THIS A.q-REEMENT, entered into c�) day of
JG9 X, by and between Cheryl Moore, hereinafter referred to as the
"Buyer," and the Civil City of South Bend, a municipal corporation of the State of
Indiana, hereinafter referred to as the "City."
WITNESSETH :
WHEREAS, I.C. 36-1-11 establishes the procedures for the sale and rental
of real property owned by the City of South Bend; and
WHEREAS, the Board of Public Works (hereinafter referred to as the
"Board") is empowered to carry out the provisions of said statute; and
WHEREAS, the Board has determined that:
1. The highest and best use of certain real property owned by the City
is by sale to an abutting landowner;
2. The cost to the public of maintaining said real property owned by the
City equals or exceeds the established fair market value of said real property;
3. It is economically unjustifiable to sell real property owned by the
City in accordance with the procedures set forth in I.C. 36-1-11-4 .
WHEREAS, the Board has determined that the assessed value of said real
property is less than TWO THOUSAND DOLLARS ($2 , 000) ; and
WHEREAS, the Board appointed a licensed independent appraiser who
appraised the particular real property; and
WHEREAS, based upon the appraisal submitted, the Board has established
an offering price for the said property, and published notice of its intention to
sell said property at said price; and
WHEREAS, pursuant to I.C. 36-1-11-5, the Board is empowered to
negotiate and sell said real property to the abutting landowner who submits the
highest offer for said real property; and
WHEREAS, the Buyer made an offer to purchase the property, this offer
being the only offer received; and
WHEREAS, the counteroffer of the City in the amount of One Hundred
Fifteen Dollars ($115.00) was accepted by the Buyer.
NOW, THEREFORE, it is agreed by and between the parties hereto, and for
and in consideration of the promises and the mutual covenants herein contained,
as follows:
1. The City agrees to sell and Buyer agrees to buy the following
property located in St. Joseph County, Indiana:
Key ##:18-1043-1854. Lot 2 & 33 x 40 ft. & adj. Kuespert & Summers
addition.
for the sum of $115.00.
2. Buyer agrees to pay the purchase price and recording fee in full at
the time of closing.
3. Buyer agrees to pay all title and abstract costs involved in said
transaction which it shall desire or request.
4. At the time to closing and after a submission of a receipt for the total
purchase price has been submitted by the Controller to the Board of Public
Works, the Board shall cause a Quit -Claim deed to be prepared, which deed shall

Thank you for contacting me regarding your bid to purchase the property at 1039 LaSalle Court
for $10.00. Pursuant to our conversation, please accept this letter as the City's formal
counteroffer to sell this property for the sum of $115.00. As we discussed, the City paid $100.00
for the appraisal of the property, and will have to pay recording costs of $15.00. For your
information the property appraised at $350.00
If this counteroffer is acceptable to you, please sign the enclosed Purchase Agreement and return
it my attention along with a certified check or money order in the amount of $115.00. Upon
receipt of the signed Purchase Agreement and check, the Board of Public Works will execute the
agreement and provide you with a Quit-CIaim Deed to the property.

In a previous Memorandum to you dated June 6, 1995, the Department of C &" ED
had recommended denial of the above noted request. The recommendation was
based on information that the adjacent lot (18-1043-1853) was owned by the City,
and that splitting the two lots apart would compromise successful reuse of the
remaining lot.
Cheryl Moore, the resident requesting the purchase, informed me on June 19th that
she in fact is the owner of the research betweenjacent dLa not
the City. Portage Spradlin and me indicates that
Assessor records and further Larry
Cheryl Moore is in fact the property owner, and not the City.
Based on this evidence, I recommend the sale of the subject lot to Cheryl Moore. I
have conveyed this information to her, and am prepared to assist you in any way I
can to resolve this issue. My sincerest apologies for any. inconvenience that this has
caused.

At its meeting held June 12, 1995, the Board of Public Works denied the sale of the above
listed property. The lot immediately adjacent to the subject lot is also owned by the City, purchased
at a tax sale in 1992. The purpose of the purchase -was to take advantage of an opportunity to
combine and be able to market two lots as one building site. The sale of one of the lots would
compromise that effort.

The Board of Public Works has received a request to purchase City -owned property
at 1039 LaSalle Court.
Favorable recommendations for the sale of this lot has been received from the
Engineering Department, Department of Code Enforcement, Community and Economic
Development (see memo of June 19, 1995), and the Park Department.
If you have no objections, the Board will proceed with the sale of this property by
obtaining an appraisal and advertising them for sale according to state statutes.

WHEREAS, the Board of Public Works of the City of South Bend, Indiana, has compiled
a current detailed inventory of all real property owned by the City of South Bend; and
WHEREAS, the Board of Public Works has reviewed said inventory of real property and it
finds that a certain parcel of real estate now owned by the City of South Bend is not necessary to the
public use and is not set aside by State and City laws for public purposes; and
WHEREAS, the Board of Public Works finds that the property described below has an
assessed valuation of less than $2,000,00, that the cost of maintaining said parcel equals or exceeds
the estimated fair market value of the parcel, and that the highest and best use of the parcel is sale
to an abutting landowner.
WHEREAS, the Board of Public Works now wishes to take the necessary action to make it

Notice is hereby given that the City of South Bend, Indiana, through its Board of Public
Works, is offering- for sale the following parcel of real estate located in South Bend,
Indiana:
1039 LaSalle Court
Key No. 18-1043-1854
More specific information concerning this property and the City's offering price is available
in the Office of the Board of Public Works, Room 1316, County -City Building, South Bend,
Indiana.
Bids to purchase said parcel must be received in the Office of the Board of Public Works,
1308 County -City Building, South Bend, Indiana, or on before Monday, August 7, 1995,
at 9:30 a.m. At that time, a determination will be made by the Board as to the sale of
these parcels.
Pursuant to State statute, these properties may not be sold to a person who is ineligible
under Section 16 (I.C. 36-1-11-16).
Additionally, an offer to purchase property submitted by trust must identify each beneficiary
of the trust and settlor empowered to revoke or modify the trust.
The Office of the Board of Public Works will record the appropriate Quit -Claim Deed in the
