ROLL CALL Present: Council Members Luecke, Niezgodski, Soderberg, Puzzello, Slavinskas, Zakrzewski, Duda, Coleman and Ladewski Absent: None REPORT FROM THE SUB- COMMITTEE ON MINUTES To the Common Council of the City of South Bend: The sub- committee has inspected the minutes of the November 12, 1991 meetings of the Council and found them correct. Therefore, we recommend the same be approved. /s/ Tom Zakrzewski /s /Don Niezgodski Council Member Zakrzewski made a motion that the minutes of the November 12, 1991 meetings of the Council be accepted and placed on file, seconded by Council Member Duda. The motion carried. SPECIAL BUSINESS Council President Niezgodski announced that the Council has two appointments to the Redevelopment Commission, which will be made on December 9. He asked that if there was any one interested in an appointment to send a letter to the Council. RESOLUTION NO. 1899 -91 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, COMMENDING THE SOUTH BEND CLINIC AND SURGICENTER ON ITS 75TH ANNIVERSARY WHEREAS, the Common Council notes that in 1916, Dr. Walter Baker, Dr. Edwin Lent, Dr. Charles Terry, Dr. Robert Shanklin, Dr. Charles E. Hansen, Dr. Hugh Miller, and Dr. Fred R. Clap founded the South Bend Clinic; and WHEREAS, these seven doctors established a unique style of medical care by bringing together medical specialists to practice together as a group; and WHEREAS, the South Bend Clinic is the oldest group practice of physicians in Indiana, and was the first free standing ambulatory surgery center in Northern Indiana; and WHEREAS, many medical advances have taken place at the clinic including the first use of penicillin in this community by Dr. Frank Scott, and polio vaccine field trials by Dr. G. Walter Erickson. WHEREAS, today the South Bend Clinic and SurgiCenter has grown to 35 physicians and 211 staff members who are all dedicated to providing dedicated and quality medical care to the citizens of our community. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend, Indiana, on behalf of all of its residents hereby publicly commends and salutes the louth Bend Clinic and SurgiCenter on its 75th Anniversary of providing quality medical care to our community. SECTION II. The South Bend Clinic and SurgiCenter is an excellent example of a caring group of individuals who are meeting the many needs of our residents, by providing after hour services, x -rays, lab and other testing services on site; as well as having over 75% of its physicians teaching at area hospitals. SECTION III. This resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. Kernan, Mayor A public hearing was held on the resolution at this time. Council Member Ladewski read the resolution. Dr. Strzelecki, President of the Board of Trustees, spoke regarding the Clinic, and thanked the Council for the resolution. Council Member Duda made a motion to adopt the resolution, seconded by Council Member Coleman. The resolution was adopted by a roll call vote of nine ayes. Council Member Zakrzewski made a motion to resolve into the Committee of the Whole, seconded by Council Member Coleman. The motion carried COMMITTEE OF THE WHOLE Be it remembered that the Common Counc Committee of the Whole on November 25, present. Chairman Duda presiding. BILL NO. 58 -91 A BILL AMENDING THE SOUTHEAST CORNER OF CITY OF SOUTH BEND, it of the City of South Bend met in the 1991 at 7:18 p.m., with nine members ZONING ORDINANCE FOR PROPERTY LOCATED AT THE HOWARD STREET AND ST. PETER STREET IN THE INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Slavinskas reported that the Zoning and Vacation Committee had met on this bill and had no recommendation for the Council. John Byorni, Area Plan, gave the staff report, which was unfavorable. Tim: Hartzer, attorney, made the presentation for the bill. He indicated this was a mixed neighborhood, and would benefit from new development, such as this bookstore. He indicated this was not spot zoning in the traditional sense, since there is a bookstore at this location. He indicted this new structure will improve the appearance of the site. Richard Nussbaum, City Attorney, spoke in favor of this rezoning. He indicated the City had issued a building permit for a library at the corner of Howard and Notre Dame, which was later withdrawn. He indicated the Board of Zoning appeals hade made a finding that a there could be a library in "A" residential as long as it was operated by a not for profit corporation. He indicated the owners of Pandora's planned to form such a corporation, so this zoning was a compromise. Thomas Gideon, 920 N. Notre Dame; Arthur Quigley, 1019 N. Frances; Jane Gurthet, 907 N. Notre Dame; Marguerite Taylor, 714 E. Corby; Ellen Martin, 1007 Howard; spoke against this zoning. Arlene Quigley, 1019 N. Francis, presented a petition with 303 signatures. Council Member Soderberg made a motion to recommend this to the Council unfavorable, seconded by Council Member Slavinskas. The motion failed on a roll call vote of four ayes (Council Members Soderberg, Slavinskas, Zakrzewski and Ladewski) and five nays. Council Member Puzzello made a motion to amend the bill as follows; after the word Area add " and subject to a final site development plan and appropriate variance(s) and exceptions regarding parking requirements from the Board of Zoning Appeals ", seconded by Council Member Luecke. The motion carried. Council Member Niezgodski made a motion to recommend this bill to the Council favorable, as amended, seconded by Council Member Puzzello. The motion carried on a roll call vote of five ayes and four nays (Council Members Soderberg, Slavinskas, Zakrzewski and Ladewski.) Council Member Soderberg made a motion to recess, seconded by Council Member Slavinskas. The motion carried and the meeting was recessed at 9:01 p.m., and reconvened at 9:10 p.m. LL NO. 62 -91 A BILL AMENDING THE ZONING ORDINANCE AND ESTABLISHING A HISTORIC LANDMARK FOR PROPERTY LOCATED AT 302- S. MAIN STREET IN THE CITY OF SOUTH BEND, INDIANA. Council Member Slavinskas reported that the Zoning and Vacation Committee had met on this bill and recommended it unfavorable to the Council. Council Member Luecke made a motion to continue public hearing on the bill until the second meeting in February, seconded by Council Member Zakrzewski. The motion carried. BILL NO. 67 -91 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, VACATING THE FIRST NORTH -SOUTH ALLEY EAST OF MAIN STREET, RUNNING NORTH FROM COLFAX AVENUE FOR A DISTANCE OF APPROXIMATELY ONE HUNDRED NINETY -EIGHT FEET (198') TO THE SOUTHERN BOUNDARY OF THE FIRST EAST -WEST ALLEY SOUTH OF LASALLE STREET BETWEEN MICHIGAN AND MAIN STREETS, ALL IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Jenny Manier, Assistant City Attorney, made the presentation for the bill. She indicated this vacation was necessary in order for the South Bend Tribune to build their addition on the site of the former Colfax Theatre. Council Member Slavinskas made a motion to accept the substitute bill on file with the City Clerk, seconded by Council Member Luecke. The motion carried. David Ray, a representative of the South Bend Tribune, spoke in favor of this vacation. Council Member Luecke made a motion to recommend this bill to the Council favorable, seconded by Council Member Slavinskas. The motion carried. BILL NO. 73 -91 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE 1ST EAST -WEST ALLEY NORTH OF CEDAR STREET, RUNNING EAST FROM ST. PETER STREET, FOR A DISTANCE OF APPROXIMATELY 345 FEET TO NOTRE DAME AVENUE, ALL IN CHAPOTON PLACE SUBDIVISION OF COTTRELL'S ADDITION TO LOWELL, AND ST. PETER STREET, FROM MINER STREET RUNNING, SOUTH TO CEDAR STREET, FOR A DISTANCE OF APPROXIMATELY 322 FEET. This being the time heretofore set for public hearing on the above bills, proponents and opponents were given an opportunity to be heard. John Ford, attorney for the petitioner St. Joseph Medical Center, made the presentation for the bill. He indicated this vacation was necessary in order to build a new medical pavilion. Council Member Niezgodski made a motion to recommend this bill to the Council favorable, seconded by Council Member Zakrzewski. The motion carried. BILL NO. 9 -91 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 4, ARTICLE 4, SECTION 4 -60 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND COMMONLY KNOWN AS "TRANSIENT MERCHANTS ". This being the time heretofore set for public hearing on the above bills, proponents and opponents were given an opportunity to be heard. Council Member Slavinskas made the presentation for the bill. He indicated this bill would amend the code for transient merchants selling Christmas trees during the months of November and December. Council Member Zakrzewski made a motion to amend the bill by changing Section 4 to read as follows: Thirty dollars ($30.00) for proposed business operations during the months of November and /or December, which only sell live and /or natural Christmas trees and /or live and /or natural wreaths., seconded by Council Member Coleman. The motion carried Council Member Luecke made a motion to recommend this bill to the Council favorable, as amended, seconded by Council Member Coleman. The motion carried. BILL NO. 21 -91 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 6 OF THE MUNICIPAL CODE BY THE INCLUSION OF NEW ARTICLE 11 ENTITLED BUILDING CONTRACTOR LICENSING REQUIREMENTS. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Duda made the presentation for the bill. Council Member Luecke made a motion to accept the substitute bill and amend it in Section III by changing the implementation date to July 1, 1992, seconded by Council Member Zakrzewski. The motion carried. Council Member Duda indicated this bill would require written proof of Workers' Comp coverage, and establish a non - reverting fund to help defray the cost of the program. Mark Donaho, 23555 Brick Rd, president of the St. Joseph Trades Council, spoke in favor of the bill. Robert Urbanski, 3343 Hedge Maple, member of the task force, asked for support of this bill; Don Blemis, 63529 Poppy Rd.; Craig Fry, 637 Bayview, Richard Nussbaum, City Attorney, spoke in favor of the bill. Council Member Luecke made a motion to recommend this bill to the Council favorable, seconded by Council Member Zakrzewski. The motion carried. Council Member Puzzello made a motion to combine public hearing on the next two bills, seconded by Council Member Niezgodski. The motion carried. BILL NO. 74 -91 A BILL TRANSFERRING MONIES FROM VARIOUS ACCOUNTS TO VARIOUS ACCOUNTS WITHIN THE VARIOUS FUNDS OF THE CITY OF SOUTH BEND, INDIANA FOR THE YEAR 1991. BILL NO. 75 -91 A BILL INCREASING APPROPRIATIONS AND DECREASING APPROPRIATIONS WITHIN THE VARIOUS DEPARTMENTS WITHIN THE VARIOUS FUNDS OF THE CITY OF SOUTH BEND, INDIANA, FOR THE YEAR 1991. ._ This being the time heretofore set for public hearing the on above bills, proponents and opponents were given an opportunity to be heard. Council Member Puzzello reported that the Personnel and Finance Committee had met on these bills and recommended them to the Council favorable, as amended. Council Member Puzzello made a motion to accept the substitute bills on file with the City Clerk, seconded by Council Member Niezgodski. The motion carried. Jeff Renard, City Auditor, made the presentation for the bills. He indicted that these bills were the annual transfer and appropriation bills passed by the Council each year. Council Member Luecke made a motion to recommend Bill No. 74 -91 to the Council favorable, as amended, seconded by Council Member Coleman. The motion carried. Council Member Luecke made a motion recommend Bill No. 75 -91 to the Council favorable, as amended, seconded by Council Member Puzzello. The motion carried. BILL NO. 76 -91 A BILL APPROPRIATING MONIES FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF THE DESIGNATED ENTERPRISE FUNDS OF THE CITY OF SOUTH BEND, INDIANA, FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1992, AND ENDING DECEMBER 31, 1992, INCLUDING ALL OUTSTANDING CLAIMS AND OBLIGATIONS, AND FIXING A TIME WHEN THE SAME SHALL TAKE EFFECT. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Puzzello reported that the Personnel & Finance Committee and the Utilities Committee had met on this bill and recommended it to the Council favorable. Jeff Rinard, City 26 . . Auditor, made the presentation for the bill. He indicated this bill represents the 1992 budgets for the Enterprise Funds, Solid Waste, Water Works, Wastewater, Sanitation, and the Parking Garage Funds. He indicted the bill should be amended - Solid Waste, reduce Seasonal & Interns by $20,000; FICA by $1,607; Water Works reduce Wells & Springs by $188,000 to $78,000. Council Member Puzzello made a motion to accept the amendments, seconded by Council Member Zakrzewski. The motion carried. Council Member Niezgodski made a motion to recommend this bill to the Council favorable, as amended, seconded by Council Member Luecke. The motion carried. Council Member Luecke made a motion to combine public hearing on the next two bills, seconded by Council Member Zakrzewski. The motion carried. BILL NO. 77 -91 A BILL APPROPRIATING $2,855,000 FROM THE COMMUNITY DEVELOPMENT BLOCK GRANT FUND FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF THE DEPARTMENT OF ECONOMIC DEVELOPMENT OF THE CITY OF SOUTH BEND, INDIANA, AND DESIGNATED SUBGRANTEE AGENCIES FOR THE PROGRAM YEAR BEGINNING JANUARY 1, 1992, TO BE ADMINISTERED THROUGH THE DEPARTMENT OF ECONOMIC DEVELOPMENT. BILL NO. 78 -91 A BILL APPROPRIATING $450,000.00 OF SECTION 108 FUNDS, PLUS INTEREST EARNED THEREON, FOR USE IN WEST WASHINGTON - CHAPIN DEVELOPMENT AREA. This being the time heretofore set for public hearing on the above bills, proponents and opponents were given an opportunity to be heard. Council Member Luecke reported that the Human Resources Committee had met on these bills and recommended them to the Council favorable. Beth Leonard, Economic Development, made the presentation for the bills. She indicted Bill No. 77 -91 would appropriate the 1992 Community Development Block Grant entitlement and program income in accordance with the application. She indicated that Bill No. 78 -91 would be used for housing rehabilitation, acquisition, relocation and demolition in the West Washington- Chapin Development Area. Council Member Luecke made a motion to recommend Bill No. 77 -91 to the Council favorable, seconded by Council Member Coleman. The motion carried. Council Member Luecke made a motion to recommend Bill No. 78 -91 to the Council favorable, seconded by Council Member Coleman. The motion carried. There being no further business to come before the Committee of the Whole, Council Member Luecke made a motion to rise and report to the Council, seconded by Council Member Zakrzewski. ORDINANCE NO. 8233 -91 AN ORDINANCE APPROPRIATING $450,000.00 OF SECTION 108 FUNDS, PLUS INTEREST EARNED THEREON, FOR USE IN WEST WASHINGTON - CHAPIN DEVELOPMENT AREA. This bill had third reading. Council Member Luecke made a motion to pass this bill, seconded by Council Member Duda. The bill passed by a roll call vote of nine ayes. RESOLUTIONS RESOLUTION NO. 1900-91 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, ENTERING INTO AN INTERLOCAL AGREEMENT CONCERNING THE PURCHASE OF SOFTWARE WHEREAS, the Police Department of the City of South Bend has purchased a NCR 900 X68 u I DIN N I System Cad Computer System and one function of that system over the years has been to keep records concerning alleged criminal activities throughout the City of South Bend; and WHEREAS, the South Bend Housing Authority would benefit from the use of non - confidential information stored on said computer system relating to crime activities throughout various areas of the City, including areas where the Housing Authority either owns a building or provides assistance for residents; and WHEREAS, the Computer Mapping System which, when used in connection with the computer information. would provide visual information concerning alleged criminal activities and would benefit both the South Bend Police Department and the Housing Authority of the City of South Bend. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The City shall enter into the Interlocal Agreement with the Housing Authority of the City of South Bend for the purchase of a Computer Mapping System for use on its NCR 900 System Cad Computer System. SECTION II. The terms and conditions of said Agreement are as attached hereto. SECTION III. This resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. /s/ Donald Niezgodski Member of the Common Council A public hearing was held on the resolution at this time. Service Division Chief, Joel Wolvos, made the presentation for the resolution. He indicated this computer system will be jointly used by the South Bend Police Department and the Housing Authority as a mapping system providing alleged criminal activities in the City. AND FOREST AVE.; EXCLUDING THE PORTIONS OF THE NORTH -SOUTH ALLEY BETWEEN FOREST AVE. AND LELAND AVE., WHICH INTERSECTS THE ALLEYS TO BE VACATED FOR A TOTAL DISTANCE OF APPROXIMATELY 960 FEET, AND A WIDTH OF APPROXIMATELY 12 FEET. This bill had first reading. Council Member Luecke made a motion to continue first reading on this bill until December 9, seconded by Council Member Duda. The motion carried. This bill had first reading. Council Member Puzzello made a motion to refer this bill to the Committee of the Whole and set it for public hearing and third reading on January 13, 1992, seconded by Council Member Luecke.
