TEMPORARY EASEMENT GRANT
(FOR CONSTRUCTION OF A TEMPORARY TURNAROUND)
Project: U.S. 31 Industriai Park, Phase II
Project No. 100-089
PPDT Corp., an Indiana corporation Indiana (the "Grantor") grants to the CITY OF SOUTH
BEND ( the "Grantee"), for and in consideration of the sum of $1.00 and other good and valuable
consideration, the receipt of which is hereby acknowledged, a temporary easement to enter upon and
have possession of the Real Estate of the Grantor's land for the purpose of construction thereupon
a temporary turnaround on the Grantor's property. The Real Estate is located in the County of St.
Joseph, State of Indiana, is described in the legal description attached as Exhibit "A", and is shown
on the survey attached as Exhibit "B". Exhibit "A" and Exhibit `B" are attached to and are part of
this Temporary Easement Grant. This temporary easement shall be released following construction
of the permanent roads to be constructed on the permanent right of way in U.S. 31 Industrial Park,
Phase II granted from the Grantor to the Grantee simultaneously with this Temporary Easement
Grant.
Any and all timber, shrubbery, fences buildings, and any other improvements situated within
the area of this temporary easement shall become the property of the City of South Bend.
The Grantor and the Grantee acknowledge that all provisions of this Temporary Easement
Grant are as stated and set forth herein and that no verbal agreement or promises exist with respect
thereto.
This temporary conveyance is subject to any and all easements, conditions, and restriction of
record. However, the Grantor represents that it is the owner in fee simple of the Real Estate and that
there exist no encumbrances, conditions, restrictions, leases, liens (except current real estate taxes
and assessments) of any kind or character which would be inconsistent with the temporary right
granted herein.
