ROLL CALL Present: Council Members Luecke, Washington, Puzzello, Slavinskas, Zakrzewski, Duda, Coleman and Ladewski Absent: Council Member Kelly REPORT FROM THE SUB- COMMITTEE ON MINUTES To the Common Council of the City of South Bend: The sub - committee has inspected the minutes of the June 22, 1992, meeting of the Council and found them correct. Therefore, we recommend the same be approved. /s/ Stephen Luecke /s /Loretta Duda Council Member Coleman made a motion that the minutes of the June 22, meeting of the Council be accepted and placed on file, seconded by Council Member Puzzello. The motion carried. Council Member Puzzello made a motion to hear resolution 92 -53 under special business, seconded by Council Member Slavinskas. The motion carried. RESOLUTION NO. 1959 -92 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, INVITING THE PUBLIC TO PARTICIPATE IN THE WEST WASHINGTON NATIONAL HISTORIC DISTRICT AND COPSHAHOL "AROUND THE BLOCK" AND "TEA OF TOUR" ACTIVITIES. WHEREAS, the Common Council acknowledges that special summer activities designed to "make the past come alive" are taking place in the West Washington National Historic District and at Copshaholm; and WHEREAS, the "Around the Block" activities began on June 17th and run every Wednesday from 9:00 a.m. to 11:00 a.m. through August 12th - with all activities free to children ages 8 to 12 years of age; and WHEREAS, additionally every Thursday through August the "Tea and Tour" program will continue with tours of the West Washington National Historic District and Copshaholm, and tea at the Queen Ann Inn. WHEREAS, the Council urges all residents and especially their children to participate in these unique summer activities which will help foster pride, understanding and appreciation, where children can become a vital link to this important neighborhood, its revitalization, and its rebirth. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: SECTION I. The Common Council urges the public to participate in the "Around the Block" and "Tea and Tour" activities taking place in the West Washington National Historic District and at Copshaholm. SECTION II. Children's upcoming activities include: July 8: "Building Blocks: Stories that Buildings Tell" July 15: "Croquet and Crumpets" July 22: "Art and Architecture" July 29: "Folk Art & Songs" August 5: "Fun With Pioneer Children" August 12: "Sketching the City Scope" SECTION III. The Council believes that through the public's support of such activities, that pride and respect for each other and this important neighborhood of our City will continue to grow. SECTION IV. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. Kernan, Mayor A public hearing was held on the resolution at this time. Council Member Washington made the presentation for the resolution. He indicated that the Northern Indiana Historic Society was sponsoring "Around the Block" activities that began on June 17 and will run every Wednesday through August 12th for children ages 8 to 12. He indicated these activities will include; Building Blocks: Stories that Buildings Tell; Croquet and Crumpets; Art and Architecture; Folk Art & Songs; Fun with Pioneer Children; Sketching the City Scope. This activity is in conjunction with "Tea of Tour ", which is a tour of the West Washington National Historic District and Copshaholm, and tea at the Queen Ann Inn. He read the resolution and presented Jan Shupert- Erick, Educational Coordinator for the Northern Indiana Historic Society, with a copy. Council Member Slavinskas made a motion to adopt the resolution, seconded by Council Member Coleman. The resolution was adopted by a roll call vote of eight ayes. Council Member Coleman made a motion to resolve into the Committee of the Whole, seconded by Council Member Washington The motion carried COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on July 13, 1992 at 7:15 p.m., with eight members present. Chairman Puzzello presiding LL NO. 33 -92 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT NORTHWEST CORNER OF THE T INTERSECTION OF PORTAGE AVENUE AND BOLAND DRIVE, GERMAN TOWNSHIP, IN THE CITY OF SOUTH BEND, INDIANA. Council Member Luecke made a motion to continue public hearing on this bill, at the request of the petitioner, until August 24, seconded by Council Member Washington. The motion carried. BILL NO. 34 -92 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT THE SOUTHWEST CORNER RALPH JONES DR. AND WILLIAM RICHARDSON DR. AND AT THE EAST END OF WILLIAM RICHARDSON DR. IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Slavinskas reported that the Zoning and Vacation Committee had met on this bill and recommended it to the Council favorable. John Byorni, Area Plan, made the presentation for the bill. He indicated Area Plan initiated this rezoning to establish "D" Light Industrial, "A" Height and Area zoning on six lots within the Toll Road Industrial Park. He indicated these lots have recently been annexed into the City, and are surrounded by "D" Light Industrial and "M" Manufacturing zoning. Council Member Coleman made a motion to recommend this bill to the Council favorable, seconded by Council Member Luecke. The motion carried. BILL NO. 36 -92 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 721, 723, 725 HOWARD STREET, IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Slavinskas reported that the Zoning and Vacation Committee had met on this bill and recommended it to the Council favorable. John Byorni, Area Plan, gave the staff report, which was favorable. He indicated that granting this petition will result in further intrusion into this single - family neighborhood, the uniqueness of the structure gives cause for treatment different from similar sites in the neighborhood. He indicated that this zoning together with the bookstore site should not be a catalyst for future zoning in this neighborhood. James Masters, attorney, made the presentation for the bill. He indicated the University of Notre Dame plans to purchase this building the building and establish a legal aid clinic at this location. James Lyphout, associate vice president for business affairs at Notre Dame, indicated the clinic would be using a building which had been underutilized for years, as well as provide a needed service to the neighborhood. Barbara Gasperetti, co- director of the clinic, indicated they had outgrown their space on campus, and the purchase of this building would allow them to triple the size of the clinic to serve more people. Ann Bockencamp, 803 Notre Dame Ave., Director of Neighborhood Housing Services, indicated they supported this rezoning. Joseph Doran, 1119 N. Frances and Arthur Quigley, 1019 N. Frances, spoke in favor of this zoning. Council Member Luecke made a motion to recommend this bill to the Council favorable, seconded by Council Member Slavinskas. The motion carried. BILL NO. 43 -92 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST EAST -WEST ALLEY NORTH OF E. ECKMAN STREET FROM THE EAST RIGHT -OF -WAY LINE OF S. DALE STREET TO THE EAST RIGHT -OF -WAY LINE 273 OF THE FIRST NORTH -SOUTH ALLEY EAST OF S. DALE STREET FOR A DISTANCE OF APPROXIMATELY 268 FEET AND A WIDTH OF 14 FEET. PART LOCATED IN LINDBERGH PARK ADDITION IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Slavinskas reported that the Zoning and Vacation Committee had met on this bill and had no recommendation. Dar Dobbins, 1017 E. Eckman, made the presentation for the bill. He indicated this alley had not been used for through traffic for 25 years. He indicated that a new neighbor wanted this alley open. He indicated they felt that for crime and safety reasons this alley should be kept closed. Candy Howell, 921 E. Eckman, presented a petition with 16 signatures to keep the alley as it is now. Ted Hengesbach, 2709 Miami, spoke in favor of the vacation. Richard Cook, attorney, spoke against this petition. He presented a petition in support of objection to vacating alley, signed by Kenneth & Sheila Klockow. Lauren Kessler 1006 Irvington, spoke against vacating this alley, since she has a garage located on the alley. Council Member Washington made a motion to continue this bill indefinitely, seconded by Council Member Slavinskas. The motion carried. BILL NO. 49 -92 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST EAST /WEST ALLEY NORTH OF EAST COLFAX AVENUE (U.S. 20) FROM THE WEST RIGHT -OF -WAY LINE OF NORTH FRANCES STREET TO THE EAST RIGHT -OF -WAY LINE OF EDMOND COURT FOR A DISTANCE OF APPROXIMATELY 165 FEET AND A WIDTH OF APPROXIMATELY 10 FEET. PART SITUATED IN COTTRELL'S FIRST ADDITION IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Slavinskas reported that the Zoning and Vacation Committee had met on this bill and recommended it to the Council favorable. Council Member Luecke made a motion to accept the substitute bill on file with the City Clerk, seconded by Council Member Coleman. The motion carried. Council Member Ladewski stated he was an employee of the South Bend Clinic and he would abstain from voting on this bill. Rick Morgan, attorney, made the presentation for the bill. He indicated the South Bend Clinic was asking for this vacation in order to expand their parking lot. Council Member Coleman made a motion to recommend this bill to the Council favorable, as amended, seconded by Council Member Duda. The motion carried. BILL NO. 42 -92 A BILL TRANSFERRING $33,500 WITHIN ACCOUNTS WITHIN THE DEPARTMENT OF ECONOMIC DEVELOPMENT. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Slavinskas reported that the Human Resources Committee had met on this bill and recommended it to the Council favorable. Beth Leonard, director of Financial and Program Management, made the presentation for the bill. She indicated this bill would transfer monies into Northeast Neighborhood Planning; Workforce Development Services; Manufacturing Technology Center; and MACOG. Council Member Coleman made a motion to recommend this bill to the Council favorable, seconded by Council Member Ladewski. The motion carried. BILL NO. 44 -92 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 21 OF THE SOUTH BEND MUNICIPAL CODE ENTITLED "ZONING ". II This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Slavinskas reported that the Zoning and Vacation Committee had met on this bill and recommended it to the Council favorable. John Byorni, Area Plan, made the presentation for the bill. He indicated that Area Plan had initiated this petition to amend the "A -3" Mixed Use Zoning to better identify permitted retail business uses. He indicated that at the present time clubs are not included as permitted uses, but other similar uses are allowed, and this bill would allow clubs within A -3 zoning. Council Member Slavinskas made a motion to recommend this bill to the Council favorable, seconded by Council Member Zakrzewski. The motion carried. BILL NO. 45 -92 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND AMENDING CHAPTER 2 OF THE SOUTH BEND MUNICIPAL CODE. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Slavinskas reported that the Human Resources Committee had met on this bill and recommended it to the Council favorable, as amended. He made a motion to accepted the amended bill on file with the City Clerk, seconded by Council Member Washington. The motion carried. Aladean DeRose, attorney for Human Rights, made the presentation for the bill. She indicated new legislation prohibiting housing discrimination based on the Fair Housing Act has been enacted. She indicated the present ordinance prohibits handicapped discrimination in housing, but does not include familial status based discrimination or the full range of prohibited acts of discrimination in housing. She indicated this bill would define terms adopted by Federal and State law, as well as define the prohibited acts of discrimination, seeks to enlarge compensatory damages in employment discrimination cases. Council Member Coleman made a motion to recommend this bill to the Council favorable, seconded by Council Member Ladewski. RESOLUTIONS 92 -51 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND, INDIANA, COMMONLY KNOWN AS 311 EAST COLFAX, SOUTH BEND, INDIANA, AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF A TEN YEAR REAL PROPERTY TAX ABATEMENT FOR BRETT PLAZA ONE. Council Member Coleman made a motion to continue public hearing on this bill until July 23, seconded by Council Member Zakrzewski. The motion carried. RESOLUTION NO. 1960 -92 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH �?75 �GI]LAR__MEE�IPdG JLILS� -].3, 1992 BEND, INDIANA, RATIFYING THE SISTER CITY AGREEMENT BETWEEN SOUTH BEND AND CZESTOCHOWA, POLAND. WHEREAS, the Common Council acknowledges that "Sister Cities International" was - initiated by the White House in 1956 when the President called for "massive exchanges between Americans and the Peoples of other lands; and WHEREAS, on May 30, 1992, the City of South Bend, Indiana and the City of Czestochowa, Poland, signed the "Sister City Agreement" pledging to establish ties of friendship and cooperation which will in turn strengthen the traditional bonds between Americans and Polish Nations; and WHEREAS, the Common Council is indeed proud to be a part of the formal ratification process which will formalize the rich ethnic ties between these two great cities. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: SECTION I. On behalf of all of the citizens of the City of South Bend, Indiana, the Common Council hereby officially ratifies the Sister City Agreement signed on the 30th day of May 1992 in Czestochowa, Poland, with copies of the Agreement in both Polish and English being attached hereto. SECTION II. The Common Council pledges its support to undertake in developing understanding, trust and friendship between the residents of Czestochowa and South Bend. SECTION III. The Council further pledges to work with the City Administration so that meaningful programs which will benefit both Czestochowa and South Bend can be established to enhance educational and cultural opportunities, tourism, and benefit the public health, safety and welfare of the citizens of these two great cities. SECTION IV. The Common Council pledges its heartfelt support of this important agreement linking rich ethnic cultures together, and proudly says "BOG ZAPLAC"! SECTION V. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approved by the Mayor. Kernan, Mayor A public hearing was held on the resolution at this time. Council Member Ladewski made the presentation for the resolution. He indicated that he was a member of a delegation that visited Czestochowa, Poland in May. Other members of the delegation were: Jack Reed, administrative assistant to the Mayor; Mikki Dobski Shidler, Community Affairs Director; David Stefancic, professor of Russian Polish and European history at St. Mary's College; and Mary Ferlic, educator; Council Member Ladewski headed the delegation. He explained that with our City's Polish heritage the proposed sister -city relationship should provide a wealth of cultural and exchange opportunities. He indicated that the province of Czestochowa, is one of Poland's largest industrial areas, with a population of 260,000. Council Member Ladewski introduced the rest of the delegation. Due to bad storms everyone was evacuated to the basement for approximately 15 minutes. After we returned to the Chambers the other members of the delegation spoke regarding this trip. Council Member Coleman made a motion to adopt this resolution, seconded by Council Member Zakrzewski. The resolution was adopted by a roll call vote of eight ayes. BILLS. Tim Hartzer, president of the Hotel -Motel Tax Board, made the presentation for the bill. He indicated bonds, in the amount of 3.3 million, will be issued in order to finance certain improvements to Century Center and the Studebaker National Museum. He indicated the bond issue has been approved by the Hotel -Motel Tax Board, the County Commissioners, and the Civic Center Board of Manager, however, the final approval needed was that of the Common Council. Council Member Slavinskas made a motion to pass this bill, seconded by Council Member Puzzello. The bill passed by a roll call vote of eight ayes.
