AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 21
OF THE MUNICIPAL CODE OF SOUTH BEND, INDIANA, ALSO
KNOWN AS ORDINANCE NO. 4990 -68, AS AMENDED, AND GEN-
ERALLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF
SOUTH BEND, INDIANA, AS AMENDED, BY ADDING PROVISIONS
RELATIVE TO A MIXED USE MULTI - FAMILY RESIDENTIAL AND
CObIAERCIAL ZONING DISTRICT.
STATEMI:Nf OF PURPOSE AND INTENT
The Common Council of the City of South Bend has determined that the
existing "A -3" High Density Residential - Office and Professional District is
in need of revision to incorporate certain provisions which permit multi - family
residential and business commercial uses that complement the Central City Area,
NOW, THEREFORE, BE IT ORDAINED AND ESTABLISHED BY THE COMMON COUNCIL
OF THE CITY OF SOUTH BEND, INDIANA, as follows:
SECTION I. That Chapter 21 of the Municipal Code of South Bend, Indiana,
be amended by deleting Division 4.5, Section 21 -11.1 in its entirety.
SECTION II. That Chapter 21 of the Municipal Code of South Bond, Indiana,
be amen(e— FEy adding Division 4.5, Section 21 -11.1 as follows:
"A -3" Mixed Use Multi - Family Residential and Commercial District.
a) The intent of this section is to establish a zoning district in
which to permit mixed use multi - family residential and business
commercial to complement the central city area.
b) Permitted Uses:
(1) Residential Uses:
-Apartments and boarding houses
-Dwellings, multi and two family
'Dwellings, single, two or multi - family, when such dwell-
ings are located in the same building as other permitted
uses.
(2) Commercial Uses:
.•Business, Rretail Business
Hotels and Motels
-Parking garages
-Restaurants, not including drive -ins
-Class A Cabarets
*Establishments ror the sale of beer
'Professional Services
(3) Office Uses:
-Professional
-Medical
-Business
(4) Entertainment Uses:
-Theatres and motion picture theatres
(5) Public and Quasi - public Uses:
-Churches
-Fire Stations
-Government offices and services
-Medical clinics
-Libraries
-Schools
'Utilities
(6) Accessory Uses:
-Parking garages
Recreational centers
-Real Estate sales and'rental offices and model dwelling
units representing only the development in which they
are located.
SECTION III. This Ordinance shall be in full force and effect from and
after its passage by the Common Council, approval by i Mayy or, and publication.
