ROLL CALL Present: Council Members Braboy, Puzzello, Taylor, Beck, Zakrzewski, Barcome, Paszek, Voorde and Serge Absent: None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: The sub - committee has inspected the minutes of the February 23, meeting of the Council and found them correct. Therefore, we recommend the same be approved. /s/ Beverlie J. Beck /s/ Al Paszek /s/ Joseph Serge Council Member Taylor made a motion that the minutes of the February 23, meeting of the Council be accepted and placed on file, seconded by Council Member Barcome. The motion carried. SPECIAL BUSINESS RESOLUTION NO. 1477 -87 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, COMMENDING HAROLD BRAZIER FOR HIS OUTSTANDING ATHLETIC ACCOMPLISHMENTS AND MANY CONTRIBUTIONS TO OUR COMMUNITY WHEREAS, the Common Council of the City of South Bend, Indiana, acknowledges that Harold Brazier holds the Junior Welterweight Division Title of The North American Boxing Federation; and WHEREAS, Harold Brazier won the boxing title in October of 1986 and defended and retained the title on February 28, 1987; and WHEREAS, Harold Brazier is a native of South Bend, Indiana, and a graduate of Riley High School; and WHEREAS, he is married, the father of four (4) children and a member of Faith Baptist Church; and WHEREAS, the Common Council believes that Harold Brazier exemplifies the high standards and qualities which have made him an excellent role model for the youth of our nation and especially the youth of our community. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. On behalf of all of the citizens of South Bend, Indiana, the Common Council hereby publicly commends Harold Brazier for winning and retaining the Junior Welterweight Division Title of the North American Boxing Federation. SECTION II. The Common Council believes that Harold Brazier's outstanding athletic achievements and personal contributions have brought honor to both him and his community. SECTION III. The Common Council believes that the hard work and dedication of Harold Brazier make him an excellent role model to our youth and we wish him continued success in the years ahead. SECTION IV. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. /s/ Joseph T. Barcome Member of the Common Council 31 NU REGULAR MEETING MARCH 9, 1987 /s/ Al Paszek Member of the Common Council /s/ John Voorde Member of the Common Council Council Member Braboy read the resolution and presented it to Harold Brazier. Council Member Voorde made a motion to adopt this resolution, seconded by Council Member Zakrzewski. The resolution was adopted by a roll call vote of nine ayes. REPORTS Council Member Voorde indicted that the Zoning and Vacation Committee had met on Bill nos. 121, 138- 86,and 4 -87. He indicated 121 and 4 received a favorable recommendations, and 138 -86 received no recommendation. Council Member Puzzello indicated that the Public Safety Committee had met on Bill No. 8 -87, and recommended it favorably, as amended. Council Member Braboy indicated that the Human Resources Committee had met on resolutions 87 -8, 87 -22 and 87 -21. She indicated that 8 and 22 received favorable recommendations, and 87 -21 would be continued until March 23. Council Member Barcome made a motion to resolve into the Committee of the Whole, seconded by Council Member Taylor. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on March 9, at 7:08 p.m., with nine members present. Chairman Puzzello presiding. BILL NO. 121 -86 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 1025 E. CALVERT STREET, IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Michael Dantz, from Area Plan, gave the staff report which favorably recommended this zoning. Council Member Beck made the presentation for the bill. She indicated this zoning legalized an already exiting usage of the property. She indicated this home has always been a duplex. Council Member Barcome made a motion to recommend this bill to the Council favorably, seconded by Council Member Paszek. The motion carried. BILL NO. 138 -86 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED IN THE 1700 BLOCK OF EAST RANDOLPH STREET IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Mike Dantz, of Area Plan, gave the staff report, which recommended this zoning favorably. Council Member Beck made a motion to accept the substitute bill on file with the City Clerk, seconded by Council Member Taylor. The motion carried. Council Member Beck made the presentation for the bill. She indicated the property was owned by Reith Riley, and purchased by Bamar Plastics. She indicated Bamar was notified that it was going to be rezoned. She indicated the property was presently zoned "E" Industrial and this is not the zoning that should be in a residential neighborhood. Don Richards, 1717 Robinson, spoke in favor of this rezoning. Tim Hartzer, attorney representing Bamar Manufacturing, is interested in expanding its business. He indicated that Bamar's present building is located on "D" Light Industrial. He indicated Bamar has been interested in this property for several years. He indicated that they were aware that th4e zoning process was underway, however, due to a two month continuance in Area Plan they did not receive another notice. He indicated the zoning has been amended and does not include the entire parcel, however, they wanted to expand on the entire site. Barry Lee, 2301 Topsfield Road, indicated they have been negotiating for the purchase of this land for approximately seven years. He indicated they needed to expand their business in South Bend, due to the fact that they have closed their Little Rock, Arkansas operation. Ralph Johnson, 630 E. Fairview; Dave Hoeflinger, 1801 S. Robinson; and James Cronk, 702 E. LaSalle, spoke in opposition to this zoning. Council Member Taylor made a motion to recommend this bill to the Council favorably, as amended, seconded by Council Member Braboy. Council Member Voorde made a motion to recess, seconded by Council Member Paszek. The motion carried and the meeting was recessed at 7:45 p.m., and reconvened at 7:55 p.m. The favorable recommendation passed by a roll call vote of nine ayes. BILL NO. 4 -87 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 3501 EAST JEFFERSON BOULEVARD IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Michael Dantz, from Area Plan, gave the staff report, which was favorable. Susanne Hanson, attorney, made the presentation for the bill. She indicated Holy Cross Health Systems, planned to continue to use this building as office space. She indicated there would be ETING MARCH 9, 1987 approximately six employees working out of this building. Council Member Barcome made a motion to accept the substitute bill on file with the City Clerk, seconded by Council Member Taylor. The motion carried. Council Member Beck made a motion to recommend this bill to the Council favorably, as amended, seconded by Council Member Serge. The motion carried. BILL NO. 14 -87 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST EAST -WEST ALLEY NORTH OF MISHAWAKA AVENUE, RUNNING EAST FROM SOUTH 25TH STREET, FOR A DISTANCE OF APPROXIMATELY 128 FEET, TO THE FIRST NORTH -SOUTH ALLEY EAST OF SOUTH 25TH STREET, RUNNING NORTH FROM MISHAWAKA AVENUE. Council Member Serge made a motion to strike this bill, seconded by Council Member Voorde. The motion carried. BILL NO. 15 -87 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST EAST -WEST ALLEY SOUTH OF WAYNE STREET EXTENDING WEST FROM THE WEST LINE OF ST. PETERS STREET TO THE EAST LINE OF ST. LOUIS STREET, BEING IN COTTRELL'S FIRST ADDITION TO THE TOWN OF LOWELL, CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA; ALSO, THE FIRST NORTH -SOUTH ALLEY WEST OF ST. PETERS STREET EXTENDING SOUTH FROM THE SOUTH LINE OF WAYNE STREET TO THE NORTH LINE OF THE FIRST INTERSECTING EAST -WEST ALLEY, BEING IN COTTRELL'S FIRST ADDITION TO THE TOWN OF LOWELL, CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA. Council Member Serge made a motion to continue public hearing on this bill until March 23, seconded by Council Member Taylor. The motion carried. BILL NO. 8 -87 A BILL AMENDING CHAPTER 4 ENTITLED LICENSES AND CHAPTER 5 ENTITLED ANIMALS AND FOWL OF THE SOUTH BEND MUNICIPAL CODE. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Voorde made a motion to accept the substitute bill on file with the City Clerk, seconded by Council Member Beck. The motion carried. Michael Vance, City Controller, made the presentation for the bill. He indicated this bill will designate the St. Joseph County Humane Society to issue licenses on their premises in the City's name. He indicated the City has issued dog licenses for many years, but feels the Humane Society is in a better position to issue the licenses because of their contact with the animal owners. He indicated this upgraded level of licensing would insure greater compliance with the ordinance and with health and safety requirements concerning dog vaccinations, etc. He indicated the passage of this bill will allow the City to better control the dog population. Ralph Johnson, 630 E. Fairview; Ken Donnelly, 2605 Frederickson; Pat Meeks, 1141 E. Calvert, spoke in favor of this bill. Council Member Serge made a motion to recommend this bill to the Council favorably, as amended, seconded by Council Member Barcome. The motion carried. There being no further business to come before the Committee of the Whole, Council Member Serge made a motion to rise and report to the Council, seconded by Council Member Taylor. The motion carried. RESOLUTIONS RESOLUTION NO. 1478 -87 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND DESIGNATING CERTAIN AREAS WITHIN THE CITY COMMONLY KNOWN AS 2901 SOUTH MAIN AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF REAL PROPERTY TAX ABATEMENT. WHEREAS, a petition for real property tax abatement consideration has been filed with the Common Council of the City of South Bend, requesting that the area commonly known as 2901 S. Main, South Bend, Indiana, and which is more particularly described by a line drawn as follows: Lots 84 through 96 both inclusive Oakside 3rd addition to the city of South Bend. be designated as an Economic Revitalization Area under the provisions of Indiana Code 6 -1.1- 12.1 -1, et seq.; and WHEREAS, the Redevelopment Commission has concluded an investigation and prepared a report with information sufficient for the Common Council to determine that the area qualifies as an Economic Revitalization Area under Indiana Code 6 -1.1- 12.1 -1, et seq., and has further prepared maps and plats showing the boundaries and such other information as required by law of the area in questions; and WHEREAS, the Human Resources and Economic Development Committee of the Common Council has reviewed said report and recommended to the Common Council that the area qualifies as an Economic Revitalization Area. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. That the Common Council hereby accepts the report and recommendation of the Human Resources and Economic Development Committee that the area herein described be designated an Economic Revitalization Area and hereby adopts a resolution designating this area as an Economic Revitalization Area for purposes of real property tax abatement. SECTION II. That this designation shall be limited to five (5) calendar years from the date of the adoption of this resolution by the Common Council. SECTION III. That the Common Council directs the City Clerk to cause notice of the adoption of this resolution to be published, said publication providing notice of the public hearing before the Common Council on said declaration. SECTION IV. This resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. /s /Joseph T. Serge Member of the Common Council A public hearing was held on the resolution at this time. William Madlin, president of Aerolite, indicated they were planning to revamp this building in order to build truck frames and bodies. He indicated the building was in bad shape and major renovations were needed. He indicated sixty new jobs will be created. Ralph Johnson, 630 E. Fairview, spoke in favor of this abatement. Council Member Taylor made a motion to adopt this resolution, seconded by Council Member Puzzello. The resolution was adopted by a roll call vote of nine ayes. Council Member Beck made a motion to combine public-hearing on the next two resolutions, seconded by Council Member Taylor. The motion carried. M I AR_MERTTNn MARCH 9, 1987 RESOLUTION NO. 1479 -86 A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND, COMMONLY KNOWN AS 2920 SAMPLE STREET TO BE AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF REAL PROPERTY TAX ABATEMENT. WHEREAS, the Common Council of the City of South Bend has adopted a Declaratory Resolution designating certain areas within the City as Economic Revitalization Areas for purpose of tax abatement consideration; and WHEREAS, a Declaratory Resolution designated the area commonly known as 2920 Sample Street and more particularly described by a line drawn as follows: Situate in St. Joseph County, in the State of Indiana A lot or parcel of land in the Northwest Quarter of the Northwest quarter of Section Fifteen (15), Township Thirty -seven (37) North, Range Two (2) East, described as follows, to -wit: Beginning on the South line of Sample Street in the City of South Bend, Indiana, at a point 330 feet East and 35 feet South of the Northwest corner of said Section 15; thence East along the south line of Sample Street 400 feet;thence south a distance of 536.78 feet more or less to the Northerly right of way line of the New Jersey, Indiana and Illinois Railroad; thence Southwesterly along said Northerly right of way line of the New Jersey, Indiana and Illinois Railroad 437.58 feet more or less to a point due South of the place of beginning; thence North 714.1 feet more or less to the place of beginning. That the Common Council hereby confirms its Declaratory Resolution designating the area described herein as an Economic Revitalization Area for the purposes of tax abatement. Such designation is for real property tax abatement only and is limited to five (5) calendar years from the date of adoption of the Declaratory Resolution by the Common Council. SECTION II. Serge Member of the Common Council A public hearing was held on the resolutions at this time. Eric Petersen, Chairman of the Board of Petersen Printing, indicated his company was experiencing the need for larger operating facilities, as well as newer technological equipment. He indicated their professional personnel, traditional commitment to superior quality and flexible techniques has enable them to prosper and grow. He indicated their growth can only be made through continued capital improvements. Council Member Voorde made a motion to adopt, Resolution No. 1479 -87, seconded by Council Member Barcome. He indicated dogs should be impounded in a proper facility in order to protect the victim. Douglas Kline, 63551 Miami, owner of Powers Discount Drugs, indicated he was not satisfied with the treatment he received from Redevelopment. He indicated that Redevelopment has subsidized his competitor, Osco's. Wayne Wirts, 1889 Riverside Drive, spoke regarding City government. Ken Donnelly, 2605 Fredricks, spoke regarding the stadium. Ralph Johnson, 630 E. Fairview, indicated the City should sell all property it owns downtown. Council Member Serge asked for a Spring clean -up program.
