Council Chambers of the County -City Building on Monday, February 12, 1990, at 7:00
p.m. The meeting was called to order and the Pledge to the Flag was given.

REPORT FROM THE SUB - COMMITTEE ON MINUTES
To the Common Council of the City of South Bend:
The sub - committee has inspected the minutes of the January 22, 1990 meeting of the
Council and found them correct.
Therefore, we recommend the same be approved.

Council Member Coleman made a motion that the minutes of the January 22, 1990,
meeting of the Council be accepted and placed on file, seconded by Council Member
Voorde. The motion carried.
SPECIAL BUSINESS
Council President Zakrzewski stated that the council has two appointment to the
Century Center Board of Managers Committee. He stated that anyone interested may
send a resume to the South Bend Common Council.

COMMITTEE OF THE WHOLE
Be it remembered that the Common Council of the City of South Bend met in the
Committee of the Whole on February 12, 1990, at 8:01 p.m., with nine members
present. Chairman Coleman presiding.
BILL NO. 120 -89 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT:
PARCEL ONE BEING APPROXIMATELY 390 FEET + EAST OF THE
INTERSECTION OF EWING AVENUE AND PRAIRIE AVENUE (STATE ROAD #23)
ON THE SOUTH SIDE OF EWING AVENUE, IN THE CITY OF SOUTH BEND,
IN.
This being the time heretofore set for public hearing on the above bill, proponents
and opponents were given an opportunity to be heard. Council Member Zakrzewski
made a motion to amend this bill, seconded by Council Member Voorde. The motion
carried. Kevin Joyce, Area Plan Commission gave the staff report. Bernard Feeney,
Lang, Feeney & Associates, Inc. 715 S. Michigan St., South Bend, made the
presentation on the bill. He indicated that the petitioner is requesting a zone
change in parcel one from "A" Residential to "B" Residential and parcel two from
Residential & Commercial to Commercial, "A" Height & Area. He stated that the
change in parcel one would allow for the construction of two - family dwellings to be
constructed in a single - family residential area. He also indicated that the change
in parcel two would be to allow for the construction of a small shopping area.
Brian McLaughlin, 23886 S.R. 23, South Bend spoke opposed to the bill. He stated
that the traffic at the intersection of Prairie & St. Rd. 23 is very heavy. He
indicated that there are traffic accidents at that location frequently. He stated
that the project would create more traffic. Council Member Niezgodski made a
motion to recommend this bill to the Council favorable, seconded by Council Member
Voorde. The motion carried.
BILL NO. 119 -89 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA
AMENDING CHAPTER 2, ARTICLE 6, COMMONLY REFERRED TO AS TAX
ABATEMENT PROCEDURES.
This being the time heretofore set for public hearing on the above bill, proponents
and opponents were given an opportunity to be heard. Steve Luecke stated that the
Human Resources and Economic Development Committee met on this bill and recommends
it to the Council favorable. Steve Luecke, 1st Disctrict Council Member made the
presentation on the bill. Council Member Zakrzewski made a motion to amend this
bill, seconded by Council Member Puzzello. The motion carried. Council Member
Luecke made a motion to recommend this bill to the Council favorable, seconded by
Council Member Slavinskas. The motion carried.
BILL NO. 1 -90 A BILL APPROPRIATING $254,385.00 FROM THE EMERGENCY MEDICAL
SERVICES CAPITAL IMPROVEMENT FUND TO DEFRAY FIRE DEPARTMENT
EXPENSES.

This being the time heretofore set for public hearing on the above bill, proponents
and opponents were given an opportunity to be heard. Fire Chief Luther Taylor,
701 W. Sample St. South Bend, made the presentation on the bill. He indicated that
the bill would allow for the appropriation of funds in the EMS Capital Improvement
Fund. This will allow EMS to make annual lease payments on existing capital
leases. He stated that the equipment items include an upgraded computer systems
and a new heart monitor. Council Member Niezgodski made a motion to recommend this
bill to the Council favorable, seconded by Council Member Voorde. The motion
carried.
BILL NO. 12 -90
A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA
APPROPRIATING ONE HUNDRED THOUSAND DOLLARS ($100,000.00) FOR
ENVIRONMENTAL ASSESSMENT OF FREDRICKSON PARK PROPERTY.
This bill had first reading. Council Member Puzzello made a motion to suspend the
rules and have public hearing and second reading on this bill, seconded by Council
Member Voorde. The motion carried on a roll call vote of eight ayes. This being
the time heretofore set for public hearing on this bill, proponents and opponents
were given an opportunity to be heard. John Leszczynski, City Engineer, made the
presentation on the bill. He indicated that the Mayor has indicated a state of an
emergency at the proposed site of Fredrickson Park. The bill requests the
appropriation of $100,000 from revenues of the South Bend Water Works. He stated
that the funds will be used for investigation of the possible contamination of the
proposed site of Fredrickson Park. He stated that the Board of Public Works will
enter into an agreement with the firm of Tenney Pavoni to perform the necessary
groundwater and soil analysis. He indicated that on February 7, 1990 the City
began identifying and testing any private wells in the vicinity of the park site.
He indicated that there is an amendment to the bill under Section I. the last
sentence shall read as follows: (This appropriation shall be administered by the
Department of Public Works as set forth below:) Council Member Voorde made a
motion to amend this bill, seconded by Council Member Coleman. The motion
carried. Richard Nussbaum, City Attorney, South Bend, Indiana, indicated that the
prior owners of the land belong to a JDK Partnership. Council Member Puzzello made
a motion to recommend this bill favorable, as amended, seconded by Council Member
Coleman. The motion carried.

RESOLUTION NO. 1766 -90 RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY
RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY
OF SOUTH BEND, INDIANA COMMONLY KNOWN AS 2629
Foundation Drive AN ECONOMIC REVITALIZATION AREA FOR
PURPOSES OF A FIVE (5) YEAR PERSONAL PROPERTY TAX
ABATEMENT FOR TOTAL COMPOSITES, INC.
WHEREAS, the Common Council of the City of South Bend, Indiana has adopted
a Declaratory Resolution designating certain areas within the City as Economic
Revitalization Areas for the purpose of tax abatement consideration; and
WHEREAS, a Declaratory Resolution designated the area commonly known as
2629 Foundation Drive which is more particularly described as follows:
A parcel of real property in St. Joseph County, Indiana, being 316.80 feet
North and South by 450.00 feet East and West, being a parcel of real property which
is 211.27 feet West and 1,590.40 feet North of the Southeast corner of the
Southwest Quarter of Section 28, Township 38 and Range 2 East.
This property has Key No.: 25 -1010- 040012.
as an Economic Revitalization Area; and
WHEREAS, notice of the adoption of a Declaratory Resolution and the public
hearing before the Council has been published pursuant to Indiana Code
6 -1.1- 12.1 -2.5; and
WHEREAS, the Council held a public hearing for the purposes of hearing all
remonstrances and objections from interested persons; and
WHEREAS, the Council has determined that the qualifications for an
Economic Revitalization Area have been met.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South
Bend, Indiana, as follows:
SECTION I. The Common Council hereby confirms its Declaratory Resolution
designating the area described herein as an Economic Revitalization Area for the
purposes of tax abatement. Such designation is for personal property tax
abatement only and is limited to two (2) calendar years from the date of adoption
of the Declaratory Resolution by the Common Council.
SECTION II. The Common Council hereby determines that the property owner
is qualified for and is granted personal property tax deduction for a period of
five (5) years.
SECTION III. This Resolution shall be in full force and effect from and
after its adoption by the Common Council and approval by the Mayor.

A public hearing was held on the resolution at this time. Ernest Szarwark,
Attorney Barnes & Thornburg, 100 North Michigan, South Bend, made the presentation
on the bill. He indicated that the equipment which is proposed to be purchased
will be utilized in the development and production of a complete facility for
thermoset composite manufacturing, a process by which various resins and sheets of
resin materials are molded to suit the needs of certain manufacturers. He stated
that these products are used in the appliance and automobile industry and many
other industries. Council Member Niezgodski made a motion to adopt this
resolution, seconded by Council Member Duda. The resolution was adopted by a roll
call vote of eight ayes

Pheasant Run, Granger, IN 46530, President, Mack Tool & Die made the presentation
on the bill. He indicated that the project will consist of the construction of a
new 10,000 square foot building on a 1 3/4 acre lot in order to provide for
necessary growth of the business of Mack Tool & Die, Inc. Council Member
Niezgodski made a motion to adopt this resolution, seconded by Council Member
Luecke. The resolution was adopted by a roll call vote of eight ayes.

A public hearing was held on the resolution at this time. Melvin W. Hartz, 51171
Pheasant Run, Granger, IN 46530, President, Mack Tool & Die made the presentation
on the bill. He stated that they will acquire three new pieces of computer
numerical control tool and die equipment. Such equipment more specifically is one
new 5 axes CNC machining center, one new Mazak quick turn 15N universal CNC lathe;
and one new Hurco 3 axes CNC machining center. He indicated that the project is
necessary to improve manufacturing efficiency and expand its production capacity
and employment, in order to remain competitive in the tool and die industry. He
indicated that the project will create eight new permanent jobs with an estimated
payroll of $260,900.00. Council Member Niezgodski made a motion to adopt this
resolution, seconded by Coleman. The resolution was adopted by a roll call vote of
eight ayes.
RESOLUTIONS NO. 90 -9 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND DESIGNATING CERTAIN AREAS WITHIN THE CITY
OF SOUTH BEND, INDIANA, COMMONLY KNOWN AS 431 E.
COLFAX AVENUE AN ECONOMIC REVITALIZATION AREA FOR
PURPOSES OF A 10 YEAR REAL PROPERTY TAX ABATEMENT
FOR: NILES / COLFAX ASSOCIATES.
Council Member Luecke made a motion to continue this bill until the March 26, 1990
meeting, seconded by Council Member Coleman. The motion carried.

STATE GRANT FUND TO BE ADMINISTERED BY THE DEPARTMENT OF
ECONOMIC DEVELOPMENT OF THE CITY OF SOUTH BEND, INDIANA.
This bill had first reading. Council Member Coleman made a motion to set this bill
for second reading and public hearing February 26, 1990, seconded by Council Member
Voorde. The motion carried.
BILL NO. 15 -90 A BILL TRANSFERRING $777,312 AMONG VARIOUS ACCOUNTS WITHIN THE
DEPARTMENT OF ECONOMIC DEVELOPMENT.
This bill had first reading. Council Member Coleman made a motion to set this bill
for second reading and public hearing February 26, 19909, seconded by Council
Member Duda. The motion carried.
Council Member Luecke indicated that Bill No. 73 -89 entitled "Recycling
Procedures ", was sponsored by Council Member Soderberg, Chairman of the Public
Safety Committee. He stated that the bill was sent to the Public Safety and
Residential Committee and no date was set. He indicated that he would like the
Chairman to set a meeting date.
