HomeMy WebLinkAbout11-09-87 Council Meeting Minutest REGULAR MEETING NOVEMBER 9, 1987 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Monday, November 9, at 7:00 p.m. The meeting was called to order and the Pledge to the Flag was given. ROLL CALL Present: Council Members Beck, Braboy, Puzzello, Taylor, Zakrzewski, Barcome, Paszek, Voorde and Serge Absent: None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: The sub - committee has inspected the minutes of the October 26, meeting of the Council and found them correct. Therefore, we recommend the same be approved. /s/ Beverlie J. Beck /s/ Al Paszek /s/ Joseph Serge Council Member Taylor made a motion that the minutes of the October 26, meeting of the Council be accepted and placed on file, seconded by Council Member Barcome. The motion carried. REPORTS Council Member Voorde indicated that the Zoning and Vacation Committee had met on Bill No. 83 and 85 -87 and recommended them favorably, Bill No. 93 -87 received no recommendation, Bill No. 94 -87 will be stricken at the request of the petitioner, and Bill nos. 95 and 106 -87 were recommended favorably, as amended. Council Member Beck indicated that the Personnel and Finance Committee had met on Bill No. 107 -87 and recommended it favorably. Council Member Taylor made a motion to resolve into the Committee of the Whole, seconded by Council Member Zakrzewski. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on November 9, 1987, at 7:10 p.m., with nine members present. Chairman Puzzello presiding. LL NO. 83 -87 A BILL AMENDING SOUTH BEND MUNICIPAL CODE CHAPTER 21, ARTICLE 6.5, ENTITLED HISTORIC PRESERVATION COMMISSION. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Kevin Joyce, of Area Plan, indicated the intent of this bill was to authorize the Historic Preservation Commission to accept facade. He indicated the Area Plan Commission gave a favorable recommendation to this bill. John Oxian, Vice President of the Historic Preservation Commission, indicated this bill concerns facade easements to be donated to the Commission. He indicated the facade on the former I & M Building, now owned by Holladay Corp., will be donated to the commission, which will lead to a reduction of the assessed value of the landmark, which will be maintained by the owners. Council Member Serge made a motion to recommend this bill to the Council favorably, seconded by Council Member Taylor. The motion carried. BILL NO. 85 -87 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 118 - 120 -122 NAVARRE STREET IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Kevin Joyce, of Area Plan, gave the staff report which was favorable. Eugene Forsythe, the petitioner, indicated he planned to erect a 64 x 64 foot building. He indicated he and his wife are manufacturer's representatives who need office space and an art studio. Rick Miller, 226 E. Navarre, spoke in favor of this rezoning. Ann Mannox, Neighborhood Housing Services; Bruce Wood, 225 E. Navarre; Charles Leone; and Greg Balough, 609 Riverside spoke against rezoning, indicating the neighborhood was starting to stabilize and they did not want this commercial development. Council Member Beck made a motion to recommend this bill to the Council favorably, seconded by Council Member Taylor. The motion carried. BILL NO. 93 -87 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED APPROXIMATELY 460 FEET WEST OF THE SOUTHWEST CORNER OF THE INTERSECTION OF MAYFLOWER AND SAMPLE STREETS IN THE CITY OF SOUTH BEND, INDIANA. �.. - This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Kevin Joyce, of Area Plan, gave the staff report, which was favorable. Rick Morgan, attorney, indicated the petitioner planned to build approximately 120 storage units. He indicated the area would be property screened. He indicated that under the current City zoning ordinance mini warehousing must be classified as "D" light industrial. Patricia Lynch 23365 Grant Road, spoke against this rezoning. She indicated this was a residential area. Bob , 5414 W. Sample, indicated he would encourage retail development, but not "D" light industrial. Valarie Malecki, Sylvan Lane, and Virgil Lynch, 23665 Grant Road, spoke against this zoning. Council Member Zakrzewski indicated he felt the best zoning for this tract would be commercial. He made a motion to recommend this bill go to Council unfavorable, seconded by Council Member Barcome. The motion failed on a roll call vote of four ayes and five nays (Council Members Braboy, Beck, Taylor, Voorde and Serge.) Council Member Taylor made a motion to recess, seconded by Council Member Beck. The motion carried and the meeting was recessed at 8:08 p.m., and reconvened at 8:20 p.m. Council Member Voorde made a motion that this bill be recommended to Council favorably, with the following amendment: In Section I, strike the period and add the following: excepting herefrom the northern one hundred and sixty feet (160') of said parcel which shall be established as C- Commercial, A- Height and area. Add a new Section II to read: This rezoning ordinance is subject to the petitioner recording in the Recorder's Office of St. Joseph County, in a form acceptable to the Council Attorney and the Common council, a covenant limited the use of the D -light industrial area heretofore described to mini - storage warehousing or any use listed in the C- Commercial District category of the South Bend Municipal Code. Renumber current Section II to III., seconded by Council Member Serge. The motion carried on a roll call vote of five ayes and four nays (Council Members Puzzello, Zakrzewski, Barcome and Paszek.) BILL NO. 94 -87 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 3814 LINCOLNWAY WEST IN THE CITY OF SOUTH BEND, INDIANA. Council Member Beck made a motion to strike this bill, on the request of the petitioner, seconded by Council Member Serge. The motion carried. BILL NO. 95 -87 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED WEST OF NILES AVENUE SOUTH OF CORBY STREET RUNNING ALONG THE ST. JOSEPH RIVER IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Kevin Joyce, of Area Plan, gave the staff report, which was favorable. Council Member Taylor made a motion to accept the substitute bill on file with the City Clerk, seconded by Council Member Beck. The motion carried. Kathleen Cekanski - Farrand, Council Attorney, indicated the bill should be amended in Section I, by adding the following to the end of the section: Subject to the terms and conditions addressed in a letter dated June 15, 1987, to the Board of Park Commissioners and its two (2) exhibits namely "a" and "B" addressing the East Bank Trail Project, copies of which are attached hereto and included herein. Council Member Voorde made a motion to accept the amendment, seconded by Council Member Taylor. The motion carried. Paul Barber, of MJK Architects, Benton Harbor, indicated the petitioner planned to construct 22 luxury condominiums of the 2.5 acre riverfront site. He indicated each of the units would have its own two car garage and contain between 1,400 and 2,200 square feet of space. He indicated the cost of the units would range in price from $125,000 to $175,000. Ann Kolata, deputy director of Redevelopment, spoke in favor of this rezoning. She indicated the developer has agreed to provide the City a 20 foot easement along Niles Ave. to permit continuance of a jogging trail that had followed an abandoned railroad right -of -way through the property. She indicated in exchange the City will provide access to the north end of the site over property being acquired by the Park Department. Council Member Beck made a motion to recommend this bill to the Council favorably, as amended, seconded by Council Member Taylor. -- The motion carried. BILL NO. 106 -87 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE 1ST EAST -WEST ALLEY SOUTH OF VINE STREET RUNNING FROM THIRTIETH STREET EAST TO THE INTERSECTING NORTH -SOUTH ALLEY, FOR A TOTAL DISTANCE OF 165' MORE OR LESS. ALL BEING IN PART OF EGGLESTON'S 1ST ADDITION WITHIN THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA. - This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Kathleen Cekanski - Farrand, Council Attorney, indicated the bill should be amended in Section I, by adding the following: subject to the petitioner dedicating additional right -of -way to the City to allow traffic to make a turn movement either to the north or to the south from the portion of remaining east /west alley, or an alternative plan acceptable to the Board of Public Works. Said dedication must be recorded within sixty (60) days of passage of the ordinance, or such plan must be approved by the Board of Public Works within sixty (60) days of the date of passage of this ordinance. Council Member Barcome made a motion to accept the amendment, seconded by council Member Zakrzewski. The motion carried. Council Member Beck made the presentation for the U bill. She indicated the petitioner was out of the City, and she was making the presentation for him. She indicated the petitioner was going to contact residents on the other half of the alley and request the entire alley be closed. She indicated this would stop the flow of traffic and enable garages to be built so they would face toward the houses now away from them. Council Member Serge made a motion to recommend this bill to the Council favorably, as amended, seconded by Council Member Braboy. The motion carried. BILL NO. 107 -87 A BILL APPROPRIATING $11,950.00 FROM THE MORRIS CIVIC AUDITORIUM IMPROVEMENT FUND FOR PURCHASE OF REPAIRS AND IMPROVEMENT AT THE MORRIS CIVIC AUDITORIUM. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Dale Balsbaugh, Director of the Morris Civic, made the presentation for the bill. He indicated this appropriation would be used for electrical work, replacement of seat covers, and roof repair. Council Member Barcome made a motion to recommend this bill to the Council favorably, seconded by Council Member Zakrzewski. The motion carried. There being no further business to come before the Committee of the Whole, Council Member Serge made a motion to rise and report to the Council, seconded by Council Member Barcome. The motion carried. ORDINANCE NO. 7819 -87 AN ORDINANCE APPROPRIATING $11,950.00 FROM THE MORRIS CIVIC AUDITORIUM IMPROVEMENT FUND FOR PURCHASE OF REPAIRS AND IMPROVEMENT AT THE MORRIS CIVIC AUDITORIUM. This bill had second reading. Council Member Puzzello made a motion to pass this bill, seconded by Council Member Zakrzewski. The bill passed by a roll call vote of nine ayes. RESOLUTIONS RESOLUTION NO. 1546 -87 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND APPROVING THE ISSUANCE OF A SCRAP METAL /JUNK DEALERS /TRANSFER STATIONS LICENSE FOR THE CALENDAR YEAR 1987 WHEREAS, the Common Council of the City of South Bend recognizes the contributions that operations such as junk /scrap and recycling dealers make to the community; and the Council further realizes that such operations must be reasonably regulated in order to minimize any environmental or aesthetic nuisances which may be created by the operations of scrap /junk /and recycling dealers within the City; and WHEREAS, the Common Council of the City of South Bend has enacted reasonable rules and regulations with regard to the issuance of licenses and the operations of the scrap /junk /and recycling dealers; WHEREAS, in accordance with these rules and regulations, inspections of a scrap /junk /and recycling operation have been completed by the Department of Code Enforcement and the Fire Department Prevention Bureau, and it has been found that such premises is fit and proper for the maintenance and operation of such a business; and WHEREAS, the Board of Public Works, at its meeting held on November 3, 1987, recommended the issuance of a license for the below listed applicant in the City of South Bend by appropriate action of the Common Council. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. That the license application for the following be approved based upon the satisfactory review of the property by the Department of Code Enforcement and the Fire Department Prevention Bureau, inspections having been made in October, 1987 and subsequent favorable recommendation by the Board of Public Works: South Bend Auto Parts 307 W. Calvert St. and subject to the terms and conditions of the October 29, 1987 letter of commitment from the applicant addressing parking, the tree lawn area, and removal of a trailer by November 29, 1987. Said letter of commitment is on file with the Clerk of the Board of Public Works. Said license approval shall be further subject to favorable inspection reports being made on a biweekly basis by the Department of Code Enforcement and the Fire Prevention Bureau. Should the applicant fail to meet any of these conditions, revocation of said license shall be instituted by the City of South Bend. SECTION II. This Resolution shall be in full force and effect from and after its & option by the Common Council and approval by the Mayor. /s /Joseph T. Serge Member of the Common Council A public hearing was held on the resolution at this time. Patricia DeClercq, Director of Code Enforcement, indicated the Board's approval of this license is subject to the terms and conditions of an October 29, letter of commitment from the applicant wherein he stated that he has reduced the number of employees on the premises to one (1), thereby bring his parking facility into compliance with the City ordinance; he will seed or sod the tree law area in front of the scrap yard as early next spring as the weather permits; and he will remove the trailer from the premises within thirty (30) days of the date of the letter. She indicated the premises were inspected for fire code violations, environmental violations, proper maintenance of the premises and area outside the fenced -in areas. Phillip Smith, owner of the scrap yard, asked that the Council allow him to reopen. He indicated the yard had been shut down since September. Chuck Rhoades, 625 Clearview, spoke in favor of this license. Hildy Zemlyak, 1903 Franklin, Vice President of the Rum Village Neighborhood Association, indicated this yard remained in violation of city ordinances, as he does not have any toilet facilities and he keeps this business records at home instead of at the business as required. Sylvester Gerschoffer, president of the Rum Village Association, indicated if the laws were enforced they would not have to be here fighting this license. Council Member Taylor made a motion to adopt this resolution, seconded by Council Member Puzzello. The resolution was adopted by a roll call vote of seven ayes and two nays (Council Members Paszek and Voorde.) BILLS. FIRST READING BILL NO. 109 -87 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: A PERPENDICULAR ALLEY RUNNING NORTH AND SOUTH PARALLEL TO FOREST AVENUE BEHIND LOTS 37 AND 38 PLAT OF CHAPIN PLACE BY EDWARD P. CHAPIN. This bill had first reading. BILL NO. 120 -87 A BILL APPROPRIATING $110,000.00 FROM THE SOUTH BEND /CLAY WASTEWATER OPERATING DEPRECIATION FUND TO VARIOUS ACCOUNTS WITHIN THE SOUTH BEND /CLAY WASTEWATER BUDGET. This bill had first reading. BILL NO. 123 -87 A BILL APPROPRIATING $47,000.00 FROM CUMULATIVE SEWER BUILDING AND SINKING FUND INTO FUND 38 DEPARTMENT 33, ACCT. #399 OF THE DEPARTMENT OF SANITATION. This bill had first reading. Council Member Beck made a motion to set this bill for second reading and public hearing November 23, and refer it to the Utilities Committee, seconded by Council Member Puzzello. The motion carried.
