HomeMy WebLinkAbout09-09-91 Council Meeting Minutesc)6 REGULAR MEETING SEPTEMBER 9, 1991 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Monday, September 9, 1991, at 7:00 p.m. The meeting was called to order and the Pledge to the Flag was given. ROLL CALL Present: Council Members Luecke, Niezgodski, Soderberg, Puzzello, Slavinskas, Zakrzewski, Duda, Coleman and Ladewski Absent: None REPORT FROM THE SUB- COMMITTEE ON MINUTES To the Common Council of the City of South Bend: The sub - committee has inspected the minutes of the August 26, 1991 meeting of the Council and found them correct. Therefore, we recommend the same be approved. /s/ Tom Zakrzewski /s /Don Niezgodski Council Member Coleman made a motion that the minutes of the August 26, 1991 meetings of the Council be accepted and placed on file, seconded by Council Member Duda. The motion carried. SPECIAL BUSINESS Council Member Zakrzewski made a motion to hold a meeting September 16, at 7:00 p.m., in the Council Chambers for the purpose of having public hearing on the budget, seconded by Council Member Ladewski. The motion carried. Council Member Coleman made a motion to resolve into the Committee of the Whole, seconded by Council Member Zakrzewski. The motion carried COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on September 9, 1991 at 7:05 p.m., with nine members present. Chairman Duda presiding. BILL NO. 44 -91 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, ANNEXING TO THE CITY OF SOUTH BEND CERTAIN TERRITORY CONTIGUOUS THEREWITH. Council Member Zakrzewski made a motion to continue this bill until September 23, seconded by Council Member Coleman. The motion carried. BILL NO. 50 -91 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: CEDAR STREET BETWEEN ST. PETER STREET AND NOTRE DAME AVENUE IN SOUTH BEND, INDIANA. Council Member Niezgodski made a motion to continue this bill indefinitely, seconded by Council Member Coleman. The motion carried. BILL NO. 43 -91 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 21, ARTICLE 10, "SIGN REGULATIONS ". This being the time heretofore set for public hearing on the above bill proponents and opponents were given an opportunity to be heard. Council Member Slavinskas reported the Zoning and Vacation Committee had met on this bill and recommended it to the Council favorable. Council Member Coleman made a motion to accept the substitute bill on file with the City Clerk, seconded by Council Member Luecke. The motion carried. John Byorni, Senior Planner - Area Plan, gave the staff report, which was favorable. Council Member Luecke made a motion to amend the substitute bill in Section I, (k) by removing no. 3, and in Section 3, paragraph C by adding "to the owner of sign(s) or his or her authorized agent who erected such sign(s) found in violation of this article. A citation may be issued for each such sign found to be in violation. Such violation shall be considered an ordinary violation with a fine of twenty -five dollars ($25.00) for the first offense, and fifty dollars ($50.00) for all subsequent offenses within the same calendar year. ", also correct a error in Section II by changing k to i, seconded by Council Member Coleman. The motion carried. Kathleen Cekanski - Farrand, Council attorney, indicated that these minor changes did not warrant the bill being sent back to Area Plan. Council Member Slavinskas made the presentation for the bill. He indicated this bill would restrict the size of political signs, limit the amount of time they can be displayed and establish fines for violation of the ordinance. He indicated this bill would restrict signs to a maximum of four square feet in size; a maximum of 3 three in height and four feet in width. Council Member Coleman made a motion to recommend this bill to the Council favorable, seconded by Council Member Zakrzewski. The motion carried. Syr �c.1! BILL NO. 56 -91 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA,APPROPRIATING $25,000.00 FROM THE NEXT DOOR NEIGHBOR PROGRAM FUND. Council Member Coleman made a motion to continue this bill until September 23, seconded by Council Member Luecke. The motion carried. BILL NO. 57 -91 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING VARIOUS SECTION OF CHAPTER 2, ARTICLE 7, OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, COMMONLY KNOWN AS BUDGETARY PROCEDURES. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Puzzello reported that the Personnel and Finance Committee had met on this bill and recommended it to the Council favorable. Katie Humphreys, City Controller, indicated the bill should be amended in by changing the word manning to staffing in two places in Section I, Article &, "d ". Council Member Puzzello made a motion to amend the bill, seconded by Council Member Luecke. The motion carried. Ms. Humphreys indicated they administration was proposing several changes in the budget reporting as a result of the new computer system, in order to improve budget information that is reviewed and approved by the Council. She indicated they were proposing that actual expenditure information for the prior two years be provided. She said they will provide quarterly reports to the Mayor and the Council on the City finances. Council Member Luecke made a motion to recommend this bill to the Council favorable, as amended, seconded by Council Member Coleman. The motion carried. There being no further business to come Member Soderberg made a motion to rise Council Member Zakrzewski. BILLS, THIRD READING ORDINANCE NO. 8211 -91 reconvened in the 7:30 p.m. AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 21, ARTICLE 10, "SIGN REGULATIONS ". This bill had third reading. Council Member Coleman made a motion to amend this bill, as amended in the Committee of the Whole, seconded by Council Member Zakrzewski. The motion carried. Council Member Coleman made a motion to pass this bill, as amended, seconded by Council member Luecke. The motion carried. ORDINANCE NO. 8212 -91 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING VARIOUS SECTION OF CHAPTER 2, ARTICLE 7, OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, COMMONLY KNOWN AS BUDGETARY PROCEDURES. This bill had third reading. Council Member Coleman made a motion to amend this bill, as amended in the Committee of the Whole, seconded by Council Member Luecke. The motion carried. BILLS, FIRST READING BILL NO. 58 -91 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER OF HOWARD STREET AND ST. PETER STREET IN THE CITY OF SOUTH BEND, INDIANA. Council Member Slavinskas made a motion to refer this bill to Area Plan, seconded by Council Member Puzzello. The motion carried. BILL NO. 59 -91 A BILL AMENDING ORDINANCE NO. 7998 -89 FIXING MAXIMUM SALARIES AND WAGES OF APPOINTED OFFICERS AND NON - BARGAINING EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA FOR THE CALENDAR YEARS OF 1990, 1991, AND 1992. This bill had first reading. Council Member Coleman made a motion to refer this bill to the Personnel and Finance Committee and set if for public hearing and second reading September 23, seconded by Council Member Duda. The motion carried. 0638 BILL NO. 60 -91 A BILL APPROPRIATING MONIES FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF SEVERAL DEPARTMENTS OF THE CIVIL CITY OF SOUTH BEND,INDIANA FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1992, AND ENDING DECEMBER 31, 1992, INCLUDING ALL OUTSTANDING CLAIMS AND OBLIGATIONS, AND FIXING A TIME WHEN THE SAME SHALL TAKE EFFECT. This bill had first reading. Council Member Puzzello made a motion to refer this bill to the Personnel and Finance Committee and set it for public hearing September 16, and third reading September 23, 1991, seconded by Council Member Zakrzewski. The motion carried. BILL NO. 61 -91 A BILL LEVYING TAXES AND FIXING THE RATE OF TAXATION FOR THE PURPOSE OF RAISING REVENUE TO MEET THE NECESSARY EXPENSES OF THE , CIVIL CITY OF SOUTH BEND FOR THE FISCAL YEAR ENDING DECEMBER 31, 1992. This bill had first reading. Council Member Puzzello made a motion to refer this bill to the Personnel and Finance Committee and set it for public hearing September 16, and third reading September 23, 1991, seconded by Council Member Coleman. The motion carried. UNFINISHED BUSINESS Council Member Soderberg asked that Bill No. 73 -89 regarding recycling be put on the agenda for September 23. There being no further business to come before the Council unfinished or new, Council Member Coleman made a motion to adjourn, seconded by Council Member Soderberg.
