TWO,
SUBDIVISION RECORDED UNDER INSTRUMENT NUMBER 0326448 IN THE
OFFICE OF RECORDER OF ST. JOSEPH COUNTY.
KNOW ALL MEN BY THESE PRESENTS, that the City of South Bend Board of Public
Works, Grantee of all easement rights within a 20 foot utility easement along the
common lot line between Lots 49 and 50 in the Summer Hill, Phase Two, Subdivision,
recorded under Instrument Number 0326448 in the Office of the St. Joseph County
Recorder, Indiana, and more particularly described as follows: One -hundred twenty and
twenty-seven one -hundredths (120.27') feet of a twenty (20) foot wide utility easement,
being 10 (ten) foot on each side of the property line and extending easterly from a fifteen
(15) foot drainage, utility, and road maintenance easement along the east right-of-way
line of Summer Wood Court to a fifteen (15) foot drainage easement, hereby agrees to
and hereby does release its rights in said easement in and along the above described real
estate.
This release is hereby issued to Clay Ironwood, L.L.C., their heirs, devisees,
grantees, personal representatives, successors, and assigns.
IN WITNESS WHEREOF, the City of South Bend Board of Public Works, has
caused this instrument to be executed by its duly authorized officials, this (a*clay of

RE: Summer Hill, Phase Two
Release of Utility Easement Request
Dear Mr. Gilot:
Attached is a 24" x 36" copy of the proposed Summer Hill, Phase Two, First Replat
showing the previous location of a 20' Utility Easement (highlighted in pink) and the new
proposed location for the 20' Utility Easement (highlighted in yellow). The lot line
between Lots 49 and 50 is being moved approximately 20 feet to the north to give Lot 49
additional building width. Since this plat was recently approved at the May l st Plat
Committee meeting, there are no utilities present within the prior location of the 20'
Utility Easement.
We respectfully request that this easement release be considered at the May 27, 2003,
meeting of the Board of Public Works.
