RELEASE OF EASEMENT
CROSS REFERENCE TO: MARIETTA STREET IN AMERICAN HOME
DREAMS, FOURTH RE PLAT
KNOW ALL MEN BY THESE PRESENTS, that the City of South Bend Board
of Public Works, Grantee of a certain forty-nine point five (49.5) foot wide Utility
easement, measured east and west, and being one hundred fifty —three (153) foot in
length, measured north and south, now known as a vacated portion of Marietta Street, and
lying on the south right-of-way line of the first cast/west alley south of Pennsylvania
Avenue to the north right-of-way line of Broadway Street within the subdivision known
as Wenger and Krieghbaum's Replat of a Part of M.L. Wenger's 61l' Addition, in Portage
Township, Indiana, hereby agrees to and hereby does release its rights in said easement in
and along the above described real estate.
This release is hereby issued to the City of South Bend Department of
Redevelopment, American Home Dreams, Inc., their heirs, devisees, grantees, personal
representatives, successors, and assigns.
IN WITNESS WHEREOF, the City of South Bend Board of Public Works, has
caused this instrurr�ent to be executed by its duly authorized officials, this c� taMday of
2001, at South Bend, Indiana.
