Littrell, City Engineer SUBJECT: Columbia Street and Western Avenue vacations DATE: May 10, 2001 The Common Council has agreed to vacate portions of Columbia Street and Western Avenue in connection with the Western Avenue/ Wayne Street Improvements project. Their action was conditioned upon becoming effective upon the Board of Public Works' notice to the Council that Crowe Chizek and Company have awarded contracts for site work in the vacated street area. Chief Deputy City Attorney Aladean DeRose has prepared the attached Resolution for the Common Council to consider. It was submitted timely for their May 14 agenda. I recommend that the Board of Public Works recommend approval of the Resolution to the Council to make the streets vacation effective June 18, 2001. Enclosure c: Tony Molnar z r.,,�20 RESOLUTION NO. A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND TO ESTABLISH THE EFFECTIVE DATE OF THE VACATION OF PUBLIC REAL PROPERTY PURSUANT TO ORDINANCE #9202-01 WHEREAS, on March 12, 2001, the South Bend Common Council passed substituted and amended Ordinance #9202-01 which at Section V specifically provided the following: This ordinance shall be passed by the Common Council and be in full force and effect, upon a Resolution being filed for Council consideration by the Administration which addresses the progress of the proposed construction related to the redevelopment project. Such Resolution shall ftirther set forth a date certain for the effective date of the vacation of real property addressed in this ordinance, all of which shall be subject to the approval of the Common Council and the Mayor; and WHEREAS, pursuant to Section V of Ordinance #9202-01 it is necessary to establish the effective date of the vacation of that public real property described more fully in Ordinance 49202- 01; and WHEREAS, the City Administration has advised the South Bend Common Council that construction of the subject redevelopment project in the general vicinity of Western Avenue, Jefferson Boulevard and Columbia Street near the center of the City of South Bend is proceeding on a timely and steady basis according to construction plans; and WHEREAS, the South Bend Common Council has been advised further that an effective date of June 18, 2001 for vacation of the public real property described in Ordinance #9202-01 is necessary in order for the project to progress on a timely basis per its construction plans. NOW, THEREFORE BE IT RESOLVED by the Common Council ofthe CityofSouth Bend as follows: Section I. The effective date of the vacation of the public real property described more specifically in South Bend Common Council Ordinance #9202-01 shall be June 18, 2001 pursuant to the terms of Section V of that Ordinance. Section H. Ordinance 99202-01 shall be deemed fully effective as of June 18, 2001. Section III. Attached for consideration by the South Bend Colninon Council is a resolution establishing June 1.8, 2001 as the effective date of the real property vacation tinder Ordinance 9202-01. This effective date assumes that the Council will approve the Resolution on May 14 and that publication will occur promptly thereafter. This Resolution also addresses the progress of the construction which is timely and in conformity with the construction plans. Public Works Director Gary Gilot will be present at the appropriate Council caucus meeting to answer any questions or concerns about this Resolution, and he will introduce the Resolution at the Council meeting on May 14, 2001. Area Plan noted that the staff would not normally recommend the vacation of rights of way in a fashion that results in the dead ending of streets. However, die traffic from both Columbia and Western will flow into the proposed Crowe Chizek campus area, which provides adequate space to turn around if necessary. The vacation of these rights of way makes sense as parr of the development of this area. It should also be noted that the closing of these rights of way wilI have an effect on travel routes of both pedestrian and vehicles to and through downtown South Bend. For this reason, it is recommended that prior to the vacation, studies be undertaken to help properly redirect both fonds of downtown traffic. Therefore, the Board submits to you a favorable recommendation concerning this vacation. As you will see it involves the vacating of alleys for implementation of the River Glen Expansion/Construction project. The petition to vacate alleys is being submitted to you in non -final form. Specifically, it is a photocopy which has not yet been attested to by the appropriate representative of the Redevelopment Commission (although it has been signed by Commission President Robert Hunt). A special Redevelopment Commission meeting to attest the Petition is being held this week, and by the time of your Council meeting on Monday, February 26, 2001, the actual originally signed petition will be provided to you. The Ordinance and cover letter for the Ordinance were prepared by Crowe-Chizek and they are in final form (unless you desire changes). The vacation of these rights -of -way makes sense as a part of the development of this area. It should also be noted that the closing of these rights -of -way will have an effect on travel routes of both pedestrian and vehicles to and through downtown South Bend.
