Home My WebLink About08-10-87 Council Meeting Minutes0 REGULAR MEETING AUGUST 10, 1987 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Monday, August 10, at 4:30 p.m. The meeting was called to order and the Pledge to the Flag was given. ROLL CALL Present: Council Members Braboy, Beck, Puzzello, Taylor, Zakrzewski, Barcome, Paszek, and Serge, Absent: Council Member Voorde REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: The sub - committee has inspected the minutes of the July 13, and July 27 meetings of the Council and found them correct. Therefore, we recommend the same be approved. /s/ Beverlie J. Beck /s/ Al Paszek /s/ James Barcome Council Member Beck made a motion that the minutes of the July 13 and July 27, meetings of the Council be accepted and placed on file, seconded by Council Member Puzzello. The motion carried. SPECIAL BUSINESS Council Member Taylor made a motion to reappoint Emil Resnik to the TRANSPO Board, seconded by Council Member Barcome. The motion carried. RRPnRTS Council Member Beck indicated the Personnel and Finance Committee had met on Bill No. 71 -87 and recommended it favorably. Jon Hunt, Director of Economic Development, presented a report on the Urban Enterprise Zone. Council Member Taylor made a motion to resolve into the Committee of the Whole, seconded by Council Member Barcome. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on August 10, at 5:10 p.m., with eight members present. Chairman Puzzello presiding. BILL NO. 72 -87 A BILL APPROPRIATING MONIES WITHIN THE CAPITAL IMPROVEMENT FUND. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Fire Chief Taylor indicated they were requesting this money in order to put a new roof of Station #2. He indicated the station is twenty years old and has the original roof, which is leaking and they want to take care of the problem before any major damage is done. Council Member Beck made a motion to recommend this bill to the Council favorably, seconded by Council Member Barcome. The motion carried. BILL NO. 73 -87 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: SCOTT STREET RUNNING FROM THE NORTHERLY RIGHT -OF -WAY OF LINCOLNWAY WEST TO THE SOUTH RIGHT -OF -WAY LINE OF MARION STREET EXTENDED WEST, FOR AN APPROXIMATE DISTANCE OF 107 FEET ALL WITHIN THE CITY OF SOUTH BEND, INDIANA AND BEING PARTS OF KENT & GARRISON AND SMITH & JACKSON SUBDIVISIONS. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mike Dobson, 207 Dixieway North, made the presentation for the bill. He indicated they were requesting this vacation in order to reduce the amountof traffic that uses 705 Lincoln Way West as an ingress and egress to and from Scott Street. He indicated that for some time the intersection of Scott and Lincolnway has been closed by a guard rail. He indicated that last year a concrete curb was constructed across Scott Street on Lincoln Way, and with this barrier some people are driving through our property to enter or exit Scott Street. Glen Moody, 418 W. Madison; Jack Weissbuch, 620 W. Marion; Shirley Dawson, 623 W. Marion; Paul Roeletter, Near Northwest Neighborhood Association; Tom Phean, 839 Forest Ave.; Wana Knight, 510 Leland; spoke against this vacation. Some of them indicated a privacy fence should be erected between the commercial and residential areas of Marion Street. Council Member Taylor made a motion to continue public hearing on this bill indefinitely, seconded by Council Member Barcome. The motion carried. 132 .11t zM „ i 04 . .. BILL NO. 79 -87 A BILL AUTHORIZING THE CITY OF SOUTH BEND, INDIANA (THE "CITY "), TO ISSUE ITS "ECONOMIC DEVELOPMENT REVENUE BOND, SERIES 1987 (KOKOKU WIRE INDUSTRIES CORPORATION PROJECT), IN THE AGGREGATE PRINCIPAL AMOUNT OF THREE MILLION TWO HUNDRED THOUSAND DOLLARS ($3,200,000.00) AND APPROVING AND AUTHORIZING CERTAIN ACTIONS WITH RESPECT THERETO. Council Member Zakrzewski made a motion to suspend the rules and accept the filing, have first reading and public hearing, and second reading on this bill, seconded by Council Member Taylor. The motion carried on a roll call vote of nine ayes. This bill had first reading. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Kenneth Fedder, attorney for the Economic Development Commission, made the presentation for the bill. He indicated the Council had recently passed an ordinance approving bonds for Kokoku, however, it was necessary to change the date of the sale of the bonds, therefore, a new ordinance must be passed. Council Member Beck made a motion to recommend this bill to the Council favorably, seconded by Council Member Barcome. The motion carried. There being no further business to come before the Committee of the Whole, Council Member Zakrzewski made a motion to rise and report to the Council, seconded by Council Member Taylor. The motion carried. BILLS, SECOND READING ORDINANCE NO. 7788 -87 AN ORDINANCE ON A BILL APPROPRIATING MONIES WITHIN THE CAPITAL IMPROVEMENT FUND. This bill had second reading. Council Member Taylor made a motion to pass this bill, seconded by Council Member Puzzello. The bill passed by a roll call vote of seven ayes (Council Member Barcome was absent from the Chambers). This bill had first reading. Council Member Puzzello made a motion to refer this bill to Area Plan, seconded by Council Member Barcome. The motion carried. BILL NO. 76 -87 A BILL APPROPRIATING MONIES FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF SEVERAL DEPARTMENTS OF THE CIVIL CITY OF SOUTH BEND, INDIANA FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1988, AND ENDING DECEMBER 31, 1988, INCLUDING ALL OUTSTANDING CLAIMS AND OBLIGATIONS AND FIXING A TIME WITH THE SAME SHALL TAKE EFFECT. This bill had first reading. Council Member Beck made a motion to set this bill for public hearing August 24, and refer it to the Personnel and Finance Committee, seconded by Council Member Taylor. The motion carried. BILL NO. 77 -87 A BILL LEVYING TAXES AND FIXING THE RATE OF TAXATION FOR THE PURPOSE OF RAISING REVENUE TO MEET THE NECESSARY EXPENSES OF THE CIVIL CITY OF SOUTH BEND FOR THE FISCAL YEAR ENDING DECEMBER 31, 1988. This bill had first reading. Council Member Puzzello made a motion to set this bill for public hearing August 24, and refer it to the Personnel and Finance Committee, seconded by Council Member Barcome. PRIVILEGE OF THE FLOOR Joseph Guentert, 3510 Corby, complimented on the cleanliness of the City for the Special Olympics. He asked if the stadium was finished. Irene Mutzl, 320 Parkovash, spoke regarding the fact that the budget no longer indicates who has City cars. Wana Knight, 510 Leland, spoke regarding the enforcement of the noise ordinance. There being no further business to come before the Council, unfinished or new, Council Member Barcome made a motion to adjourn, seconded by Council Member Taylor.
