AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 21
OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND,
INDIANA, AS AMENDED BY ADDING PROVISIONS RELATIVE
TO REDEVELOPMENT PROJECT AREAS.AND AMENDING PER
TINENT SECTIONS.
STATEMENT OF PURPOSE AND INTENT:
The Common Council of the City of South Bend has determined
that it is necessary to update certain provisions of the Zoning
Ordinance of the City of South Bend, known as Chapter 21 of the
Municipal Code of the City of South Bend, to address current and
future needs relative to such zoning which are caused by the
redevelopment of certain areas of the city. In order to allow for
future flexibility in the event of the declaration of additional
redevelopment project areas, amendments to current provisions of
the zoning ordinance are required.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of South Bend, Indiana, as follows:
SECTION I. That Section 21- 1(a)(3.1) of the Municipal Code
of the City of South Bend, Indiana, be amended as follows:
(3.1) Associated sphere of influence:
The area extending from one-half block beyond the bounda-
ries of the - central- Dewntewn- Urbaa- Renewal- Prejeet -Area
and- bexaded- by- Marien- Street -en- the - North;- Williams- Street
on -the -West; - South- Street -ea- the - South -rind- Niles - Avenue -on
the -East- an. adopted Redevelopment Project Area.
SECTION II. That Section 21- 1(a)(16.1) of the
Municipal Code of the City of South Bend, Indiana, be.amended
as follows:
(16.1) Development Design Review Committee: An advisory
committee for- the- eextral- Dewntewn- Urban- ReRewa.l -Area:
established by the Redevelopment Commission in certain
eas.
SECTION III. That Section 21 -1.(a) of the Municipal Code of
the City of South Bend be .amended by adding a new subsection 47.05
as follows:

SECT70N IV. That Section 21 -172 of the Municipal Code of the
City of South Bend, Indiana, be amended as follows:
Sec. 21 -172. Development Design Review Committee: Membership;
duties and powers relative to administration of article.
(a) The Development Design Review Committee shall include
the following members:
(1) Executive Director,
Chairman;
(2) City Engineer;
(3) Executive Director,
Commission;
Department of Redevelopment,
St. Joseph County Area Plan
(4) City Building Commissioner; and
(5) A bus inessman -iR- the -Gen tr&I- DewRtown-UrbdR
Renewal- Area; person, appointed by the South
Bend - Dewntewn- Heuneil Redevel.opment_Coinmission.
(b) The Development Design Review Committee shall have the
following powers andduEi.es in all matters relative to the
erection or alteration of signs within the Central:- Downtown
UrbaR- Renewal -Area adopted Redevelopment Project Areas and
within one -half block beyond Lfie boundaries of such areas:
(1) Review applications for sign permits and, within
fifteen (15) working days of receipt of the
application;-either:
a. Return the application to the Building
Commissioner with a letter of approval
stating that the proposed sign is in
conformance with this art:i.cle, and auLho-
r.izi.ng the issuance of a sign permit; or
b. Deny the application, stating in writing
the reason fur. such denial.
Failure of the Development Dvsil,n ReVi.CW Commiitce, to
take such action shall constitute approval of the at,p1JC,%1 i011.
(2) Make recommendations relative to amendment, supple-
ment, change or repeal of this arti.cld, according
to the provisions of this article.
(3) Maintain a permanent record of all actions of the
Commi.t'tee.
SECTION V. That Section 21- 169(c)(5)c be amender] as follows:

SECTION VI. That Section 21- 170(2) of the Municipal Code of the
City of Sou -tli -Bend, Indiana, be amended as follows:
(2) "A -2" Planned Residential Development District and "A -3"
Mixed Use Multi - Family Residential and Commercial District
(a) All signs permitted in the "A" Residence District.
(b) Identification signs for pei2m- 1 # #1ng permitted
commercial uses in a planned residential de-
velopment or mixed use multi - family residential
commercial district not exceeding one -half square
foot in display area per linear front foot of the
commercial uses and not visible from any public
street outside the development.

SECTION VII. That Section 21- 173(a)(2)h of the Municipal Code
of the City of South Bend, Indiana, be amended as follows:
h. Other such applicable information as the Building
Commissioner or the Beuelepmen# Design Review Committee
may require under the provisions of this article.
SECTION VIII. That Section 21- 173(a)(3)a of the Municipal Code
of the City of South Bend, Indiana, be amended as follows:

a. In accordance with the provisions of this section 21 -173,
the Building Commissioner shall forward upon receipt one
copy of the application for a signed permit along with all
supporting data to the BevelegmeA# Design Review Committee
for review and approval. The Building Commissioner shall
issue a signed permit or deny the application upon receipt
of the decision of the Bevelepffieet Design Review Committee;
and
IX. That Section 21 -6(a) of the Municipal Code of the

SECTION IX XI. That this Ordinance shall be in full force and
effect from and -aTter its passage by the Common Council, approval
by the Mayor, and publication as required by law.
