GAMMON Approved and signed by me X0 19 g/ Clerk ORDINANCE NO. 6918 -81 AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Chapter 21, Municipal Code). STATEMENT OF PURPOSE AND INTENT The Common Council recognizes the need for Development Controls for the East Bank Development Area. The Council recognizes that the current zoning of the Development Area is not in keeping with the Development Controls of the adopted East Bank Develop- ment Plan. In order to promote the East Bank Development Area as a Mixed Use Multi - Family Residential and Commercial District, the following described area is to be rezoned from "D" Light Industrial to "A -3" Mixed Use Multi- Family Residential and Commercial and from "F" Height and Area to "G" Height and Area. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. Ordinance No. 4990 -68, as amended, which is commonly known as the Zoninance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: A parcel of land being a part of the City of South Bend, Portage Township, St. Joseph County, Indiana and being more particularly described as follows, viz: Beginning at the point of intersection of the North right -of -way line of Sorin Street with the East right - of-way.line of Niles Avenue in said City; thence South along said East right -of -way line of Niles Avenue to the centerline of the first fourteen (14) foot alley lying North of Cedar Street and between Niles Avenue and Hill Street; thence East, along said centerline, to the centerline of Hill Street, a sixty -six (66) foot right -of -way; thence South, along said Hill Street centerline, to the centerline of Jefferson Boulevard, an eighty -two and one -half (82.5) foot right -of -way; thence West, along said Jefferson Bou- levard centerline to the center of the St. Joseph River; thence in a Northwesterly and Northeasterly direction along the centerline of said River to its intersection with the projected North right -of -way line of said Sorin Street; thence East, along said projection and along said North right -of -way line to the East right -of -way line of Niles Avenue which is the place of beginning. be and the same is hereby changed from "D" Light Industrial to "A -3" Mixed Use Multi- Family Residential and Commercial District and from "F" Height and Area to "G" Height and Area District. SECTION II. This Ordinance shall be in full force and effect from and after its passage y the Common Council, approval by the Mayor and legal publi- cation. Auburn Members of the Common Council Member 441 County /City Building South Bend, IN 46601 Dear Councilmen: Attached are three (3) ordinances amending Chapter 21 of the Municipal Code. These ordinances all involve zoning and are related to activities in the East Bank Development Area. The first ordinance amends the existing "A -311 zoning classification to provide for a mixed -use district allowing both multi - family residential and business commercial uses. The second ordinance is a rezoning of the East Bank Development Area from "D" Light Industrial to "A -311 Mixed -Use Multi- Family Residential and Commercial and from "F" Height and Area to "G" Height and Area. This rezoning would bring the East Bank area into line with the develop- ment controls of the adopted East Bank Development Plan. The third ordinance extends several provisions in Chapter 21 that currently relate to the downtown redevelopment area to cover other redevelopment areas. These provisions include establishment of a Design Review Committee in redevelopment project areas and sign controls in such areas. Your favorable consideration of these ordinances is requested.
