RE: Property Vacation
Dear Members of the Council:
PHONE219/235-9251
FAx 219/235-9171
TDD 219/235-5567
fn accordance with Municipal Code Section 18-53.8, an unfavorable recommendation is being
submitted to the Common Council concerning a property vacation on the following:
That portion of the existing public rights of way known as Western Avenue and Columbia Street being
a part of the recorded Plat of River Bend Addition to the City of South Bend also being a part of the
wvest half of Section 12, Township 37 North. Range 2 East and described as follows: On Western
Avenue, from a point approximately 650 feet southwesterly of Jefferson Boulevard; thence
northeasterly to Jefferson Boulevard: thence also on Columbia Street from a point approximately 350
feet southeasterly of Western Avenue, thence northwesterly to western Avenue.
Mr. Gilot advised that the Board is in receipt of favorable recommendations concerning this Vacation Petition
from the Area Plan Commission, Police Department, Fire Department, Sanitation, Department of Economic
Development and the Department of Public Works. Area Plan noted that the staff would not normally
recommend the vacation of rights of way in a fashion that results in the dead ending of streets. However, die
traffic from both Columbia and Western will flow into the proposed Crowe Chizek campus area, which
provides adequate space to turn around if necessary. The vacation of these rights of way makes sense as parr
of the development of this area. It should also be noted that the closing of these rights of way wilI have an
effect on travel routes of both pedestrian and vehicles to and through downtown South Bend. For this reason,
it is recommended that prior to the vacation, studies be undertaken to help properly redirect both fonds of
downtown traffic.
Therefore, the Board submits to you a favorable recommendation concerning this vacation.

Dear Ms. Pfeifer:
I am writing this letter simply to explain the status of the attached Petition and Ordinance. As
you will see it involves the vacating of alleys for implementation of the River Glen
Expansion/Construction project.
The petition to vacate alleys is being submitted to you in non -final form. Specifically, it is a
photocopy which has not yet been attested to by the appropriate representative of the Redevelopment
Commission (although it has been signed by Commission President Robert Hunt). A special
Redevelopment Commission meeting to attest the Petition is being held this week, and by the time of
your Council meeting on Monday, February 26, 2001, the actual originally signed petition will be
provided to you.
The Ordinance and cover letter for the Ordinance were prepared by Crowe-Chizek and they are
in final form (unless you desire changes).
Because of the need to move this project as expeditiously as possible, we are hoping that
submission of the fully executed petition in time for your Monday meeting will be adequate for first
reading on the Ordinance.
iC yuu h.ava: questions or concarns ubauC this Feel trcc to cOr t mc. As .I understand it', Crowc-

Community and Economic Development office to offer any further information or assistance.

Addition to the City of South Bend also being described as follows: On Western

Dear Board Members:
The staff has reviewed this petition relative to IC 36-7-3-13. It is the staffs opinion that:
(1) The vacation would not hinder the growth or orderly development of the
unit or neighborhood in which it is located or to which it is contiguous.
(2) The vacation would not make access to the lands of the aggrieved person
by means of public way difficult or inconvenient.
(3) The vacation would not hinder the public's access to a church, school, or
other public building or place.
(4) The vacation would hinder the use of a public way by the neighborhood in which
it is located or to which it is contiguous.
The staff would recommend that these rights -of -way be vacated, subject to any utility easements that
may be required.
The staff would nit vLc,r,,,auy «

proposed Crowe Cl-iizec cainpus area, which provides adequate space to turn around if necessary. The
vacation of these rights -of -way makes sense as a part of the development of this area.
It should also be noted that the closing of these rights -of -way will have an effect on travel routes of
both pedestrian and vehicles to and through downtown South Bend. For this reason, it is
recommended that prior to the vacation, studies be undertaken to help properly redirect both forms of
downtown traffic.
Sincerely,
