Subject: Sale of Vacant City -Owned Lot
623 Indiana Avenue is a City -Owned vacant lot that was advertised for sale on August 31 and September
7, 2001. Bids were due to the Board of Works on September 24th.
There is only adjacent ro ert owner to 623 Indiana, a Mr. Elijah Jones. Mr. jones had expressed an
interest in buying the vacant lot and had indicated that he would submit a bid. A bid was not received by
Mr. Jones. I called him up today and told me that he had inadvertently missed the deadline and was still
interested in buying the lot.
I told Mr. Jones to submit a bid now, but could not guarantee him that it would be valid. The question is do
we have to re -advertise, or can we accept his late bid?

Thank you for your letter regarding the bids for the lot at 623 E. Indiana Avenue, Tax
Key Number - 18-7030-1172, Lot 36 Indiana Avenue Addition.
I would very much like to bid on the lot mentioned above, for $298.74, plus $90 for
advertising, and hope you will consider me for it. It is next door to my property and I
feel that I could benefit from the lot more than anyone else_

Because the abutting land owner has first priority on the sale of vacant property per Indiana Code and
because no other offers were received as to this property, in my opinion you do not need to readvertise.
Had the abutting owner not made an offer, and if the offer had come from a member of the general public,
my opinion would be different.

The Board of Public Works, at its public agenda session held October 19, 2001, accepted
your bid of $298.74, plus $90.00 for advertising costs, for the purchase of the above referred to City -
owned property.
Enclosed is a Purchase Agreement for this properties. Please sign it and return it to my
attention. The City Attorney's office will begin preparing the appropriate Quit Claim Deed for this
property for your signature.
Please submit a check to the Board of Public Works, made payable to the City of South Bend,
in the amount of $394.27. Once the payment has been returned to me, the Quit Claim Deed and
Purchase Agreement will be processed for this property. I will forward copies of the completed
documents to you.

The Board of Public Works has determined that the highest and best use of the adjacent property
is its sale to an abutting land owner - the parcel is approximately 35' wide by 152.7' long, a
configuration that is not suitable for the construction of a new single family structure, but offers
an opportunity to create additional yard space for an adjacent parcel that has very little; and that
the cost to the public of maintaining the tract equals or exceeds the estimated fair market value of
the tract - the tract's assessed value is $30.00 for property tax purposes, generally equaling
$90.00 in estimated value. Tracts with an assessed value less than $2,000.00 based on the most
recent assessment of the tract are not required to be appraised. The cost of mowing this tract is
estimated at $82.00 per mow, at a minimum of 5 times per year, equaling $410.00 per year.
