Clerk Tirado stated that the Sub -Committee on Minutes inspected the February 10, 2025 Common Council meeting minutes and recommend they be approved. White — Aye SPECIAL BUSINESS 1 REGULAR MEETING February 24, 2025 None. REPORTS FROM CITY OFFICES Charles King III, Director of the Citizen Police Review Board (CPRB), 202 South Michigan Street, South Bend, IN 46601, provided an overview of the CPRB's 2024 Annual Report. The CPRB implemented an online portal to streamline feedback and ensure timely responses; the board has received a total of sixteen (16) resident complaints regarding the South Bend Police Department (SBPD). The CPRB board members, in total, have completed over two hundred (200) hours of training. In 2024 the CPRB held three (3) public meetings with residents, launched multilingual outreach campaigns, and engaged with media to amplify public awareness. Director King stated that the CPRB has laid the initial groundwork for analyzing police practices. In 2025 the CPRB plans to establish case review mechanisms, implement operational bylaws, strengthen public engagement, deliver policy recommendations, foster collaboration with academic and civic organizations, and measure and report on the board's impact through data -driven metrics and community surveys. The CPRB will commence its review processes following the completion of mandatory training in early 2025. The focus of policy recommendations will be to mitigate bias, ensure proportionality, enhance neighborhood engagement, and build trust. Councilmember Dr. Oliver Davis requested information regarding the Board of Public Safety and asked if there had been contact with review boards from other cities. Director King stated that the information gathered by the CPRB should be shared with the Board of Public Safety. Director King stated that he has spent time with the review board in Kalamazoo learning about their processes and how to better organize and operate South Bend's CPRB. Councilmember Dr. Davis requested information regarding Kalamazoo's review board. Director King confirmed that Kalamazoo's review board covers complaints regarding the police department and the fire department. Councilmember Karen White asked regarding the status of the sixteen (16) filed complaints. Director King stated that the cases are still pending, and the board will be investigating them soon. The CPRB plans to have a maximum forty-five to fifty (45-50) day process for investigating complaints and making recommendations to SBPD. Councilmember Gooden-Rodgers asked regarding the amount of required training. Director King stated that board members must go through the Citizen's Police Academy to qualify for the police ride-alongs. Councilmember Gooden-Rodgers asked if the CPRB would be willing and able to hold events at the Dream Center to boost community outreach. Director King answered yes. Councilmember Warner stated that as the CPRB moves forward, it would be beneficial for Director King to provide Council with recommendations should there need to be any changes to the requirements laid out in the CPRB ordinance. Council Vice President Rachel Tomas Morgan thanked the members of the CPRB for their commitment and effort. Councilmember Sheila Niezgodski requested information regarding the time commitment of board members. Director King stated that handling the backlog of sixteen (16) cases will increase the time commitment of board members and stated that the cases will be reviewed three (3) at a time. The ordinance requires the CPRB to meet quarterly, but they have chosen to increase their meeting frequency to monthly due to the high workload. Council President Lee asked how the CPRB has helped to bridge the gap between SBPD and citizens. 2 REGULAR MEETING February 24, 2025 Director King stated that the CPRB has eased some of his own misconceptions of SPBD. Director King stated that he does not seek to target SBPD with unnecessary investigations but will be the first (Pt) person to stand up and speak out regarding any wrongdoing. White — Aye PUBLIC HEARINGS BILL NO. 07-25 PUBLIC HEARING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 18, ARTICLE 5, TO UPDATE THE PROCEDURES FOR VACATION OF PUBLIC WAYS AND PUBLIC PLACES Clerk Tirado read the bill to the Council for its second (2nd) reading. After the second (2°d) reading, Councilmember Warner requested the committee report. Councilmember Niezgodski stated that Bill No. 07-25 went before the Public Works and Property Vacation Committee and comes with a favorable recommendation. Councilmember Warner requested that the petitioner(s) state their name and address and share key points before the council. Chris Dressel, Senior Planner in the Department of Community Investment, with offices on the 14th floor of the County -City Building, presented Bill No. 07-25. Bill No. 07-25 seeks to help petitioners and improve efficiency regarding the alley vacation process. Bill No. 07-25 corrects a scrivener's error, adds a fee to cover filing assistance, updates requirements for certified envelopes, and makes it so petitioners must receive signatures from fifty-one percent (51 %) of adjacent property owners. Council President Lee asked how much time will be saved with the updated ordinance. Chris Dressel stated that the value will be in the personal contact between petitioners and City departments throughout the process, which will reduce confusion and increase efficiency. Councilmember White recommended the creation of a flowchart showcasing the outline of the alley vacation process. Chris Dressel stated that a flow -chart could be created. Councilmember Niezgodski thanked everyone involved. Councilmember Warner held the public hearing, and nobody spoke. Council Vice President Tomas Morgan thanked Councilmember Niezgodski, Chris Dressel, Jenna Throw, and City Clerk Bianca Tirado for their work. Councilmember Warner stated Bill Nos. 25-14 and 25-15 both were heard in the Community Investment Committee, and both come to the Full Council with favorable recommendations. Council President Lee requested that the petitioner(s) state their name and address and share key points before the council. Erik Glavich, Director of Growth and Opportunity, with offices on the 14th floor of the County - City Building, stated that Bill No. 25-14 is a two-year (2) vacant building tax abatement for property located at 425 South Michigan Street, and Bill No. 25-15 is a ten-year (10) real property tax abatement for property located at 425 South Michigan Street. The property is the former Inwoods building, which was purchased in 2022 by Penny Hill Homes LLC, a female -owned company based in South Bend. The building has been vacant since 1999, and the project will provide a mixture of creative and commercial spaces. Bill No. 25-14 will allow the petitioner to invest in their project the majority of the annual six thousand seven hundred and sixty-four dollars ($6,764) they would pay in taxes. Bill No. 25-15 abates new taxes generated by the project for the next ten (10) years while still accruing more tax revenue than would be accumulated without the renovation project and tax abatements. Sarah Hill, the petitioner, was also present for questions. Council Vice President Tomas Morgan asked why it was decided to have such a high tax abatement percentage for the entirety of the ten (10) year abatement. Erik Glavich stated that this project sought Readi 2.0 funds, which require the City to match the petitioner's commitment. The City looked at different ways of meeting the requirements for the petitioner to obtain the Readi 2.0 funds and ultimately decided upon the two (2) tax abatements being presented. Council President Lee reiterated that the current annual taxes for the property are six thousand seven hundred and sixty-four dollars ($6,764), and the annual taxes after the abatements will be thirty-five thousand one hundred and eighty-nine dollars ($35,189). Council President Lee opened the public hearing. Jesse Davis, P.O. Box 10205, South Bend, IN, requested clarification regarding the property. Erik Glavich stated that Penny Hill Homes LLC recently subdivided the parcel. The tax abatements do not apply to the Monroe Arts building or the Rocky Button building. Jesse Davis asked if the property had been vacant. Erik Glavich, Director of Growth and Opportunity, with offices on the 14th floor of the County - City Building, stated that Bill No. 25-16 is a seven-year (7) real property tax abatement for property located at 25471 Cleveland Road. The property will be the new headquarters for HRP Construction, allowing them to consolidate all operations within the region into one (1) location in South Bend. The project will allow HRP Construction to retain forty-eight (48) full-time jobs and create six (6) new full-time jobs. The property's pre -project estimated annual taxes are six thousand one hundred and forty-two dollars ($6,142), whereas after the project, the estimated annual taxes are one hundred thirty-two thousand three hundred and seventy-five dollars ($132,375). The petitioner's total investment in the project is seven million three hundred thousand dollars ($7,300,000). Nancy Knapik, petitioner, 5777 Cleveland Road, South Bend, IN 46628, was present for questions. Jered Baker, petitioner, 5777 Cleveland Road, South Bend, IN 46628, stated that HRP Construction is a local company that has been in South Bend since 1980. This project is a great opportunity to consolidate HRP Construction's operations. Nancy Knapik stated that HRP Construction would like to remain based in South Bend. Councilmember Dr. Davis asked what has allowed HRP Construction to succeed. 6 REGULAR MEETING February 24, 2025 Nancy Knapik stated that HRP Construction has grown naturally mainly through local public works projects. Jered Baker stated that HRP Construction is in an industry with a large barrier to entry but has been able to grow a good reputation. Council Vice President Tomas Morgan requested information regarding the geographic scope of HRP Construction's work. Jered Baker stated that most of HRP Construction's work is done locally in South Bend but has worked on projects as far as Michigan City, Indiana and Rochester, Indiana. Council President Lee thanked the petitioner for the increase in jobs and their investment in South Bend. Council President Lee held the public hearing, and nobody spoke.
