ROLL CALL Present: Council Members Serge, Braboy, Puzzello, Taylor, Zakrzewski, Barcome, Paszek, Voorde and Beck Absent: None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: The sub - committee has inspected the minutes of the June 8, 1987 meeting of the Council and found them correct. Barcome Barcomem Council Member Beck made a motion that the minutes of the June 8, 1987, meeting of the Council be accepted and placed on file, seconded by Council Member Taylor. The motion carried. SPECIAL BUSINESS RESOLUTION NO. 1519 -87 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, COMMENDING THE POLISH NATIONAL ALLIANCE, POST 83 ON ITS ONE HUNDREDTH (100TH) ANNIVERSARY. WHEREAS, the Common Council of the City of South Bend, Indiana, recognizes with pride that the Polish National Alliance, Post 83, is celebrating its One Hundredth (100th) Anniversary this year; and WHEREAS, the PNA has established a reputation of being of being a social and service organization dedicating itself to many worthwhile social activities and sponsoring several athletic activities throughout our community; and WHEREAS, over eight hundred (800) adult members belong to the PNA Post 83, all of which have some Polish extraction; and WHEREAS, a special recognition dinner in honor of its 100th anniversary was held on Saturday, June 20, 1987. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. On behalf of the citizens of the City of South Bend, Indiana, the Common Council hereby publicly commends the Polish National Alliance, Post 83, on reaching its One Hundredth (100th) Anniversary. SECTION II. The Common Council wishes PNA Post 83 and all of its members continued growth and prosperity as it begins another year of serving our community. SECTION III. This resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. /s/ Joseph T. Council Member Zakrzewski read the resolution and presented it to members of the PNA. Council Member Taylor made a motion to adopt the resolution, seconded by Council Member Barcome. The resolution was adopted by a roll call vote of nine ayes. M REGULAR MEETING REPORTS JUNE 22, 1987 Council Member Zakrzewski indicated the Residential Neighborhood Committee had met regarding traffic problems on Widener Lane. He indicated the majority of the residents in attendance at this meeting wanted Widener closed at Miami. Council Member Voorde indicated the Zoning and Vacation Committee had met on Bill No. 53 -87 and recommended it favorably. Council Member Braboy indicated that the Human Resources Committee had met on Bill No. 54 -87 and recommended it favorably. Council Member Taylor made a motion to resolve into the Committee of the Whole, seconded by Council Member Zakrzewski . The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on June 22, 1987, at 7:28 p.m., with nine members present. Chairman Puzzello presiding. BILL NO. 53 -87 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST NORTH -SOUTH ALLEY WEST OF IRONWOOD DRIVE RUNNING SOUTH FROM PLEASANT STREET TO THE ST. JOSEPH RIVER FOR A DISTANCE OF 136 FEET MORE OR LESS. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mary Schaffer, 2108 Pleasant, made the presentation for the bill. She indicated she was requesting this vacation for the safety of neighborhood children and the security of adjacent home owners. Council Member Zakrzewski made a motion to recommend this bill to the Council favorably, seconded by Council Member Taylor. The motion carried. BILL NO. 54 -87 A BILL TO APPROPRIATE $287,500 FROM THE ECONOMIC DEVELOPMENT STATE GRANT FUND TO BE ADMINISTERED BY THE DEPARTMENT OF ECONOMIC DEVELOPMENT OF THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Donald Inks, Director of Community Development, made the presentation for the bill. He indicated this appropriation of State grant money would be used as a loan to assist Sibley Machine and Foundry Corporation and Precision Tool & Die in their proposed projects. Council Member Zakrzewski made a motion to recommend this bill to the Council favorably, seconded by Council Member Taylor. The motion carried. There being no further business to come before the Committee of the Whole, Council Member Taylor made a motion to rise and report to the Council, seconded by Council Member Zakrzewski. The motion carried. RESOLUTIONS 107 RESOLUTION NO. 1520 -87 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, RECOMMENDING THAT A COUNTY -WIDE WOMEN'S COMMISSION BE ESTABLISHED BY THE ST. JOSEPH COUNTY COUNCIL WHEREAS, various members of the Common Council have been apprised by the Working Women's Coalition of the growing economic hardships facing today's women; and WHEREAS, according to the U. S. Department of Commerce, Bureau of Census; one -third (1/3) of all female headed households are living below the poverty line and two (2) out of three (3) adults in poverty are women; WHEREAS, it has been estimated that women workers in the Michiana area earn fifty -four cents ($.54) for every dollar earned by a man whereas the national figure is sixty -five cents ($.65); and WHEREAS, a county -wide commission could be established to address such items as wage and salary inequities; inadequate child care facilities; inadequate housing, health care, job training and educational opportunities are to monitor progress in each of these areas. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council of the City of South Bend, Indiana is aware of the growing concerns facing women in the Michiana area. SECTION II. The Council believes that a county -wide commission which would address such items as wage and salary inequities, inadequate child care facilities, inadequate housing, health care, job training, and educational opportunities would be in the best interests of the community. SECTION III. The Council recommends that the St. Joseph County Council consider establishing a "County Women's Commission" and pledges its support to the County Council in such an endeavor. Bartlett; Ellyn Stecker, 1036 Niles Ave., Co -Chair of NOW; Jodi Fox 17775 Douglas, President of the League of Women Voters; Theresa DeSimone, 5345 York Road; Elizabeth Mooney, 701 Marquette; Linda Cook - Gordan, 629 W. LaSalle; and Mary Craypo, 1106 Oak Ridge, spoke in favor of this resolution. Council Member Zakrzewski made a motion to adopt this resolution, seconded by Council Member Taylor. The resolution was adopted by a roll call vote of nine ayes. RESOLUTION NO. 1521 -87 A RESOLUTION TRANSFERRING THE UNUSED AND UNENCUMBERED BALANCE OF $8,213.78 FROM THE BOND PROCEEDS OF '81 FUND TO THE GENERAL OBLIGATION DEBT FUND AND FURTHER TRANSFERRING THE UNUSED AND UNENCUMBERED BALANCE OF $34,180.50 FROM THE GENERAL OBLIGATION DEBT FUND TO THE GENERAL FUND OF THE CITY OF SOUTH BEND. WHEREAS, a bond proceeds fund, commonly referred to as the Bond Proceeds of 181 Fund, was created by Ordinance No. 6908 -81 in order to pay for capital expenditures on behalf of the City of South Bend; and WHEREAS, the purpose of the bond issue has been accomplished; and WHEREAS, the Council now desires to transfer surplus monies in said fund to the General Obligation Debt Fund of the City of South Bend, pursuant to its authority under I. C. 5- 1 -13 -2; and WHEREAS, a Sinking Fund, commonly referred to as the General Obligation Debt Fund, was created by Ordinance No. 7108 -82 in order to pay the City's debt incurred through the issuance of Municipal bonds; and w� REGULAR MEETING JULY 13, 1987 WHEREAS, all General Obligation outstanding debt has now been retired; and WHEREAS, the Council now desires to transfer surplus monies in said General Obligation Debt Fund of the City of South Bend. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: SECTION I. That the sum of $8,213.78, being the amount of monies remaining in the Bond Proceeds of 181 Fund, is hereby transferred from said fund to the General Obligation Debt Fund of the City of South Bend, Indiana. SECTION II. That the sum of $34,180.50 being the current unused and unencumbered balance of $25,966.72 plus the amount of $8,213.78 being transferred from the Bond Proceeds of '81 Fund to the General Obligation Debt Fund, is hereby transferred from said General Obligation Debt Fund of the City of South Bend, Indiana to the General Fund of the City of South Bend, Indiana. SECTION III. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. s /Joseph T. Michael Vance, Controller, indicated State law allows the City to transfer the unused monies in a fund that has fulfilled its purpose. He indicated that both of these funds are related to the bonds of 181 for purchase of miscellaneous equipment and materials. He indicated they were asking for the transfer of the balance of the proceeds not spent to the General Obligation Debt Fund. Council Member Taylor made a motion to adopt this resolution, seconded by Council Member Zakrzewski. The resolution was adopted by a roll call vote of nine ayes. 1 :11 *0& -Ina 4;i44M0OLA934�Les BILL NO. 56 -87 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE 40 FOOT RIGHT -OF -WAY OF LATHROP STREET FROM THE NORTHWEST CORNER OF SECTION 33, TOWNSHIP 38 NORTH, RANGE 2 EAST, EAST TO 450 FEET WEST OF THE WEST RIGHT -OF -WAY LINE OF FOUNDATION DRIVE, A DISTANCE OF APPROXIMATELY 2,000 FEET. This bill had first reading. Council Member Puzzello made a motion to set this bill for second reading and public hearing July 13, 1987, and refer it to Zoning and Vacation Committee, seconded by Council Member Barcome. The motion carried. BILL NO. 57 -87 A BILL AUTHORIZING THE CITY OF SOUTH BEND, INDIANA (THE "CITY "), TO ISSUE ITS "ECONOMIC DEVELOPMENT REVENUE BOND, SERIES 1987 (KOKOKU WIRE INDUSTRIES CORPORATION PROJECT), IN THE AGGREGATE PRINCIPAL AMOUNT OF THREE MILLION TWO HUNDRED THOUSAND DOLLARS ($3,200,000.00) AND APPROVING AND AUTHORIZING CERTAIN ACTIONS WITH RESPECT THERETO. This bill had first reading. Council Member Barcome made a motion to set this bill for second reading and public hearing July 13, 1987, seconded by Council Member Paszek. The motion carried. BILL NO. 58 -87 A BILL APPROPRIATING $108,927.74 FROM THE ZOO ENDOWMENT FUND, ACCOUNT NUMBER 403 TO ACCOUNT 399.0 CONTRACTUAL SERVICES, SAID ACCOUNT BEING WITHIN THE GENERAL PARK FUND. This bill had first reading. Council Member Barcome motion to set this bill for second reading and public hearing July 13,1987, and refer it to the Parks Committee, seconded by Council Member Paszek. The motion carried. BILL NO. 59 -87 A BILL APPROPRIATING $115,478.00 AMONG VARIOUS ACCOUNTS WITHIN THE DIVISION OF COMMUNITY DEVELOPMENT. This bill had first reading. Council Member Puzzello made a motion to set this bill for second reading and public hearing July 13, 1987, and refer it to the Human Resources Committee, seconded by Council Member Barcome. The motion carried. BILL NO. 60 -87 A BILL APPROPRIATING $66,000.00 FROM THE FEDERAL ASSISTANCE GRANT FUND COMMONLY REFERRED TO AS THE GENERAL REVENUE SHARING TRUST FUND TO ACCOUNT 4399.0 OTHER CONTRACTUALS TO PAY THE 1987 PLEDGE TO PROJECT FUTURE BY THE CITY OF SOUTH BEND. Council Member Barcome made a motion to refer this ill to the Board of Works, seconded by Council Member Zakrzewski. The motion arried on a roll call vote of five ayes and four nays (Council Members Braboy, eck, Taylor and Serge.) Council Member Beck made a motion that the report from the oard of Works be submitted by July 27, seconded by Council Member Taylor. She indicated that the overall basis for the denial is that the uth Bend Common Council has no authority to remove the Mayor from office.
