ROLL CALL Present Absent: Council Members Luecke, Niezgodski, Soderberg, Puzzello, Slavinskas, Zakrzewski, Coleman, Duda and Voorde None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: The sub - committee has inspected the minutes of the August 20, 1990 and August 27, 1990 meeting of the Council and found them correct. Therefore, we recommend the same be approved. /s/ Tom Zakrzewski /s/ Ann Puzzello Council Member Coleman made a motion that the minutes of the August 20, 1990 and August 27, 1990, meeting of the Council be accepted and placed on file, seconded by Council Member Puzzello. The motion carried. SPECIAL BUSINESS COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on August 27, 1990, at 7:05 p.m., with nine members present. Chairman Coleman presiding. BILL NO. 56 -90 A BILL AMENDING AND SUPPLEMENTING CHAPTER 21, ZONING, OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED, AND HEREBY IS FURTHER AMENDED TO INCORPORATE PROVISIONS RELATIVE TO FLOODPLAIN REGULATIONS. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Slavinskas made a motion to amend this bill, by substitution, seconded by Council Member Zakrzewski. The motion carried. Council Member Slavinskas stated that the Zoning & Vacation Committee met on this bill and recommends it to the Council favorable, as amended. Bob Sante, Assistant Director Area Plan Commission, gave the staff report and made the presentation on the bill. Council Member Luecke made a motion to recommend this bill to Council favorable, as amended, seconded by Council Member Slavinskas. The motion carried. BILL NO. 58 -90 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND AMENDING CHAPTER 4, ARTICLE 4, SECTION 4 -51, COMMONLY KNOWN AS SCRAP METAL DEALERS, JUNK DEALERS, RECYCLING OPERATIONS, AND TRANSFER STATIONS. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Puzzello made a motion to amend this bill, by substitution, seconded by Council Member Niezgodski. The motion carried. Council Member Puzzello stated that the Personnel & Finance Committee met on this bill and recommends it to the Council favorable, as amended bysubstitution. Council Member Thomas Zakrzewski, 5035 Sunnyfield P1., made the presentation on the bill. He stated that the bill makes changes in fencing requirements. He indicated that the bill would make enforcement easier for the Code Enforcement Department. Council Member Niezgodski made a motion to recommend this bill favorable, as amended, seconded by Council Member Duda. The motion carried. BILL NO. 65 -90 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE 1ST NORTH -SOUTH ALLEY WEST OF MAIN STREET, RUNNING NORTH FROM THE NORTH LINE OF MONROE STREET TO THE SOUTH LINE OF THE 1ST EAST -WEST ALLEY NORTH OF MONROE STREET ALL IN MARTIN'S ADDITION. Council Member Slavinskas made a motion to strike this bill, seconded by Council Member Luecke. The motion carried. BILL NO. 66 -90 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE 1ST EAST -WEST ALLEY SOUTH OF WESTERN AVENUE, RUNNING WEST FROM MAIN STREET, FOR A DISTANCE OF APPROXIMATELY 165 FEET TO THE EAST LINE OF THE 1ST NORTH -SOUTH ALLEY WEST OF MAIN STREET, ALL IN MARTIN'S ADDITION. Council Member Slavinskas made a motion to continue this bill indefinately, seconded by Council Member Puzzello. The motion carried. 80 BILL NO. 69 -90 A BILL APPROPRIATING MONIES FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF SEVERAL DEPARTMENTS OF THE CIVIL CITY OF SOUTH BEND, INDIANA FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1991, AND ENDING DECEMBER 31, 1991, INCLUDING ALL OUTSTANDING CLAIMS AND OBLIGATIONS, AND FIXING A TIME WHEN THE SAME SHALL TAKE EFFECT. BILL NO. 70 -90 A BILL LEVYING TAXES AND FIXING THE RATE OF TAXATION FOR THE PURPOSE OF RAISING REVENUE TO MEET THE NECESSARY EXPENSES OF THE CIVIL CITY OF SOUTH BEND FOR THE FISCAL YEAR ENDING DECEMBER 31, 1991. BILL NO. 71 -90 A BILL APPROPRIATING MONIES FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF THE CENTURY CENTER FUND OF THE CITY OF SOUTH BEND, INDIANA, FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1991 AND , ENDING DECEMBER 31, 1991 INCLUDING ALL OUTSTANDING CLAIMS AND OBLIGATIONS AND FIXING A TIME WHEN THE SAME SHALL TAKE EFFECT. This being the time heretofore set for public hearing on the above bills, proponents and opponents were given an opportunity to be heard. Ann Puzzello stated that the Personnel & Finance Committee met on these bills last week, during the budget hearing process and indicated that all three bills are sent to the Council with a favorable recommendations. Ann Puzzello, 4th District Council Member, made the presentation on the bill. She asked City Controller Katie Humphreys to read the amendments into the record for Bill No. 69 -90. Katie Humphreys, City Controller, 1319 E. Wayne N. read the amendments as follows: GENERAL FUND 03 City Clerk 4110 Secretary IV from $16,302 to $16,908. 05 City Attorney 4390 Subscriptions & Dues from $11,000 to $10,000. 06 Common Council 4311 Legal from $27,766 to $28,666; 4399 Other Contractuals from $125,000 to $127,850. 15 Police 4110 Safetyville from $17,250 to $16,908. 16 Fire 4110 Special Duty Pay (EMT) from $36,750 to $33,250; 4130 EMT Training from $15,000 to $12,000; 4130 Sick Leave Buy Back from $151,000 to $135,000; 4130 Retirement Sick Buy Back from $44,760 to $37,760; 4151 Medical, Surgical, Dental from $80,120 to $63,620; 4154 Clothing Allowance from $182,207 to $191,200. 18 EMS 4110 Special Pay from $43,905 to $45,197; 4120 Salaries & Wages Temp. from $10,336 to $11,400; 4154 Clothing Allowance from $15,181 to $17,100; 4396 Instruction from $ -0- to $8,450. 20 Communication Center 4110 Longevity Pay from -0- to $5,250; 4110 Sick Leave Buy Back from $ -0- to $10,000. 28 Human Rights 4110 Secretary II to IV from $14,536 to $16,908; 4110 Secretary IV from $16,302 to $16,908; 4428 Office Equipment from $10,300 to $ -0 -. 92 Equipment Services 4399 Other Contractuals from $200,000 to $15,000. 97 Code Enforcement 4399 Other Contractuals from $ -0- to $2,280. She stated that indicates changes in the general fund from $29,427,972 to $29,301,854. PARK MAINTENANCE FUND 24 Parks 4110 Bonus from $3,600 to $7,750; 4130 Extra & Overtime Wages from $175,000 to $171,350. Council Member Puzzello made a motion tc amend this bill, seconded by Council Member Luecke. The motion carried. Council Member Niezgodski made a motion to recommend this bill to Council favorable, as amended, seconded by Council Member Puzzello. The motion carried. She also indicated that the budgets total over $50,823,132. Katie Humphreys, City Controller, made the presentation on Bill No. 70 -90. She stated that the current tax rates is 4.8271, and that the advertised tax rate was 8.0677 and the expected tax rate to be 5.0134 an increase of approximately 3.86 percent. Council Member Niezgodski made a motion to recommend this bill to Council favorable,seconded by Council Member Duda. The motion carried. Katie Humphreys, City Controller, made the presentation on Bill No. 71 -90. She indicated that the total for the Century Center Budget is $2,045,736. Council Member Niezgodski made a motion to recommend this bill to Council favorable, seconded by Council Member Luecke. The motion carried. Mayor Joseph Kernan, 114 E. Pokagon, spoke regarding the budget process. He commended City Controller, Katie Humphreys, and Chief Deputy Controller, John Leisenring, for the many hours spent on the budget. He thanked the Council for their participation in the budget process. There being no further business to come before the Committee of the Whole, Council Member Niezgodski made a motion to rise and report to the Council, seconded by Council Member Luecke. The motion carried. ORDINANCE NO. 8119 -90 AN ORDINANCE LEVYING TAXES AND FIXING THE RATE OF TAXATION FOR THE PURPOSE OF RAISING REVENUE TO MEET THE NECESSARY EXPENSES OF THE CIVIL CITY OF SOUTH BEND FOR THE FISCAL YEAR ENDING DECEMBER 31, 1991. This bill had second reading. Council Member Puzzello made a motion to pass this bill, seconded by Council Member Coleman. The bill passed by a roll call vote of nine ayes.
