HomeMy WebLinkAbout09-21-92 Council Meeting Minutesa' H REGULAR MEETING SEPTEMBER 21, 1992 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Monday, September 21, 1992, at 5:00 p.m. The meeting was called to order and the Pledge to the Flag was given. ROLL CALL Present: Council Members Luecke, Washington, Kelly, Puzzello, Slavinskas, Zakrzewski, Coleman and Ladewski Absent: Council Member Duda SPECIAL BUSINESS RESOLUTION NO. 1972 -92 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, CONGRATULATING THE SOUTHEAST LITTLE LEAGUE ALL -STARS FOR WINNING THE INDIANA STATE CHAMPIONSHIP IN THE MAJOR BOYS DIVISION WHEREAS, the Common Council notes that each Spring thousands of boys and girls throughout the nation proudly take the "Little League Pledge" on opening day; and WHEREAS, Little League brings the hopes and dreams of youngsters, and their parents into a unique combination of working with League Officials, Managers, Coaches, Umpires, Auxiliary Members, and countless volunteer agencies and sponsors representing a cross section of the community; and WHEREAS, the Common Council is proud to acknowledge that for the first time in South Bend history, the Indiana State Championship was won by the Southeast Little League All -Stars in the Major Boys' Division; and WHEREAS, the Common Council is proud to acknowledge each of the members of this winning team: Tyler Back Andy Buda Ryan Cosner Ben Dance Ted Dobosiewicz Garret Ginter Josh Howell Aaron Kaser Tony Mathews James Palen David St. Clair Jeff Steele Nate VanLaere Caleb Wilson Stan Mathews, Manager Phil St. Clair, Coach Chuck Steele, Equip. Mgr. WHEREAS, this group of 11 and 12 year old boys had an overall record of 17 wins and 3 loses, and out hit their opponents with a record 110 runs to only 48 runs being scored by their opposition. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. On behalf of all of the citizens of the City of South Bend, Indiana, the Common Council hereby publicly congratulates the Southeast Little League All Star Team for winning the first State Championship in the history of our City in the Major Boys' Division. SECTION II. The Common Council publicly acknowledges each of these young men, their coaches, managers, parents, and sponsors for their willingness to strive for excellence and for being proud examples of our community in achieving their goals of the Little League Pledge. SECTION III. This resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. Kernan, Mayor A public hearing was held on the resolution at this time. Council Member Slavinskas made the presentation for the bill. He read the resolution and introduced the members of the team, as well as their coach and managers. Council Member Puzzello made a motion to adopt this resolution, seconded by Council Member Ladewski. The motion carried. REGULAR MEETING SEPTEMBER 21, 1992 Council Member Coleman made a motion to resolve into the Committee of the Whole, seconded by Council Member Kelly. The resolution was adopted by a roll call vote of eight ayes. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on September 21, 1992 at 5:15 p.m., with eight members present. Chairman Puzzello presiding. BILL NO. 57 -92 A BILL FIXING MAXIMUM SALARIES AND WAGES OF APPOINTED OFFICERS AND NON - BARGAINING EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, FOR THE CALENDAR YEARS 1993, 1994, AND 1995. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Luecke made a motion to accept the substitute bill on file with the City Clerk's office, seconded by Council Member Coleman. The motion carried. Council Member Puzzello reported that the Human Resources Committee had met on this bill and recommended it to the Council favorable, as amended. Mayor Kernan made the presentation for the bill. He indicated that for the most part increases would be paid in bonus form for non - bargaining employees, however, there were adjustments made in different positions for a variety of reasons. Kevin Horton, Controller, asked that the bill be amended on page 2, Chief Deputy City Clerk should be increased from $25,000 to $26,000, deputy should be increased from 22,850 to 23,850 on the base pay. Council Member Coleman made a motion to accept the amendment, seconded by Council Member Luecke. The motion carried. He indicated a 4.33% bonus would be paid one -half in January and the other in July. He said 31 positions have been recommended for adjustments, which will only effect the budget by $29,000. Council Member Luecke made a motion to recommend this bill to the Council favorable, as amended, seconded by Council Member Coleman. The motion carried. BILL NO. 74 -92 A BILL MAKING TECHNICAL CORRECTIONS TO ORDINANCE NO. 8280 -92 FIXING THE MAXIMUM SALARIES AND WAGES OF TEAMSTERS EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, FOR CALENDAR YEARS 1993, 1994, AND 1995. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Luecke made a motion to accept the substitute bill on file with the City Cler, seconded by Council Member Coleman. The motion carried. Kevin Horton, Controller, made the presentation for the bill. He indicted this bill would make necessary technical corrections to the Teamsters salary ordinance by eleiminating clerical errors and ommissions. Council Member Luecke made a motion to recommend this bill to the Council favorable, seconded by Council Member Coleman. The motion carried. BILL NO. 61 -92 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING VARIOUS SECTIONS WITHIN CHAPTER 2, ARTICLE 7 ENTITLED "BUDGETARY AND SALARY PROCEDURES" AND AMENDING VARIOUS SECTIONS WITHIN CHAPTER 2 ARTICLE 8 ENTITLED "CITY OFFICERS AND EMPLOYEES ". Council Member Luecke made a motion to continue this bill, at the request of the petitioner, until October 26, seconded by Council Member Coleman. The motion carried. BILL NO. 70 -92 A BILL LEVYING TAXES AND FIXING THE RATE OF TAXATION FOR THE PURPOSE OF RAISING REVENUE TO MEET THE NECESSARY EXPENSES OF THE CIVIL CITY OF SOUTH BEND FOR THE FISCAL YEAR ENDING DECEMBER 31, 1993. BILL NO. 69 -92 A BILL APPROPRIATING MONIES FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF SEVERAL DEPARTMENTS OF THE CIVIL CITY OF SOUTH BEND, INDIANA FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1993, AND ENDING DECEMBER 31, 1993, INCLUDING ALL OUTSTANDING CLAIMS AND OBLIGATIONS, AND FIXING A TIME WHEN THE SAME SHALL TAKE EFFECT. Council Member Coleman made a motion to combine public hearing on the above two bills in the Council portion, seconded by Council Member Zakrzewski. The motion carried. Council Member Luecke made a motion to accept the substitute on Bill No. 69 -92, seconded by Council Member Coleman. The motion carried. Jeff Rinard, City Auditor, indicated that Bill No. 69 -92 needed to be amended: on page 1 -8, City Clerk, in account 101.0201.411.10.01 decrease by $30.60; account 101 - 0201.411.11.01 decrease by $2.34; account 101 - 0201 - 411 -04 decrease $1.53 for a total decrease of $34.47; on page 1 -82, Building Department, account 101.1306.415.10.01 increase $1,776; account 101.1306.415.11 -01 increase $89.97; account 101.1306.416.11.04 increase $58.81 for a total of $1,834.92. Council Member Luecke made a motion to accept the amendment, seconded by Council Member Coleman. The motion carried. Council Member Luecke made a motion to recommend Bill No. 70 -92 to the Council favorable, as amended, seconded by Council Member Coleman. The motion carried. Council Member Luecke made a motion to recommend Bill No. 69 -92 to the Council favorable, seconded by Council Member Coleman. The motion carried. 108 REGULAR MEETING SEPTEMBER 21, 1992 Council Member Luecke made a motion to rise and report to the Council, seconded by Council Member Duda. The motion carried. BILLS, THIRD READING ORDINANCE NO. 8297 -92 AN ORDINANCE FIXING MAXIMUM SALARIES AND WAGES OF APPOINTED OFFICERS AND NON - BARGAINING EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, FOR THE CALENDAR YEARS 1993, 1994, AND 1995. This bill had third reading. Council Member Puzzello made a motion to amend this bill, as amended in the Committee of the Whole, seconded by Council Member Coleman. The motion carried. Council Member Coleman made a motion to pass the bill, as amended, seconded by Council Member Kelly. The bill passed by a roll call vote of six ayes and two nays (Council Member Slavinskas and Zakrzewski.) ORDINANCE NO. 8298 -92 AN ORDINANCE MAKING TECHNICAL CORRECTIONS TO ORDINANCE NO. 8280 -92 FIXING THE MAXIMUM SALARIES AND WAGES OF TEAMSTERS EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, FOR CALENDAR YEARS 1993, 1994, AND 1995. This bill had third reading. Council Member Coleman made a motion to amend this bill, as amended in the Committee of the Whole, seconded by Council Member Washington. The motion carried. Council member Coleman made a motion to pass the bill, as amended, seconded by Council Member Kelly. The bill passed by a roll call vote of eight ayes. ORDINANCE NO. 8299 -92 AN ORDINANCE LEVYING TAXES AND FIXING THE RATE OF TAXATION FOR THE PURPOSE OF RAISING REVENUE TO MEET THE NECESSARY EXPENSES OF THE CIVIL CITY OF SOUTH BEND FOR THE FISCAL YEAR ENDING DECEMBER 31, 1993. Council Member Coleman made a motion to pass the bill, as amended, seconded by Council Member Kelly. The bill passed by a roll call vote of eight ayes. PRIVILEGE OF THE FLOOR Jim Cierzniak, 1156 E. Victoria, spoke against the College Football Hall of Fame being built in South Bend. There being no further business to come before the Council unfinished or new, Council Member Coleman made a motion to adjourn, seconded by Council Member Ladewski.
