HomeMy WebLinkAbout07-27-87 Council Meeting MinutesREGULAR MEETING July 27, 1987 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Monday, July 27, at 4:30 P.M. The meeting was called to order and the Pledge to the Flag was given. ROLL CALL Present: Council Members Braboy, Beck, Puzzello, Taylor, Zakrzewski, Barcome, Paszek, Voorde and Serge, Absent: None SPECIAL BUSINESS Council Member Beck made a motion to set the August 10 meeting at 4:30 p.m., seconded by Council Member Taylor. The motion carried. REPORTS Council Member Braboy indicated the Human Resources Committee had met on Resolutions 65, 66, 67 and 68 -87 and recommended them favorably. Council Member Beck indicated that the leaf burning report from City Engineer, John Leszczynski, due today, would be given on September 14. Council Member Barcome made a motion to accept September 14, for this report, seconded by Council Member Paszek. The motion carried. Council Member Taylor made a motion to resolve into the Committee of the Whole, seconded by Council Member Zakrzewski. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on July 27, at 4:37 p.m., with nine members present. Chairman Puzzello presiding. BILL NO. 71 -87 A BILL DELETING CHAPTER 14 ENTITLED "PROPERTY." This being the time heretofore set for public and opponents were given an opportunity to be Attorney, made the presentation for the bill. Chapter 14.5 of the Code entitled "Property ", of municipal law. Council Member Taylor made Council favorably, seconded by Council Member .5 OF THE SOUTH BEND MUNICIPAL CODE, hearing on the above bill, proponents heard. Eugenia Schwartz, City She indicated this bill deletes since State law now governs this area a motion to recommend this bill to the Serge. The motion carried. There being no further business to come before the Committee of the Whole, Council Member made a motion to rise and report to the Council, seconded by Council Member . The motion carried. BILLS, SECOND READING ORDINANCE NO. 7787 -87 A BILL DELETING CHAPTER 14.5 OF THE SOUTH BEND MUNICIPAL CODE, ENTITLED "PROPERTY." This bill had second reading. Council Member Puzzello made a motion to pass this bill, seconded by Council Member Voorde. The bill passed by a roll call vote of nine ayes. RESOLUTIONS RESOLUTION NO. 1524 -87 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND DESIGNATING CERTAIN AREAS WITHIN THE CITY COMMONLY KNOWN AS 516 SOUTH MICHIGAN ST. AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF REAL PROPERTY TAX ABATEMENT. WHEREAS, a petition for real property tax abatement consideration has been filed with the Common Council of the City of South Bend, requesting that the area commonly known as 516 South Michigan St., South Bend, Indiana, and which is more particularly described by a line drawn as follows: 124 REGULAR MEETING JULY 27, 1987 South 1/2 Lot #9 Samuel Martin's Addition be designated as an Economic Revitalization Area under the provisions of Indiana Code 6 -1.1- 12.1 -1, et seq.; and WHEREAS, the Redevelopment Commission has concluded an investigation and prepared a report with information sufficient for the Common Council to determine that the area qualifies as an Economic Revitalization Area under Indiana Code 6 -1.1- 12.1 -1, et seq., and has further prepared maps and plats showing the boundaries and such other information as required by law of the area in questions; and WHEREAS, the Human Resources and Economic Development Committee of the Common Council has reviewed said report and recommended to the Common Council that the area qualifies as an Economic Revitalization Area. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. That the Common Council hereby accepts the report and recommendation of the Human Resources and Economic Development Committee that the area herein described be designated an Economic Revitalization Area and hereby adopts a resolution designating this area as an Economic Revitalization Area for purposes of real property tax abatement. SECTION II. That this designation shall be limited to five (5) calendar years from the date of the adoption of this resolution by the Common Council. SECTION III. That the Common Council directs the City Clerk to cause notice of the adoption of this resolution to be published, said publication providing notice of the public hearing before the Common Council on said declaration. SECTION IV. This resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. /S/ Joseph T. Serge Member of the Common Council A public hearing was held on the resolution at this time. Council Member Voorde made a motion to amend this resolution in Section 2, delete five insert two, add a new Section 4 to read: The abatement deduction shall be for six years. This determination is made under the authority of I.C. 6 -1.1- 12.1 -3. Current Section Four would be Section Five., seconded by Council Member Taylor. The motion carried. Richard Lutin, 111 E. Main, Niles, indicated he planned to renovate this building and use it as a music store. He indicated one full -time employee, and two part -time employees will be hired. Council Member Taylor made a motion to adopt this resolution, seconded by Council Member Beck. The resolution was adopted by a roll call vote of seven ayes and two nays (Council Members Barcome and Paszek.) Council Member Taylor made a motion to combine public hearing on the next two resolutions, seconded by Council Member Zakrzewski. The motion carried. Council Member Taylor made a motion to accept substitute Resolution No. 67 -87 on file with the City Clerk, seconded by Council Member Beck. The motion carried. Ernest Szarwark, attorney, indicated Allied Products is a diversified corporation which owns two divisions in South Bend, South Bend Stamping Division and White Farm. He indicated these abatements are for the White Farm, or New Idea Division, which is located at 701 South Chapin He indicated they plan to upgrade the sprinkler system, install new convayors, overhaul the elevator, and do other miscellaneous building revamping. He indicated they also planned to purchase numerous pieces of factory machinery. He indicated this project will save approximately fifty jobs . Council Member Taylor made a motion to adopt Resolution No. 1525 -87, seconded by Council Member Barcome. The resolution was adopted by a roll call vote of nine ayes. RESOLUTION NO. 1527 -87 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND DESIGNATING CERTAIN AREAS WITHIN THE CITY COMMONLY KNOWN AS 220 WEST ECKMAN STREET AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF PERSONAL PROPERTY TAX ABATEMENT. rM WHEREAS, a petition for personal property tax abatement consideration has been filed with the Common Council of the City of South Bend, requesting that the area commonly known as 220 West Eckman Street, South Bend, Indiana, and which is more particularly described as follows: Real Estate in St. Joseph County, in the State of Indiana, described as follows: A tract of land located in the Northwest Quarter of Section 24, Township 37 North, Range 2 East, City of South Bend, St. Joseph County, Indiana, and described as follows: Beginning at an iron pipe at the Southwest corner of the Northwest Quarter of said Section 24; thence North 00000'00" East (all bearings assumed) along the West line of the said Quarter Section, 1136.35 feet to a 4" fence post, said point being at the South Right of Way of Eckman Street (50' Right of Way); thence North 88048143" East along the said Right of Way line of Eckman Street 343.75 feet to a point identified by a cross cut in concrete, said point being on the Right of Way line of Pennsylvania System Vandalia Rail Road Company (99' Right of Way); thence Southwesterly along the said Rail Road Right of Way 1174.85 feet measured on a curve to the right having a radius of 5682.44 feet, subtended by a chord having a bearing of South 13008102" West and a chord length of 1172.80 feet; thence South 88059132" West, 77.20 feet to the Point of Beginning and containing 6.035 acres more or less. be designated as an Economic Revitalization Area under the provisions of Indiana Code 6 -1.1- 12.1 -1, et seq.; and WHEREAS, the Redevelopment Commission has concluded an investigation and prepared a report with information sufficient for the Common Council to determine that the area qualifies as an Economic Revitalization Area under Indiana Code 6 -1.1- 12.1 -1, et seq., and has further prepared maps and plats showing the boundaries and such other information as required by law of the area in questions; and WHEREAS, the Human Resources and Economic Development Committee of the Common Council has reviewed said report and recommended to the Common Council that the area qualifies as an Economic Revitalization Area. Council Member Voorde made a motion to accept the substitute resolution on file with the City Clerk, seconded by Council Member Zakrzewski. The motion carried. Ernest Szarwark, attorney, indicated that Sibley's intended to increase the capacity at the foundry in order to enable them to produce more intricate and complex products. He indicated this expansion was a vital component to the Company's survival in an increasing competitive environment. He indicated sixty to seventy -five new jobs will be created. Council Member Taylor made a motion to adopt this resolution, as amended, seconded by Council Member Barcome. The resolution was adopted by a roll call vote of nine ayes. RESOLUTION NO. 1528 -87 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE MAYOR TO SUBMIT AN APPLICATION TO THE INDIANA DEPARTMENT OF COMMERCE FOR THE STATE INDUSTRIAL DEVELOPMENT GRANT FUND PROGRAM. (INTRACOMP INC.) WHEREAS, the City of South Bend, Indiana, is dedicated to pursuing economic development through promoting growth of businesses which stimulate the local economy and thereby benefit the people of South Bend as a whole; and nil a WHEREAS, IntraComp Inc., project will benefit the local economy, specifically by increasing its present staff level of 22 employees to 52 employees, for a total of 30 new jobs; and WHEREAS, IntraComp Inc., is located in the South Bend area, but their present leased facility does not provide the firm with the space for expansion. In an effort to retain the existing business and facilitate the firm's expansion, a site has been tentatively selected that is located in Phase IV of the Industrial Foundation's Airport Industrial Park; and WHEREAS, the site will require various site improvements including water, sewer, and road work. The receipt of a State Industrial Development Grant will enable the City of South Bend to finance this project with a fifty percent (50a) match of that cost, not to exceed $75,000., for the purpose of providing IntraComp adequate water, sewer, and access to their property. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Council hereby establishes the authority of the Mayor of the City of South Bend to submit a State Industrial Development Grant application to the Indiana Department of Commerce for the IntraComp project. SECTION II. This Resolution shall be in full force and effect immediately upon passage by the Common Council of the City of South Bend, Indiana, and approval by the Mayor. /s/ Joseph T. Sherrie Shane, Department of Economic Development, indicated IntraComp is located in the South Bend area, however, their present facility does not provide space for expansion. She indicated a site in the Industrial Foundation's Airport Industrial Park has been selected, and the company has indicated it will make a capital investment of approximately $850,000 and will create thirty full -time jobs within two years. She indicated this grant of $75,000 will be matched locally with $37,500 coming from the LRSF, and $37,500 coming from the Industrial Foundation. She indicated these proceeds will be used to construct an access road and to extend water and sewer lines to the project site. Council Member Barcome made a motion to adopt this resolution, seconded by Council Member Paszek. The resolution was adopted by a roll call vote of nine ayes.
