GAMMON 19 Clerk BILL NO. 40 -81 ORDINANCE NO. 6914 -81 AN ORDINANCE FIXING THE ANNUAL PAY OF POLICE OFFICERS FOR THE CALENDAR YEARS OF 1982, 1983, AND 1984. STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend, Indiana recognizes that Indiana Code Section 18- 1 -11 -2 specifically authorizes the Common Council to set salaries for the Police Department. The Council further recognizes that its' Wage Committee and the Police Officers' Wage Committee met on several occasions to discuss the annual pay for Police Officers in 1982, 1983, and 1984. The Common Council believes that the following three -year salary schedule is a fair and equitable pay package which recognizes some of the many needs of the Police Officers. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. (a) The Common council of the City of South Bend, Indiana, recognizes the Wage Committee of the Fraternal Order of Police, Lodge No. 36, as the sole bargaining unit for the annual salaries and fringe benefits for members of the South Bend Police Department, excluding the Police Chief, Division Chiefs, and Captains. (b) The Council further recognizes and designates the Police Chief, Divisions Chiefs and Captains as the management members of the department. (c) The annual pay for the officers and sworn members of the Police Department of the City of South Bend for the 1982, 1983 and 1984 calendar years, by rank shall be as follows: Police Chief Division Chief Captains Lieutenants Sergeants Corporal Patrolman First Class 1982 27,680.00 25,280.00 23,080.00 19,680.00 18,680.00 17,680.00 14,650.00 1983 29,130.00 26,730.00 24,530.00 21,130.00 20,130.00 19,130.00 16,100.00 1984 30,630.00 28,230.00 26,030.00 22,630.00 21,630.00 20,630.00 17,750.00 The first service year for a police officer commences upon his being sworn in as a police officer. The police officer shall obtain his second service year on the next succeeding first day of January until he attains the maximum salary for the particular rank he may hold. (d) The Common Council recognizes that recruits are not sworn police officers. However in the interest of establishing an equitable salary for recruits it hereby establishes their salary as follows: 1982 $12,650.00 1983 $14,100.00 $15,750.00 SECTION II. The foregoing salary schedule is subject to renegotiation only if the Indiana Property Tax Control Program of 1973, as amended, is totally abolished so that the City of South Bend could establish its' own property tax rate, or if the South Bend Common Council adopts a Local Option Income Tax Program. SECTION III. In addition to the foregoing annual pay, the officers and members of the Police Department shall receive compen- sation for extra duty for the calendar years 1982 and 1983, as follows: (a) Effective January 1, 1981, if an officer is subpoenaed to court or has to go to court or is required to appear at any given location to validate a complaint, warrant or recall, the officer shall be paid (if off duty) at the rate of time and one -half the officer's regularly scheduled work day and four hours on the officer's regularly scheduled day off. In addition, any officers required to work overtime shall be paid at the rate of one and a half times the officer's normal rate of pay with a minimum of one.hour for any overtime beyond said officer's normal work day schedule. (b) Any officers shall be entitled to receive $31.90 for each of the holidays listed below, whether such holiday is worked or not. Payment shall be made for each holiday during the pay period to which the holiday falls; however, no holiday shall be paid in advance of its occurrence. The holiday pay shall apply only to the following: New Year's Day Fourth of July Lincoln!s. Birthday Labor Day Washington's Birthday Columbus Day Good Friday Veteran's Day Easter Sunday Thanksgiving Day Memorial Day Christmas Day (c) For night incentive and hazard pay, $300.00 per year. SECTION IV. The Common Council recommends as follows: (a) The sworn members of the Police Department shall receive an annual clothing allowance of $500.00. Such clothing allowance shall be distributed one -half by each June 15th and the remaining one -half by each December 15th. (b) That the annual clothing allowance for those individuals holding the rank of Chief, Division Chief or Captain be in the amount of $375.00; and be distributed one -half by each June 15th, and the remaining one -half by each December 15th. (c) That the advancement of rank from Patrolman First Class to Corporal be after three complete years upon satisfactory performance of duty and promotion by the Board of Safety. (d) That the same dollar amount being paid pursuant to the 1981 police salary ordinance for each officer requesting Dependent Health Insurance coverage be continued. (e) That officer working under the Overtime Foot Patrol Program be paid at the rate of $7.50 per hour. (f) That no other special pay programs or salary bonuses such as S.O.S be established, and that if such special programs are needed, that participating officers be paid out of the Overtime monies. SECTION V. All monetary fringe benefits which shall remain at the 1981 levels for the 1982 and 1983 calendar years, may be renegotiated for the 1984 calendar year. -2- In the event of either or both of the conditions described in Section II occurring, the respective Wage Committees of the South Bend Common Council and the Fraternal Order of the Police Lodge No. 36, may negotiate the distribution of any new monies generated to salaries and /or monetary fringe benefits, subject to Common Council passage by ordinance and Lodge ratification. SECTION VI. As you are well aware this offer includes all of the available dollars we could include in this three -year package. Although this package was not ratified by the rank and file of the F.O.P., we believe that it is the best possible offer we can make in these ever - tightening- budgetary times. We believe that the attached ordinance shows the Common Council's sincere belief in making the Police Department a top priority in our City. You will note that the attached Ordinance includes salary figures for the three management ranks, namely: Police Chief, Division Chief, and Captain. These figures are included at the request of the Mayor whose letter is attached, and are not the result of any negotiations between our Committee and these three ranks. The attached Bill is within the guidelines established by the Common Council. We believe it is a fair and equitable package and seek your continuing support of it. All City employees need a fair and reasonable salary for 1982, 1983 and 1984.
