BROWN ST.JOSEPH COUNTY RECORDER PGS: 5 FEES. 25.00 Cross Reference(s): Instrument No. 2024-11404 (Crowe Chizek Second Minor Subdivision) RELEASE OF EASEMENT WHEREAS, On or about May 24, 2024, HP Blackbird, LLC ("Blackbird") recorded the Crowe Chizek Second Minor Subdivision as Instrument Number 2024-11404 in the Office of the Recorder of St. Joseph County, Indiana (the "Second Minor Subdivision"); WHEREAS, pursuant to the Second Minor Subdivision, Blackbird granted to the City of South Bend, acting through its Board of Public Works, an Ingress/Egress Easement on Lot 1 and 2 of the Second Minor Subdivision ("Ingress/Egress Easement"); WHEREAS, the City of South Bend, acting through its Board of Public Works reaffirmed that it is the benefited party pursuant to the grant of the Ingress/Egress Easement by way of Resolution No. 9-2025 adopted on February 11, 2025; and WHEREAS, the portion of the Ingress/Egress Easement as depicted and described in Exhibit A, attached hereto and incorporated (the "Ingress/Egress Easement Release Area") is no longer necessary and the City of South Bend, acting through its Board of Public Works desires to release and terminate any and all rights in and to the Ingress/Egress Easement Release Area. NOW, THEREFORE, the City of South Bend hereby releases and terminates any and all interest or retained easement rights in and to the Ingress/Egress Easement Release Area granted pursuant to Instrument Number 2024-11404 in the St. Joseph County Recorder's Office, and all of the rights thereunder with the intent that this certain Ingress/Egress Easement Release Area may be forever extinguished.
