Tlus Easement Agreement is made by and between Roger Hartman (Grantor) and the
Board of Public Works of the City of South Bend, Indiana (Crrantee) and is entered
into this 9"--1 day of p 2002.
WHEREAS, Roger Hartman (Grantor) is the owner of the following described real
estate:
A parcel of land being a part of the Southeast Quarter of Section 3,
Township 37 North, Range 2 East, Portage Township, City of South Bend,
St. Joseph County, Indiana and being more particularly described as
follows: Beginning at the Northwest corner of Lot Number 9 as shown on
the Recorded Plat of O'Bannon's Subdivision of a part of Large Lot
Numbered 2 in Kunstman and Meyer's Addition to the City of South Bend,
the same being recorded in the Office of the Recorder of St. Joseph
County, Indiana in Plat Book 5, Page 38; thence North 90100'00" East, a
distance of 30.15 feet; thence South 00151'01" West, a distance of 132.01
feet; thence North 90°00'00" West, a distance of 30.00 feet; thence North
00°47'08" East, a distance of 132.01 feet to the place of beginning.
Said tract of land being also known as lots one (1) and two (2) of the
proposed plat of Snelson-Hartman Minor Subdivision.
WHEREAS, Grantor desires and/or finds it necessary to create an easement for the
construction, operation and maintenance of water lines and services along, over, across
and under the following described real estate:
A parcel of land being a part of the Southeast Quarter of Section 3,
Township 37 North, Range 2 East, Portage Township, City of South Bend,
St. Joseph County, Indiana and being more particularly described as
follows:
Commencing at the Northwest corner of Lot Number 9 as shown on the
Recorded Plat of O'Bannon's Subdivision of a part of Large Lot
Numbered 2 in Kunstman and Meyer's Addition to the City of South Bend,
the same being recorded in the Office of the Recorder of St. Joseph
County, Indiana in Plat Book 5, Page 38; thence North 90°00'00" East, a
distance of 23.75 feet to the place of beginning for this description; thence
continuing North 90°00'00" East, a distance of 6.40 feet; thence South
0015V0F West, a distance of 78.36 feet; thence North 90°00'00" West, a
distance of 6.40 feet; thence North 00°51'01" East, a distance of 79.36 feet
to the place of beginning.
The purpose of this easement is for the extension and/or installation of utilities and is
graphically represented in EXTUBIT `A' attached hereto and made a part hereof.

Re: Easement Vacation
Dear Ms. Jacob,

CONSTRUCTION SURVEYS
In May of this year, our office prepared and had recorded, an easement which was
intended to allow the future extension of water and/or sewer services to a lot in a
proposed minor subdivision.
This easement was recorded on May 16` L 2002 in the office of the Recorder of St.
Joseph County, Indiana as instrument numbered 0227348, a copy of which is enclosed
along with this request.
Subsequent to recording of this easement, it was determined that I had
misunderstood the criteria required by the Plat Committee of the Area Plan Commission
and that the recorded easement was not needed in this format. Therefore, I would request
that the South Bend Board of Works release and relinquish all rights granted by the
aforementioned recorded easement at their earliest convenience.
