SUBJECT:Rescind Emergency Contract – Demolition of 1701 Anderson Avenue
Ratify Emergency Contract
DATE:03/03/2025
At the February 25, 2025, meeting of the Board of Public Works, an emergency contract with
Jackson Demolition was approved for demolition of an unsafe building at 1701 Anderson
Avenue.
Upon notification of the ratification of the contract, Jackson Demolition alerted the City they
would not be performing the work. They noted an error in their emergency quote, omitting two
(2) separate allowances of $5,000 each. They claim their quote should have been $42,000. A
copy of the original quote request is attached, showing the requirement of the two allowances
for utility shutoffs and asbestos remediation.
Neighborhood Services & Enforcement originally solicited emergency demolition quotes from
the following contractors:
x Jackson Demolition: $32,000
x Ritschard Bros.: $33,620
x Green Demolition: No Quote
x Indiana Earth: No Quote
Ritschard Bros. has agreed to honor their price and move forward with this emergency work.
I recommend the Board rescind its emergency contract with Jackson Demolition. They will no
longer be solicited for emergency demolition work.
I recommend ratification of an emergency contract for Demolition of 1701 Anderson Avenue
to Ritschard Bros., in the amount of $33,620. Funding is available through DCI’s Neighborhood
fund.

PUBLIC WORKS CONTRACT
This Agreement is made and entered into this 11th Day of March 2025, by and between Ritschard
Bros., Inc., (the “Contractor”), and the Board of Public Works (the "Board”).
The Contractor covenants and agrees to make the following improvement, as fully set out in the
Request for Quotations, Standard Specifications, Special Provisions, Plans, and Bid Proposals, all
of which are set forth as a part of this Contract, for:

The unit prices for this improvement were those prices as received and accepted by the Board on
the 11th Day of March 2025.
The Contractor further agrees to notify the assigned Engineer when this improvement is
completed. This notification shall be in the form of a Project Completion Affidavit, signed by the
Contractor. Upon final acceptance of the improvement by the Engineer, the Contractor’s final
estimate will be presented to the Board for final Payment with one (1) copy of the Project
Completion Affidavit and one (1) copy of a Waiver of Lien.
Each of the Parties, by signing below, represents and warrants to the other Party that he/she/it has
the authority to bind the named person or entity to this Agreement.

RE: Request for Quote for an Emergency Demolition
The Director of Neighborhood Services & Enforcement (the “Department”) has determined that the structure 1701
ANDERSON AVE, SOUTH BEND, IN 46628, State Parcel ID number: 71-03-35-352-012.000-026, is unsafe and hereby
orders an emergency demolition on this property. This order is issued under the Indiana Unsafe Building Law IC 36-7-9-9.
You are requested to provide us with a quote for the demolition of the following structure(s) listed:
•HOUSE and FENCE
The work is to include:
1.Upon awarding of project, the immediate erection of a portable 6ft chain link fence around perimeter of
property must be completed within 48 hours.
a.Fencing should completely block all sidewalks
2.Securing licensed asbestos inspector to monitor demolition throughout;
3.Please include a $5,000 asbestos disposal allowance.
4.Please include a $5,000 allowance to assist with the demolition of water taps. This allowance should cover
roadway cuts, excavation, roadway patch and traffic control.
5.Removal of driveway and service walks;
6.All crawlspace or basement slabs must be removed entirely;
7.Foundation walls must be removed entirely;
8.Clean fill is to be used for backfilling; and
9.Four (4) inches of topsoil and approved seed is to be the final grade
10.Adequately wetting demolition site
The contractor is responsible for following applicable environmental laws/regulations, maintaining a clean, safe site,
obtaining all required permits, completing inspections, having insurance, and properly disposing of demolition remains.
The contractor must adequately wet the demolition site during demolition and when demolition debris is disturbed. The
Department reserves the right to request proof of permits and insurance.

The Department has ordered the disconnections of utilities to this property. The Department will be soliciting a
minimum of three (3) quotes from city-approved contractors and the lowest quote will be awarded the project.
