JULY 29, 1993
Be it remembered that the Common Council of the City of South Bend
met in the Council Chambers of the County -City Building on
Thursday, July 29, 1993, at 9:30 p.m. The meeting was called to
order and the Pledge to the Flag was given.
ROLL CALL Present: Council Members Luecke,
Washington, Kelly, Slavinskas,
Zakrzewski, Coleman, Duda and
Ladewski
Absent: Council Member Puzzello
Council Member Coleman made a motion to resolve into the Committee
of the Whole, seconded by Council Member Duda. The motion carried.
COMMITTEE OF THE WHOLE
Be it remembered that the Common Council of the City of South Bend
met in the Committee of the Whole on July 28, 1993 at 10:00 p.m.,
with eight members present. Chairman Zakrzewski presiding.
BILL NO. 60 -93 A BILL FIXING MAXIMUM SALARIES AND WAGES OF
APPOINTED OFFICERS AND NON - BARGAINING
EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA,
FOR THE CALENDAR YEARS 1994 AND 1995.
This being the time heretofore set for public hearing on the above
bill, proponents and opponents were given an opportunity to be
heard. Council Member Coleman reported that the Personnel &
Finance Committee had met on this bill and recommended the
substitute bill to the Council favorable. Council Member Luecke
made a motion to accept the substitute bill on file with the City
Clerk, seconded by Council Member Coleman. The motion carried.
Kevin Horton, Controller, made the presentation for the bill. He
indicated this bill represented a 1 1/2% increase, with a $300
bonus in 1994; 1 1/2% base increase in January of 1995 and 1 1/2%
base increase in July, 1995. He indicated there were six
exceptions in this bill: a new position has been created at
Century Center, assistant director, and two people will be upgraded
to that position with a salary of $38,506; in addition there will
be 4 changes in the division of Public Works - $2,000 increases for
each of the bureau managers; and a position of Finance Service
Director has been created for the utilities at a salary of $32,500.
He indicated the Building Department has added another position,
Inspection 5, however, it is not being filled at this time because
it is necessary for any one seeking this position to have additions -I
schooling at their own expense. Council Member Luecke made a
motion to delete the $300 bonus and insert 110" in the column for
Director of Vehicle Maintenance, Director Water Dept., Director of
Engineering, and Director of Transportation, and the assistant
directors of Century Center, seconded by Council Member Coleman.
The motion carried. Council Member Luecke made a motion to
eliminate the bonus of $300 for the Director of Financial Services,
seconded by Council Member Coleman. The motion carried. Council
Member Washington indicated he felt the Recreation Department
Directors should receive a higher increase then the 1 1/2. He made
a motion to increase their salary by 3 1/2% for 1994, seconded by
Council Member Duda. The motion failed on a roll call vote of four
ayes and four nays. Council Member Luecke made a motion to
recommend this bill to the Council favorable, as amended, seconded
by Council Member Coleman. The motion carried.
BILL NO. 59 -93 A BILL FIXING THE ANNUAL PAY AND MONETARY
FRINGE BENEFITS OF FIREFIGHTERS OF THE SOUTH
BEND FIRE DEPARTMENT FOR THE CALENDAR YEARS
1994, 1995, AND 1996.
Council Member Coleman reported that the Personnel & Finance
Committee had met on this bill and made no recommendation.
Kathleen Cekanski - Farrand, Council attorney, introduced the
negotiating teams. She indicated the Firefighters Local Union 362
did not ratify the negotiated contract. Council Member Coleman
made a motion to accept the substitute bill on file with the City
Clerk, seconded by Council Member Duda. The motion carried. Kathy
Cekanski indicated the bill should be amended on page two to
reflect 1995 salaries of $43,517 for the Chief; $39,500 for the
asst. chiefs; $39,500 for the battalion chiefs. 1996 salaries
of $45,693 for the Chief; $41,475 for the asst. chiefs; $37,041 for
the battalion chiefs; and the specialist position will remain open
for 1995 and 1996; the 1996 salary for captains should be reduced
$278 for a total of $28,958; the salary for engineers should be
reduced $265 for a total of $27,560; firefighters 1st class should
be redu ed $228 for a total of $23,472; firefighters should be
reducedgl97 for a total of $20,618. In paragraph (b) add a
sentence to the paragraph which reads "Said 8 -Hour Incentive Pay
shall also be paid to officers in 1995 and 1996 only." In
paragraph (c) insert $1,000. Delete paragraph (d) regarding
Conditional Hydrant Users Fee and Effect as well as current
paragraph (e). Reletter current paragraphs (f) to (d) and (g) to
(e). Council Member Luecke made a motion to accept this amendment,
seconded by Council Member Duda. Council Member Luecke made a
motion to amend the original amendment in Section IX (d) third
sentence from the end of the paragraph change the amount from $227
to $250 per month. seconded by Council Member Duda. The motion
carried on a roll call vote of five ayes and three nays (Council
Members Washington, Slavinskas and Zakrzewski.) Marty Orlowski,
Fire Department Negotiating Team, indicated there were never
offered a base pay raise, and our retirees will not have an
increase in their pensions. Jeff Polansky, firefighter, spoke
against this bill. After discussion Council Member Slavinskas made
a motion to amend and return the $250 in Section XI (d) to $227 per
month, seconded by Council Member Washington. The motion carried.
Council Member Kelly made a motion to recommend this bill to the
Council favorable, as amended, seconded by Council Member Ladewski.
The motion carried.
Council Member Luecke made a motion to rise and report to the
Council, seconded by Council Member Coleman. The motion carried.

County -City Building at 11:30 p.m. Council President Luecke
presiding, and eight members present.

ORDINANCE NO. 8396 -93 AN ORDINANCE FIXING MAXIMUM SALARIES AND
WAGES OF APPOINTED OFFICERS AND NON -
BARGAINING EMPLOYEES OF THE CITY OF SOUTH
BEND, INDIANA, FOR THE CALENDAR YEARS
1994 AND 1995.
This bill had third reading. Council Member Coleman made a motion
to amend this bill, seconded by Council Member Duda. The motion
carried. Council Member Coleman made a motion to pass the bill, as
amended, seconded by Council Member Duda. The bill passed by a
roll call vote of seven ayes and one nay (Council Member
Washington.)
ORDINANCE NO. 9397 -93 AN ORDINANCE FIXING THE ANNUAL PAY AND
MONETARY FRINGE BENEFITS OF FIREFIGHTERS
OF THE SOUTH BEND FIRE DEPARTMENT FOR THE
CALENDAR YEARS 1994, 1995, AND 1996.
This bill had third reading. Council Member Coleman made a motion
to amend this bill, seconded by Council Member Duda. The motion
carried. Council Member Coleman made a motion to pass the bill, as
amended, seconded by Council Member Duda. The bill passed by a
roll call vote of six ayes and two nays (Council Member Slavinskas
and Zakrzewski.)
There being no further business to come before the Council
unfinished or new, Council Member Coleman made a motion to adjourn,
seconded by Council Member Zakrzewski. The motion carried and the
meeting was adjourned at 11:35 p.m.
