RELEASE OF EASEMENT r +
CROSS REFERENCE TO: LOT NUMBER 26 AND 27 SOUTHEAST
NEIGHBORHOOD, PHASE ONE, SECTIONS TWO AND THREE
KNOW ALL MEN BY THESE PRESENTS, that the City of South Bend Board
of Public Works, Grantee of a certain sixty (60) foot wide Utility easement, measured
north and south, and being one hundred thirty (130) foot in length, measured east and
west, now known as a vacated portion of Pennsylvania Avenue, and lying between the
west right-of-way line of High Street and the newly�dedicated east right-of-way line of
Pennsylvania Avenue, in Southeast Neighborhood, Phse One, Section Two, recorded as
instrument number 9914340 in the Office of the St. Joseph County Recorder,City of
South Bend, Portage Township, Indiana, (as shown on Attachment A) hereby agrees to
and hereby does release its rights in said easement in and along the above described real
estate.
This release is hereby issued to the City of South Bend Department of
Community and Economic Development, Division of Redevelopment, their heirs,
devisees, grantees, personal representatives, successors, and assigns.
IN WITNESS WHEREOF, the City of South Bend Board of Public W ram, has
ca ed this ins rument to be executed by its duly authorized officials, this day of
1999, at South Bend, Indiana.

SUBJECT: Release of Easement on
Vacated Pennsylvania Avenue
DATE: November 22, 1999
I recommend that the Board of Public Works approve the attached document to
release a sixty feet wide easement on vacated Pennsylvania Street west of High Street.
Over one year ago, the Common Council vacated a section of Pennsylvania Street,
subject to easements for existing utilities, to allow the Department of Community and
Economic Development to develop Phase One, Sections Two and Three of the Southeast
Neighborhood Project. There is a water main and a combined sewer line in vacated
Pennsylvania. An easement twenty-five feet wide is sufficient for maintaining these pipes.
The Southeast Subdivision Phase One, Section Three subdivision is before the Area Plan
Commission at the present time. That plat includes dedication of a twenty-five feet wide
easement for the pipes. That will be sufficient.
That subdivision can not be approved until the sixty feet wide easement is released.
Thus, the importance of approving this release of easement.
