AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68,
AS AMENDED, COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
(Chapter 21, Municipal Code)
BE IT ORDAINED by the Common Council of the City of South Bend,
Indiana:
Section 1. Ordinance No. 4990 -68, as amended, which ordinance
is commonly known as the Zoning Ordinance of the City of South Bend,
Indiana, be and the same hereby is amended in order that the zoning
classification of the following described real estate in the City of
South Bend, St. Joseph County, State of Indiana:
Lot #159 and the (SZ) of Lot #158
Lot #165 except West end to City
Lot #164
100 West end Lot 163 and 65 East end Lot 163
All as shown on.the original Plat of the Town now City of
South Bend
be and the same is hereby established as A -3 Mixed use Multi- Family
Residential and Commercial District, G (Height and Area,if City).
Section 2. This Ordinance shall be in full force and effect from and

Ordinance as herein requested.

RE: A proposed ordinance and site development plan of the Town Tower Motel
Corporation, to zone from "C" Commercial, "F" and "G" Height and Area
to "A -3" Mixed Use Multi- Family Residential and Commercial, "G" Height
and Area, property located at 423 North Michigan Street - 416 North
Main Street, City of South Bend
Gentlemen:
The attached rezoning petition of Town Tower Motel Corporation was legally
advertised May 9, 1981. The Area Plan Commission gave it a public hearing
on May 19, 1981, at which time the following action was taken:
Upon a motion by Joseph Simeri, being seconded by William Limerick
and unanimously carried, the cocktail lounge is deleted from the
list of proposed uses, upon request of the petitioner.
Upon a motion by Joseph Serge, being seconded by Donald Jankowski
and unanimously carried, the proposed ordinance and site develop-
ment plan, as amended, of the Town Tower Motel Corporation, to zone
from "C" Commercial, "F" and "G" Height and Area to "A -3" Mixed Use
Multi- Family Residential and Commercial, "G" Height and Area, property
located at 423 North Michigan Street - 416 North Main Street, is sent
to the Common Council with a favorable recommendation, subject to a
final site plan, as amended.
The above recommendation is made subject to a final site plan.
PLEASE NOTE that this is not the same Ordinance which received first reading by
the Council. This Ordinance was amended at the Area Plan Commission's Public
Hearing to include only multiple family dwelling units on the site, and to
delete the proposed use of a cocktail lounge. The amended Ordinance was the
Ordinance heard by the Area Plan Commission.
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will be
forwarded to you at a later date to be made a part of this report. Attached, for

STAFF REPORT
TOWN TOWER MOTEL, INC. - #742 -81 May 8, 1981
423 N. Michigan, 416 N. Main, South Bend
REQUESTED ACTION: The petitioners are requesting a zone change from
"C" Commercial, "F" and "G" Height and Area to
"A -3" Mixed Use, Multi- family Residential and
Commercial, "G" Height and Area, to allow for
"Multi- family apartments and bar."
EXISTING LAND USE: The site contains an abandoned motel complex.
SURROUNDING LAND USE AND ZONING: Located to the north, east, and south are commercial
business and offices zoned "C" Commercial, "F" and
"G" Height and Area; and to the west is the Masonic
Temple and a church zoned "B" Residential, "G"
Height and Area.
APPLICABLE PARKING REGULATIONS: Multi- family uses require one parking space per unit,
and cocktail lounges require one parking space per
3 customer seats.
ACCESS:
There are 2 access points each on Main Street,
Madison Street, and Michigan Street.
DRAINAGE:
The drainage has not been addressed by the petitioner.
DATA:
The total site is 47,590 square feet. Of that,
18,555 square feet or 39% of the site is occupied
by buildings, 27,500 square feet or 57.8% of the
site is used for parking and drives, and 1523 square
feet, or 3.2% of the site is open space.
SITE PLAN:
The site plan is preliminary.
AGENCY COMMENTS:
The City Engineer has the following comments;
"1. Based on available data the parking spaces
provided are inadequate for the intended use. To
better determine exact number required more infor-
mation is needed on the cocktail lounge.
2. The location of some of the parking spaces should
be redesigned.

3. Handicapped spaces should be 12' wide.
4. One parking spot in the extreme southwest corner
of the property is insufficient in size and should
be corrected.
