ROLL CALL Present: Council Members Beck, Braboy, Puzzello, Taylor, Zakrzewski, Barcome, Voorde and Serge Absent: Council Member Paszek REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: The sub - committee has inspected the minutes of the November 23 meeting of the Council and found them correct. Therefore, we recommend the same be approved. /s/ Beverlie J. Beck /s/ Al Paszek /s/ Joseph T. Serge Council Member Taylor made a motion that the minutes of the November 23, meeting of the Council be accepted and placed on file, seconded by Council Member Barcome. The motion carried. SPECIAL BUSINESS Council Member Barcome made a motion to set the December 21 meeting at 5:00 p.m., seconded by Council Member Zakrzewski. The motion carried. RESOLUTION NO. 1556 -87 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA COMMENDING GLADYS MUHAMMAD FOR HER SERVICE TO THE CITY AS ASSISTANT DIRECTOR OF THE DEPARTMENT OF CODE ENFORCEMENT. WHEREAS. the Common Council of the City of South Bend, Indiana acknowledges with pride that GLADYS MUHAMMAD has served as Assistant Director of the Department of Code Enforcement since August 8, 1983. WHEREAS, in this capacity she has earned a reputation of being a very cooperative and caring City official; and WHEREAS, GLADYS MUHAMMAD has competently handled numerous emergency situations for the Department of Code Enforcement and has delicately balanced the rights of the property owners and the best interest of the City. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana as follows: SECTION I. On behalf of all of the citizens of the City of South Bend, Indiana, the Common Council hereby publicly commends GLADYS MUHAMMAD for her four (4) years of dedicated public service to the City as its Assistant Director of the Department of Code Enforcement. SECTION II. The Common Council wishes her continued success as she embarks her new career as Community Organizer for the Near West Side Neighborhood of the South Bend Heritage Foundation. SECTION III. This resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. /s/ Joseph T. Council Member Braboy read the resolution and presented it to Gladys Muhammad. Council Member Taylor made a motion to adopt the resolution, seconded by Council Member Beck. The resolution was adopted by a roll call vote of eight ayes. REPORTS Council Member Voorde indicated that the Zoning and Vacation Committee had met on Bill Nos. 97, 124, 125 -87; 115 -87 will be continued until December 21. He indicated the other bills received a favorable recommendation. Council Member Braboy indicated the Human Resources Committee had met on Bill No. 128 and 132 -87 and they received a favorable recommendation. Council Member Puzzello indicated the Committee of the Whole had met on Bill No. 67 -87, and it was sent to the Council with no recommendation. Council Member Barcome indicated the Utilities Committee had met on Bill No. 129 and 130 -87, and they were sent to the Council with no recommendation. Council Member Barcome indicated the Personnel and Finance Committee had met on Bill No. 133 -87 and it received a favorable recommendation. Council Member Braboy made a motion to resolve into the Committee of the Whole, seconded by Council Member Zakrzewski. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on December 7, at 4:18 p.m., with nine members present. Chairman Puzzello presiding. BILL NO. 97 -87 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 1918 EDISON ROAD IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Kevin Joyce, from Area Plan, gave the staff report. He indicated this bill was sent to the Council with no recommendation. Tony Zappia, attorney for the petitioner, made the presentation for the bill. He indicated they were requesting "b" zoning for this property, in order for Dr. Sergio, to move out of his office. He indicated the doctor's practice is limited to periodontics and sees approximately six patients a day, therefore, there would be no increase of traffic in the area. He indicated the office was completely remodeled and was an asset to the neighborhood. He read two letters from the immediate next door neighbors George and Lillian Ambler and Ross Mittiga, indicating Dr. Sergio has been a good neighbor and has upgraded the property. Chris Winter, spoke against this rezoning. He indicated that "B" zoning Dr. Sergio to bring another doctor into the office, and he could rent apartments to students. He indicated that the doctor does not reside at this office. He indicated that the "B" zoning would allow Dr. Sergio to sell the property to anyone who would qualify under that zoning. Bob Mulderink, 1516 Harrington Dr., spoke against this zoning. He indicated there was a traffic problem in the area now. Art James, 2007 E. Edison, spoke against this zoning. Tony Zappia, indicated the doctor does live at 1918 Edison. He indicated the doctor only sees approximately six patients a day therefore the traffic would not be increased. He indicated the office and parking lot are not large enough to accommodate another doctor. Dr. Sergio indicated he receives referrals from other dentists and could not have another dentist in his office. The Council concluded that no alterations could be made to this property without approval of Area Plan. Council Member Beck made a motion to recommend this bill to the Council favorably, seconded by Council Member Barcome. The motion carried on a roll call vote of six ayes and two nays (Council Members Zakrzewski and Voorde.) BILL NO. 115 -87 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: DINAN COURT, RUNNING WEST FROM ST. JOSEPH STREET APPROXIMATELY 165 FEET TO THE FIRST NORTH -SOUTH ALLEY WEST OF ST. JOSEPH STREET. ALSO, THE FIRST EAST -WEST ALLEY NORTH OF NAVARRE STREET FROM ST. JOSEPH STREET WEST APPROXIMATELY 165 FEET TO THE FIRST NORTH -SOUTH ALLEY WEST OF ST. JOSEPH STREET. BILL NO. 124 -87 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: GARST ST. RUNNING WEST FROM THE WESTERLY RIGHT -OF -WAY OF PRAIRIE TO THE 1ST NORTH -SOUTH ALLEY FOR A DISTANCE OF 143.54' MORE OR LESS. ALL BEING PART OF SOUTH BEND CITY ADD., WITHIN THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Don Golichowski, Secretary- Treasurer of the Sheet Metal Workers Joint Training Trust Fund, made the presentation for the bill. He indicated they were requesting this vacation to 204 create off street parking for property being used to teach and train apprentices and journeymen in the construction industry. Council Member Beck made a motion to recommend this bill to the Council favorably, seconded by Council Member Zakrzewski. The motion carried. BILL NO. 125 -87 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST NORTH -SOUTH ALLEY WEST OF KESSLER BOULEVARD, RUNNING SOUTH FROM MCCARTNEY STREET FOR A DISTANCE OF APPROXIMATELY 128 FEET TO THE FIRST INTERSECTING ALLEY, LYING BETWEEN LOTS 64 AND 65 OF THE NORTHWEST 2ND ADDITION TO THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Ken Fedder, attorney, made the presentation for the bill. He indicated they were requesting this alley vacation since the City no longer uses the alley for trash purposes and the alley has fallen into disuse. Council Member Serge made a motion to recommend this bill to the Council favorably, seconded by Council Member Taylor. The motion carried. BILL NO. 67 -87 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING VARIOUS SECTIONS OF THE MUNICIPAL CODE FOR THE PURPOSES OF PREVENTING FIRES AND FIRE LOSSES AND TO MINIMIZE AIR POLLUTION CAUSED BY OPEN BURNING. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Beck made the presentation for the bill. She indicated several sections of the Municipal Code address burning regulations, and this proposed ordinance would specifically amend four of those sections. She indicated that currently burning is allowed from 7:00 a.m. to 7:00 p.m. from October 15 to November 15 and from April 15 to May 15, and that would be eliminated. She indicated currently code prohibits burning on any asphalt street, alley, and this will be amended to prohibit any burning on any street, alley or sidewalk regarding of the composition. She indicated obsolete language referencing the Board of Public Works and Safety will be amended to the South Bend Fire Prevention Bureau. Kathleen Cekanski - Farrand, Council attorney, indicated this proposed bill would allow for a permit procedure, but prohibits the spring and fall burning. She indicated this bill should be amended in Sec. 9 -7 (a) by adding "or" between fire _ grass and delete "or any other type of fire ". Council Member Taylor made a motion to accept this amendment, seconded by Council Member Barcome. The motion carried. Dick Miller, 226 E. Navarre, indicated he loved trees but hated smoke. Craig Barber, 1233 White Oak, spoke regarding air pollution. Daniel Winicur, 1802 Dorwood, an asthma sufferer indicated leaf burning was making him sick. Pat Wise, 1237 Blaine, a representative of the Lung Association, indicated children as well as adults have asthma, emphysema and bronchitis, and they suffer when there is leaf burning. Sara Steele, 1308 White Oak, indicated she was in favor of banning burning but not in favor of bagging leaves. Mary Crapo, 1106 Oakridge, indicated she was in favor of banning burning of leaves. She asked to come up with a solution to leaf burning. Fred Elbel, 2234 Englewood, indicated this plan could start a wave of tree destruction. Fred Mutzl, 320 Parkovash, spoke in favor of this bill. Irene Magyar, 2517 S. Ironwood, indicated the spring burning could be eliminated, but continue the fall burning. Rebecca Shriner, 415 Parry, spoke in favor of this bill. Richard Gard, 2521 Erskine, spoke in favor of this bill. Lisa Lawson, and Beverly Lawson 533 E. Riverside spoke in favor of this bill. Irene Siberell, 228 Timber Lane, read a letter from Irene Gammon, City Clerk, 3316 Oak Crest, expressing opposition to banning leaf burning. She indicated that the 1988 Civil City budget was cut by 2.3 million dollars, and the City does not have the funds to purchase needed equipment that will be required if the Council passes this bill in its present form. Roger Bock, 3505 Winding Wood, indicated the City could not provide for leaf pick up. Steven Stagger, 208 Sylvan Glen, indicated oak leaves cannot be mulched. Laura Hardtke, 1114 Oak Ridge, indicated the City has to have an alternate plan before leaf burning is banned. Fern Pachika, 303 Sylvan Glen, indicated the leaf ordinance should remain the way it is until there is an alternative plan. Maryam Barrett, 1809 Corby, indicated in her area it would cost $200 for leaf bags. She indicated that one month is not enough for burning because some years the leaves do not come down until December. Robert Parker, 232 Sylvan Glen, indicated he counted the bags of leaves he ranked on his property and there were 279. He indicated burning could be banned in the spring. Harry Vogt, 3616 Oak Crest, indicated oak leaves do not mulch as they do not decay. Jack Brehmer, 2902 S. Twyckenham, indicated there is a problem with vandalism when you bag leaves. He indicated this bill should not be passed until a solution has been found. Jim Clark, 1017 White Oak; Ben Barrett, 1809 Corby; Rosemary Kauffman, 1703 E. Corby; Jim Brenay, 216 Wildemere; Lois Borden, 1222 White Oak; George Rembusch, 1520 Elmer; spoke against this bill. Kathleen Cekanski - Farrand, Council attorney, indicated she recommended the following amendments to the bill: Section I, new sub - section (3) to read as follows: (c) This Section shall be read in conjunction with Section 16 -16(c) and Section 20 -67(e) of this Code. Reletter present (c) to (d) to read as follows: (d) Any person violating any provision of this section shall upon conviction, be deemed guilty of an r a ordinance violation and shall be punishable by a fine in the amount of fifty dollars ($50.00) per occurrence and each such kindlinq shall be treated as a separate offense. Council member Zakrzewski indicated the problems should be worked out before the bill is passed. He indicated this bill should be tabled. He made a motion to table the bill indefinitely, seconded by Voorde. The motion failed on a roll call vote of four ayes and four nays (Council Members Braboy, Beck, Taylor and Serge. Council Member Taylor made a motion to recommend this bill to the Council favorably, seconded by Council Member Serge. The motion failed on a roll call vote of four ayes and four nays (Council Members Puzzello, Zakrzewski, Barcome and Voorde.) Council Member Beck made a motion to continue public hearing on this bill until January 11, seconded by Council Member Serge. Council Member Zakrzewski made a motion to accept the amendments, seconded by Council Member Barcome. The motion carried. Council Member Beck made a motion to continue public hearing on this bill until Mach 28, seconded by Council Member Voorde. The motion carried. Council Member Barcome made a motion to recess, seconded by Council Member Zakrzewski. The motion carried and the meeting was recessed at 7:00 p.m., and reconvened at 7:45 p.m. BILL NO. 128 -87 A BILL TRANSFERRING $50,000.00 AMONG VARIOUS ACCOUNTS WITHIN THE DEPARTMENT OF ECONOMIC DEVELOPMENT. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Jon Hunt, Director or Economic Development, indicated this bill transfers $50,000 from the 1987 Fredrickson Park account to the 1987 Redevelopment Administration account. He indicated this transfer was necessary due to the unanticipated reductions in Civil City funds. He indicated this additional money will cover remaining administrative costs through the end of 1987. Joseph Guentert, 3510 Corby, asked if the money being transferred was not part of the Fredrickson Park money they tried to use for the stadium. Jon Hunt indicated this was Federal money and it will be used for West Washington and the Studebaker Corridor. Irene Mutzl, 320 Parkovash, asked if there was going to be a bond issue for the Studebaker Corridor. Council Member Barcome made a motion to recommend this bill to the Council favorably, seconded by Council Member _ Zakrzewski. The motion carried. BILL NO. 129 -87 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 16, ARTICLE 2 OF THE MUNICIPAL CODE OF SOUTH BEND. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. John Leszczynski, Director of Public Works, made the presentation for the bill. He indicated they were requesting an increase of $1.50 per month for collection of garbage and trash. He indicated the reason for the increase was twofold: the landfill costs have risen $.70 and are expected to go up another $.75 per year in March; and we are attempting to make the Solid Waste program self- supported and vehicle maintenance costs were previously handled by other departments and they are now included in the Solid Waste budget. Joseph Guentert, 3510 Corby, spoke against this bill. Council Member Zakrzewski made a motion to amend the bill in Section I, paragraph (c) reduce the amount to $4.50 per month, seconded by Council Member Taylor. The motion carried. Council Member Beck made a motion to recommend this bill to the Council favorably, as amended, seconded by Council Member Serge. The motion carried. BILL NO. 130 -87 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING SECTION 17 -56(A) OF CHAPTER 17, ARTICLE 7, COMMONLY KNOWN AS SEWER SERVICE FUND AND CHARGES. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. John Leszczynski, Director of Public Works, made the presentation for the bill. He indicated this bill increases the rate from twenty -five cents a month to fifty cents to cover the revenue shortfall in the sewer repair fund. He indicated more and more city sewage customers have been using the system. He indicated it was the intent of this fund to provide relief from the large bills associated with sewer repairs. He indicated the customer pays only the first five hundred dollars of the bill in most cases. Joseph Guentert, 3510 Corby, spoke against this bill. Council Member Beck made a motion to recommend this bill to the Council favorably, seconded by Council Member Taylor. The motion carried. BILL NO. 132 -87 A BILL AMENDING CHAPTER 2, ARTICLE 6, OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, ADDRESSING TAX ABATEMENT PROCEDURES. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Puzzello made the presentation for the bill. She indicated this bill would amend the tax abatement procedures by incorporating a review procedure addressing onsite child care or day care facilities, services and benefits. She indicated there is a dramatic increase in the number of parents working outside the home both nationally and in South Bend. This bill would require petitioners to make known in the original petition the type of onsite child care or day care facilities, services, or ME benefits offered or proposed to be offered by the employer for children of their employees. She indicated the bill would also require the petitioner to update the Council on this same topic of onsite day care or child care facilities, services, or benefits in their annual reports. She indicated this bill addresses a real concern which impacts both employers and employees. Council Member Barcome made a motion to recommend this bill to the Council favorably, seconded by Council Member Taylor. The motion carried. BILL NO. 133 -87 A BILL APPROVING PARKING RATES FOR PARKING GARAGES AND PARKING LOTS OWNED, LEASED AND OPERATED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Michael Vance, Controller, made the presentation for the bill. He indicated the administration has been reviewing parking rates in the downtown area and Redevelopment is contemplating the construction of a new parking facility on the northwest corner of the intersection of Wayne and St. Joseph Street. He indicated that in order to provide parking at a price reflective of the cost in that facility, the other two garages and flat lots the parking rates should be amended as proposed in this bill. He indicated the privately owned garages downtown are charging a monthly rate of: Valley American $50; 1st Source $40 and First Interstate $35. he indicated the rates for the municipally owned garages would still result in a lower monthly parking rate than the other facilities. Council Member Serge made a motion to recommend this bill to the Council favorably, seconded by Council Member Beck. The motion carried. There being no further business to Member Taylor made a motion to rise Member Beck. The motion carried. PRIVILEGE OF THE FLOOR Joseph Guentert, 3510 Corby, spoke regarding separating trash. He indicated five cities in Indiana are using this system. Council Member Barcome made a motion to allow Mr. Guentert to continue over the three minute time allowed, seconded by Council Member Voorde. The motion carried. There being no further business to come before the Council, unfinished or new, Council Member Barcome made a motion to adjourn, seconded by Council Member Beck.
